Sites Of Redemption: A Wide-Angle Look At Government Vouchers And Sectarian Service Providers, Ira C. Lupu, Robert W. Tuttle

The constitutional issues presented by the use at religious institutions of government-financed vouchers for social services have been addressed repeatedly, but virtually all of the writing in the field focuses exclusively on educational services. Most of that writing, moreover, takes the overly simple view that voucher programs are linear relationships running from government to recipient to service provider. Proponents of such programs argue that the presence of recipients as intermediate decision-makers breaks the link between the state and religion, and therefore solves the constitutional problem of church-state connection. Opponents argue that use of intermediaries is nothing more than "money-laundering," and …

The structure of the U.S. financial services industry has been transformed during the past two decades by the combined forces of new technologies, deregulation and financial innovation. Large banks, securities firms and life insurers have responded to these forces by pursuing a twofold consolidation strategy - acquiring direct competitors within their traditional industry sector and making cross-industry acquisitions in other sectors. The Gramm-Leach-Bliley Act of 1999 ratified the ongoing trend toward cross-industry consolidation and facilitated the creation of large financial conglomerates. This Article begins by surveying the myriad ways that increasing globalization of communication, travel, and trade, and in particular the rise of the Internet, have forced judges and legal scholars to "adapt" traditional rules for legal jurisdiction to the new economic and social environment. For example, if a person posts content online that is legal where posted but illegal in some place where it is viewed, can that person be subject to suit in the far-off location? It should come as no surprise that the Bush administration showed little interest in adopting Vice President Gore's ambitious, high profile National Performance Review (NPR) agenda. One area, however, where the Bush administration would do well to embrace the NPR's efforts is the plain language initiative. While it would be hyperbole to suggest that the NPR's efforts dramatically improved the clarity of the government's written communication (including statutes, regulations, policies, instructions, etc.), some progress was made. Fine-Tuning Acquisition Reform's Favorite Procurement Vehicle, The Indefinite Delivery Contract, Karen Thornton

This article provides an assessment of the effectiveness of the efforts to improve efficiency and commercialize government procurement, seven years after the passage of the Federal Acquisition Streamlining Act. The reforms that abolished inflexible rules and empowered a reduced acquisition workforce have been criticized as allowing agencies to obscure the transparency of traditionally rule-bound federal procurement, using sole source methods and bundling to limit competition. This Article asserts the problems associated with indefinite delivery contracting can be alleviated if more attention is devoted to accountability and enhancing contracting officer participation on the acquisition team.

The efficient market hypothesis is a special case in finance. It explains only tiny fractions of observed phenomena. Perhaps its major contribution is a formal definition of an ideal market world, to which policy formulations may be directed and against which they can be measured. Indeed, it seems unlikely that the infirmities of market action ever will be so minuscule as to render the EMH more than a special case, though it may explain more in the future than it does now. Following the 9/11 terrorist attacks, those arguing that international law cannot serve as an effective tool in the fight against terrorism have grown. The ranks of international relations realists, who view international law primarily as a cover for strategic interests and thereby as lacking any independent bite, has swelled. In November 2001, President Bush issued an executive order asserting the authority to use military commissions to try individual terrorism suspects captured by the United States. Such commissions would be conducted unilaterally and would not be required to include procedural safeguards to protect the rights of the accused. This crisis has …

This Article, part of a symposium entitled "Lawyering for a New Democracy," explores current issues related to the changing roles of public interest lawyers engaged in Community Economic Development (CED) in a new democracy. After discussing current issues and trends in CED practice, the author concludes that CED is inherently privatized and is becoming more so with the national emphasis on economic self-sufficiency. The author provides lessons from law school clinical practice of enhanced strategic collaborations and highlights current trends and issues involving technology, leadership development, community organizing, asset accumulation, and social capital. OBJECTIVE: To establish the prevalence of fear of fatness (the desire to be thinner) and associated factors, including obesity, reported energy, iron and folate intakes. The difficulties in defining overweight among Irish children and an assessment of dietary and socio-economic factors related to dental caries and also reported in the group. METHODS: A one-year follow up study of 251 healthy schoolchildren at baseline (119 boys and 132 girls; mean age 11 years) attending 7 fee-paying (6 single- and 1-mixed sex) and 8 non-fee-paying (4 single- and 4 mixed-sex) schools in Dublin city center. Background: Most patients with Friedreich ataxia (FA) have a GAA trinucleotide repeat expansion in intron 1 of the FA gene (FRDA) on both arms of chromosome 9. However, some patients are compound heterozygotes and harbor a GAA expansion on one allele and a point mutation on the other. Compound heterozygous patients with FA who have a GAA expansion and a G130V mutation have been reported to have an atypical phenotype with a slow disease progression, minimal or no ataxia, or gait spasticity. We have studied object persistence and availability of 1,000 digital library (DL) objects. Twenty World Wide Web accessible DLs were chosen and from each DL, 50 objects were chosen at random. A script checked the availability of each object three times a week for just over 1 year for a total of 161 data samples. During this time span, we found 31 objects (3% of the total) that appear to no longer be available: 24 from PubMed Central, 5 from IDEAS, 1 from CogPrints, and 1 from ETD.

