Federal Courts, Overbreadth, And Vagueness: Guiding Principles For Constitution Challenges To Uninterpreted State Statutes, Mark L. Rienzi, Stuart Buck
Federal Courts, Overbreadth, And Vagueness: Guiding Principles For Constitution Challenges To Uninterpreted State Statutes, Mark L. Rienzi, Stuart Buck
Scholarly Articles
When a federal court is asked to declare an uninterpreted state law to be unconstitutionally overbroad or vague, it faces several tensions. On one side, the overbreadth and vagueness doctrines urge the court to strike down the statute on its face. On the other side, the related doctrines of constitutional avoidance, narrowing interpretations, abstention and certification all urge the court to find some way to save the statute at least as to some applications. But because of the cardinal principle that federal courts are not the final authority on the interpretation of state law, many federal courts err on the …

Under the rubric of an ethics of ends, the essay examines, more particularly, the ends of health and efficiency. Under that of duty, it addresses the duties of respect for the dignity of the human person; respect for the covenant of treatment; and respect for justice in distribution. In each case, it seeks to identify the basis for an adequate response …
The Extent Of Protection Of The Individual’S Personality Against Commercial Use: Toward A New Property Right, George P. Smith Ii
The Extent Of Protection Of The Individual’S Personality Against Commercial Use: Toward A New Property Right, George P. Smith Ii
Scholarly Articles
The purpose of this Article is to explore the extent of an individual's right of privacy, vis-à-vis the concepts of commercial use and appropriations, which compromise rights of publicity. The deceptively simple, yet complex, conclusion to be drawn from this analysis is that a delicate balance of interests must be struck, either legislatively or judicially, between recognizing a full right of privacy, and its permutations in the right of publicity, with the press and news media. A definitive balancing test may be elusive, but at a minimum, a framework for principled decision making must be attempted. It is imperative that …
The Science, Law, And Politics Of Fetal Pain Legislation, Kevin C. Walsh
The Science, Law, And Politics Of Fetal Pain Legislation, Kevin C. Walsh
Scholarly Articles
Most people prefer not to inflict gratuitous pain on other sentient beings, especially other humans. What, then, should be the legal system's reaction to the mounting evidence that in late-term abortions doctors are inflicting just such pain on fetuses who have the anatomical, physiological, and neurological capacity to experience it? The pain being inflicted is gratuitous because it can be easily avoided with no significant increases in cost or health risk by the administration of tar geted fetal pain relief. If informed that an abortion is likely to cause pain to the fetus and given a choice between a procedure …
The Global Digital Divide: Focusing On Children, Susanna Frederick Fischer
The Global Digital Divide: Focusing On Children, Susanna Frederick Fischer
Scholarly Articles
This article addresses the global aspect of the digital divide in two ways. First, I will focus primarily on the issue of school-aged children's access to information and communications technologies (ICT) globally. My focus is on children for the simple reason that children embody the future. Second, I will limit my assessment of this issue to a comparison of children's access to ICT in six countries around the world. Located on five continents, these six countries range from highly developed OECD countries to lesser developed countries. They are the United States, the United Kingdom, France, Australia, Mongolia, and Tanzania.

Cigarette Smoking And The Desire To Quit Among Individuals Living With Hiv, Edward M. Mamary, Darlene Bahrs, Sharon Martinez
Faculty Publications
Among individuals living with human immunodeficiency virus (HIV), studies have found that smokers are at greater risk than nonsmokers to develop bacterial pneumonia, oral lesions and acquired immune deficiency syndrome (AIDS) dementia complex. Information is lacking regarding the prevalence of cigarette smoking among people living with HIV or about their intentions to quit smoking. A survey was conducted with a sample of patients attending an HIV outpatient clinic at San Francisco General Hospital to assess the prevalence of cigarette smoking and the level of interest in quitting. In total, 228 assessments were completed. Study results revealed a high percentage of …
Increasing Company Competitiveness: “Tuning-Up” Your Pay System, K. Dow Scott, Dennis Morajda, James W. Bishop
Increasing Company Competitiveness: “Tuning-Up” Your Pay System, K. Dow Scott, Dennis Morajda, James W. Bishop
School of Business: Faculty Publications and Other Works
The cost of labor (i.e., salaries, benefits and incentives) accounts for a sizeable portion of an employer’s operating expenses. Pay packages priced too low or configured improperly can deprive firms of the talent needed to successfully develop, market and produce viable products and services in today’s ultra competitive business environment. However, if pay packages are too high, labor costs can weaken a firm’s ability to compete. For example, a firm with 500 employees can have labor costs that easily exceed $15 million. Thus, building and maintaining a cost-efficient pay system that encourages employee performance without adversely affecting corporate earnings requires …

