February 27, 2001 marked the 200th anniversary of the Federal Courts of the District of Columbia, the courts we know today as the United States District Court for the District of Columbia and the United States Court of Appeals for the District of Columbia. The history of these courts is interesting, albeit somewhat confusing; their names changed no fewer than six times since their creation. Indeed, from 1863 until 1893, the two courts were joined and called the Supreme Court of the District of Columbia. In my view, whether or not Article III is written as members of a new constitutional convention might write it, there is nothing more fundamental to the way our entire judicial system operates (including in many ways, although indirectly, our state courts) than federal judges being as independent as law can make them. Larry Mitchell's book describes the movement toward share price maximization by corporate managers. More intensive market competition both domestically and abroad has led managers to believe that their corporations have little choice but to focus on short-term profits. This practice leads to greater instability for corporate workers and efforts to externalize other costs on third parties. It also intensifies the erosion of "local" cultural practices that are seen as impediments to profit maximization, whether they are associated with countries abroad, communities in the United States, or within the corporation itself. Describes one particular approach to teaching evidence-based practice in physical therapy. At Sacred Heart University students begin course work that is foundational to preparing them for evidence-based practice. In the first semester of study, they take a Concepts in Measurement unit. During the second semester, I teach a semester-long Clinical Research course that focuses on understanding concepts of clinical research and on critical review of physical therapy literature. During the third and fourth semesters of study, when they are doing their clinical coursework, the emphasis is on the concepts of validity and reliability of the tools they use. The students …

Consumer bankruptcy insures individuals against misfortune. Like other forms of insurance, bankruptcy reduces an individual's incentive to guard against misfortune and provides her with an incentive to overstate her need for relief. The "first-best," or optimal, bankruptcy system, like the first-best tax or public assistance system, solves these moral hazards without any loss of efficiency. In bankruptcy, this first-best approach would deny relief to debtors responsible for their own distress and reduce the deserving debtors' obligations to an amount commensurate with their ability to pay. Evidence suggests that the feminist consensus on Jean-Jacques Rousseau “misogyny” is breaking down.New studies are emerging that bring to light the many sympathetic portrayals of women in Rousseau’s works and the important role he ascribed to women within the family. Some modern feminists are even finding ways of reading Rousseau that speak to women’s concerns today. Overturning the notion that Rousseau was an arch-misogynist will be an uphill battle, however, given how very widespread it has become. Proteolytic Specificity Of Lactobacillus Delbrueckii Subsp. Bulgaricus Influences Functional Properties Of Mozzarella Cheese, B. S. Oommen, Donald J. Mcmahon, C. J. Oberg, Jeff Broadbent, M. Strickland

Nutrition, Dietetics, and Food Sciences Faculty Publications

Low-moisture part-skim Mozzarella cheeses were manufactured from 2% fat milk and aged for 21 d. Treatments included cheeses made with one of three different strains of Lactobacillus delbrueckii ssp. bulgaricus in combination with a single strain of Streptococcus thermophilus. A fourth, control treatment consisted of cheeses made with only S. thermophilus. Although total proteolytic ability of these strains, as indicated by the o-phthaldialdehyde analysis, was similar in each of the three strains of L. bulgaricus, these strains exhibited different proteolytic specificities toward the peptide, αs1-CN (f 1-23). Less expensive bench-scale composting reactor systems which can mimic actual composting process via self-heating are needed. One can achieve such systems without using the expensive temperature feed-back control by properly insulating the bench composting reactors. However, the knowledge of heat generation and transfer in bench composting reactors is essential in properly designing such inexpensive insulation systems. All compost trial temperature profiles illustrated initial elevated temperature levels followed by a slow gradual temperature decreasing phase. Of all of the variables, the airflow rate, the volume and the overall heat transfer coefficient, seem to have the greatest impact on producing thermophilic temperatures. …

This essay addresses the challenges of controlling toxic harms through an intensive case study of efforts to regulate and remedy dioxin contamination in the U.S. pulp and paper industry. By focusing on the struggle to control a specific toxic harm in a specific industrial sector, the essay explores the politicized nature of toxic harms in the United States and, in the process, highlights the considerable shortcomings of existing legal frameworks and institutions for dealing with problems of such scope and complexity. This paper considers how emotions can foster compliance by rational actors with international environmental law. Many environmental issues are highly emotionally charged. Both supporters of and opponents to international environmental law often feel very strongly about their positions and views. A psychological game-theoretic model focuses on the disciplinary role that losing face may play in compliance with international environmental law. This model implies that non-compliance, especially by high-profile international actors, should be highly and swiftly publicized upon detection and verification. Enron has brought about demands from many quarters to grant the Securities and Exchange Commission (SEC) new powers. Among the powers the SEC now seeks is the power to bar or suspend securities law violators from serving as an oflicer or director of any public company. Currently, the law assigns this power only to federal district courts. In this Essay, Professor Barnard traces the history of the current law; examining why Congress has expressly withheld suspension and bar powers from the SEC. Incentives To Create Under A "Lifetime-Plus-Years" Copyright Duration: Lessons From A Behavioral Economic Analysis For Eldred V. Ashcroft, Avishalom Tor, Dotan Oliar

In this Article, we highlight for the first time some of the significant but hitherto unrecognized behavioral effects of copyright law on individuals' incentives to create and then examine the implications of our findings for the constitutional analysis of Eldred v. Ashcroft. We show that behavioral biases - namely, individuals' optimistic bias regarding their future longevity and their sub-additive judgments in circumstances resembling the extant rule of copyright duration - explain the otherwise puzzling lifetime-plus-years basis for copyright protection given to individual authors, and reveal how this regime provides superior incentives to create. As scholars of world religions search for promising ways of responding to the ecological crisis, the Christian tradition can look for inspiration to Descriptio Positionis Seu Situationis Monasterii Claraevallensis, a twelfth-century description of the site and surroundings of Clairvaux abbey. The text exudes the unnamed author's deep appreciation and gratitude for the cooperative interactivity of human beings, other species, the land, water, and air that assured their mutual sustainability and maintained the site's integrity.