Focusing Feedback on Interpersonal Skills: Practice Makes Perfect is a Web-Based learning environment enabling standardized patients (SPs) to develop, practice and enhance constructive feedback skills. The Web-based training environment for SPs features realistic professional healthcare provider/patient video scenarios, graphics, audio and immediate feedback in a student-centered self-instructional environment. SPs, who are trained to simulate an illness and portray a patient in a realistic and consistent way, subsequently provide feedback from a patient's perspective to students undergoing communication and interpersonal skills training in health science fields like medicine and nursing.

One critical step in addressing and resolving the problems associated with human errors is the development of a cognitive taxonomy of such errors. In the case of errors, such a taxonomy may be developed (1) to categorize all types of errors along cognitive dimensions, (2) to associate each type of error with a specific underlying cognitive mechanism, (3) to explain why, and even predict when and where, a specific error will occur, and (4) to generate intervention strategies for each type of error. Technological and cultural factors influence access to health information on the web in multifarious ways. We evaluated structural differences and availability of communication services on the web in three diverse language and cultural groups: Chinese, English, and Spanish. A total of 382 web sites were analyzed: 144 were English language sites (38%), 129 were Chinese language sites (34%), and 108 were Spanish language sites (28%). We did not find technical differences in the number of outgoing links per domain or the total availability of communication services between the three groups. Objective: To see the clinical features and treatment of children with Acute Myeloid Leukemia (AML) in Pakistan. Setting: Tertiary referral at a specialist Hematology/Oncology center.
Methods: Retrospective, chart-based review of children (less than 14 years) admitted to the hospital with a diagnosis of AML between January 1987 and August 1997.
Results: A total of 23 patients were admitted. There were 18 males and 5 females. The mean age was 8 5 years. M3 was the commonest morphological subtype (43%). Twenty- two percent of the patients presented with hyperleucocytosis (TLC> 100 x i09 /L) and 95% with an elevated …

Objectives: To compare the clinical benefits of granulocyte-colony stimulating factor (G-CSF) or granulocyte macrophage-colony stimulating factor (GM-CSF) plus standard supportive care to supportive care alone among cancer patients with febrile neutropenia.
Methods: Clinical data were collected retrospectively from 148 consecutive cancer patients with neutropenia and fever. Patients had hematologic (i.e., acute leukemias or lymphoproliferative disorders) or non-hematologic malignancies (i.e., solid tumors including carcinoma of breast, lung, or colon). Clinical variables analyzed included: age and sex; underlying malignancies; chemotherapy regimens; symptoms at time of presentation; duration of fever prior to study enrollment; days from chemotherapy until administration of GM-CSF or …

A pilot study evaluating the Second Step, Middle School/Junior High®program was conducted to determine its effect on students’ attitudes regarding aggression and perceived difficulty of performing social skills. Sixth-through eighth-grade students (N = 714) were surveyed before and after the pro-gram was implemented by teachers in intervention classrooms. Second Step students were taught curricular modules corresponding to their year in middle/junior high school. Program effects were tested using a repeated measures design. Relative to nonparticipants, Second Step students in their second year of school de-creased in their overall endorsement of aggression and perceived difficulty of per-forming social skills. This Note addresses the efficacy of construing the term "wages" RCW 51.08.178 to include employer-provided health insurance, hoping to serve as a resource for the Legislature to reevaluate IIA's wage definition in light of Cockle. First, this Note gives a general background of IIA and the Act's time-loss compensation scheme. Next, this Note discusses how Washington and other jurisdictions treat fringe benefits in defining "wages." This thesis aimed to provide an integrated model of infant feeding, centred on women's experiences. Two studies were employed in order to meet this aim. Firstly, a questionnaire-based longitudinal study within a Social Cognitive framework was carried out in order to understand the internal and external processes involved in the infant feeding experience. Eighty-five first time mothers participated in this study. Participants were assessed at three stages; once during pregnancy, once at six to eight, and again at four to six moths postpartum. The main goal of this study was to develop a theory of missionary outreach to unchurched Czech people which is biblically informed and culturally relevant. The theoretical proposal for a plausible model of churching in the Czech Republic builds on basic theological, philosophical, and conceptual assumptions (chapter 2), a societal analysis of the problem of Czech churching (chapter 3), and a review of the issues relating to the situation of existing churches and religious movements.

In this article, the author proposes that the traditional custom-based standard applicable in medical malpractice cases be replaced with a reasonable, prudent physician standard that will more adequately take into account the role of the physician in rationing care. Part I of this article focuses on the heightened tension between tort and contract in managed health care.