A Preferred Vision For Administering Elementary Schools : A Reflective Essay, Brad Bridgewater
Graduate Research Papers
Caring is the first trait exhibited by almost every great leader. It may sound like a very soft touchy-feely thing, but it works. The second trait of great leaders, or those who get others to excel, is Integrity. In other words, they can be trusted to tell the truth. They tell the truth in good times and bad, and they tell the truth whether or not it makes them look good or bad.
Finally, great leaders who get others to excel have high expectations. They don't let people get by with mediocrity. No one can really feel good about themselves when …

Wolves In Utah: An Analysis Of Potential Impacts And Recommendations For Management, T. Adam Switalski, Trey Simmons, Shiree L. Duncan, Andreas S. Chavez, Robert H. Schmidt
Natural Resources and Environmental Issues
The historic range of gray wolves (Canis lupus) in Utah was essentially statewide. Although their presence cannot be disputed, the historic abundance of wolves in Utah is unknown. The release of gray wolves into Yellowstone National Park and central Idaho in 1995 established growing populations, and increasing dispersal is bringing these wolves closer to Utah. It seems likely that wolves will commingle with Utah's other native mammals in the near future. The potential presence of wolves in Utah is generating a series of questions and debates. In this report, we review the potential of wolves in Utah and make predictions …
An Investigation Of Labour Ward Care To Inform The Design Of A Computerised Decision Support System For The Management Of Childbirth, Maureen Harris
An Investigation Of Labour Ward Care To Inform The Design Of A Computerised Decision Support System For The Management Of Childbirth, Maureen Harris
School of Nursing and Midwifery Theses
Patient monitoring is a complex task, particularly during childbirth, where assessment of the baby's condition is inferred from the continuous electronic recording of the baby's heart rate pattern and maternal uterine contractions (CTG). Computerised decision support has long been advocated, as difficulties in the interpretation of the CTG have led to failure to intervene and unnecessary intervention. The problem is large, for obstetric litigation now accounts for 80% of the UK National Health Service litigation bill. The Plymouth Perinatal Research Group has developed a computerised decision support system for patient monitoring during childbirth and the UK Medical Research Council has …
Unresolved Complex Mixtures Of Aromatic Hydrocarbons In The Marine Environment : Toxicity, Solubility And Photodegradation Studies, Emma Louise Smith
Unresolved Complex Mixtures Of Aromatic Hydrocarbons In The Marine Environment : Toxicity, Solubility And Photodegradation Studies, Emma Louise Smith
School of Geography, Earth and Environmental Sciences Theses
Unresolved complex mixtures (UCMs) of aromatic hydrocarbons have been found in a wide range of environmental matrices at high concentrations. However, limited consideration has been given to the potential detrimental effects of the accumulation of these compounds in the marine environment. In particular, there is a need to evaluate these compounds in the light of recent evidence that points to the long term effects of oil in the marine environment. The overall aim of this work was therefore to investigate unresolved complex mixtures of aromatic hydrocarbons in the marine environment with particular emphasis on assessment of toxicity, aqueous solubility and …
The Development And Study Of Chelating Substrates For The Separation Of Metal Ions In Complex Sample Matrices, James Cowan
The Development And Study Of Chelating Substrates For The Separation Of Metal Ions In Complex Sample Matrices, James Cowan
School of Geography, Earth and Environmental Sciences Theses
The fabrication and study of high performance chelating substrates for the separation of trace metals using a single column under both isocratic and gradient elutions were investigated. Neutral polystyrene based resins from a variety of manufacturers including a hypercrosslinked resin (MN 200) were functionalised via impregnation with chelating dyestuffs or dynamically modified with small, low molecular weight organic molecules by physical adsorption and chemisorption processes respectively. Improvements in the impregnation of substrates were developed, based upon ultrasonic agitation, along with improvements in the detection of metal ions by the use of a noise reduction system, eluent clean-up procedures and large …
The Role Of Cellular Stress During Cold Ischaemic And Reperfusion Injury, Jonathan Richard Roberts
The Role Of Cellular Stress During Cold Ischaemic And Reperfusion Injury, Jonathan Richard Roberts
Peninsula Medical School Theses
The elemental physiology of the highly complex and regulated cellular response to stress remains poorly understood. Hypothermia and reperfusion are necessary and unavoidable stresses associated with the procurement, storage and transplantation of organs such as the kidney. Signal transduction pathways and transcription factors are evolutionarily conserved mediators of stress responses. This project has investigated the activation of the transcription factors Nuclear Factor kappa B (NFκB), Activator Protein 1 (AP1) and the Heat Shock Factor I (HSF1) as well as the mitogen activated protein kinases (MAPK), p38, JNK and ERK 1 /2, during hypothermic and reperfusion stress in cultured endothelial cells …
Dealing With Complex Evidence Of Domestic Violence: A Primer For The Civil Bench, Jane C. Murphy, Jane H. Aiken
Dealing With Complex Evidence Of Domestic Violence: A Primer For The Civil Bench, Jane C. Murphy, Jane H. Aiken
All Faculty Scholarship
New laws and policies aimed at protecting victims of domestic violence have been adopted across the country throughout the last twenty years. The legal approaches taken to protect battered women and control family violence have brought about significant changes in family law. New laws include statutes permitting civil protection or restraining orders, and laws requiring that domestic violence be considered in custody and visitation decisions. Both of these types of statutory reforms can provide protection to adult victims of domestic violence and their children. Evaluating a parent’s fitness by considering past acts of violence to other family members results in …

This thesis identifies systematically the domains of positive consequences of illness and details the development of a measure of the positive consequences of illness- the Silver Lining Questionnaire (SLQ). Further aims of the thesis include the use of the SLQ as a predictor of health outcome and an investigation of the prevalence and correlates of positivity in illness. The first study questioned 55 people about their positive experiences of illness and uncovered 17 themes. In the second study a pilot questionnaire based on these themes was administered to the participants of the first study and an additional sample of cancer …
Individual Differences In Secretory Immunoglobulin A (S-Iga) Reactivity To Acute Stress, Mark Anthony Wetherell
Individual Differences In Secretory Immunoglobulin A (S-Iga) Reactivity To Acute Stress, Mark Anthony Wetherell
School of Psychology Theses
Secretory immunoglobulin-A (S-IgA) is an antibody found on all surfaces of the common mucosa and serves as a first line of defence against pathogens. S-IgA is the predominant antibody in human secretions and unlike many other immune parameters, can be measured non-invasively in saliva. In addition to being an efficient indicator of health status, S-IgA levels are sensitive to variations in subjective and objective levels of stress, both of which are also influenced by state and trait factors. Stress is known to play an important role in susceptibility to infections of the common mucosa, and as such, the role of …
What Has Happened To Named Nursing? Perceptions Of The Named Nurse System, Ann Josephine Humphreys
What Has Happened To Named Nursing? Perceptions Of The Named Nurse System, Ann Josephine Humphreys
Other Faculty of Health Theses
The purpose of this study was to explore the previously little researched area of the implementation of the Named Nurse Standard in hospital settings. The Standard formed part of the Government's programme of health service reforms that aimed to enhance the patient experience by having an identified nurse in charge of their care from admission to discharge. Quantitative and qualitative methods were used to identify whether nursing work was organised to facilitate the named nurse concept and the patient's perception of who delivered their care. A case study approach in surgical wards in two NHS trusts enabled comparison of clinical …

In this study, the mRNA and protein levels of hypoxia inducible factor 1 (HIF-1α), and a number of genes regulated by hypoxia (VEGF, GLUT-1, p53), were determined in four breast carcinoma cell lines, peripheral blood mononuclear cells (PBMCs) of patients with breast cancer and Type 1 diabetes (TIDM), and in human breast and brain tumour tissue. Breast carcinoma cells and PMBCs from both patients and normal controls were exposed to hypoxia (≤1% 0 2) and/or high glucose. Both up-regulated and down-regulated HIF-1α, GLUT-1 and p53 mRNA expression was observed in the breast carcinoma cell lines exposed to hypoxia and/or high …
Genetic Analysis Of The Microvascular Complications Of Diabetes Mellitus, Deborah F Cross
Genetic Analysis Of The Microvascular Complications Of Diabetes Mellitus, Deborah F Cross
Other Faculty of Health Theses
There is increasing evidence to suggest that genetic factors are involved in the pathogenesis of microvascular complications in diabetes mellitus. Recent studies have suggested that genetic variations in the aldose reductase (ALR2) gene may contribute to the genetic susceptibility to microvascular complications. Aldose reductase is the first and rate-limiting enzyme of the polyol pathway and is implicated in the pathogenesis of diabetic microvascular disease (nephropathy, retinopathy and neuropathy). It has recently been shown that the three polymorphisms of the ALR2 gene are associated with susceptibility to microvascular complications in both TIDM and T2DM. The aim of this study was to …
