Statement Before The United States House Of Representatives Concerning Charitable Choice And The Community Solutions Act , Carl H. Esbeck Jan 2002

Statement Before The United States House Of Representatives Concerning Charitable Choice And The Community Solutions Act , Carl H. Esbeck

Faculty Publications

First, charitable choice imposes on both government and participating faith-based organizations (FBOs) the duty to not abridge certain enumerated rights of the ultimate beneficiaries of these welfare programs. Second, the statute imposes on government the duty to not intrude into the institutional autonomy of faith-based providers. Third, the statute reinforces the government's duty to not discriminate with respect to religion when determining the eligibility of private-sector providers to deliver social services.

Using Dispute System Design Methods To Promote Good-Faith Participation In Court-Connected Mediation Programs, John M. Lande Jan 2002

Using Dispute System Design Methods To Promote Good-Faith Participation In Court-Connected Mediation Programs, John M. Lande

Faculty Publications

This article discusses what can be done to promote productive behavior in mediation and reduce bad conduct. Although most participants do not abuse the mediation process, some people use mediation to drag out litigation, gain leverage for later negotiations, and generally wear down the opposition. Rules requiring good-faith participation are likely to be ineffective and possibly counterproductive. This article proposes using dispute system design principles to develop policies satisfying the interests of stakeholders in court-connected mediation programs. After outlining important interests of key stakeholder groups, including litigants, attorneys, courts, and mediators, the Article describes specific policies that could satisfy their …

Diagnosis And Placement Variables Affecting The Outcome Of Adolescents With Behavioral Disorders, Mary A. Peterson, Mark Scanlan

Faculty Publications - Doctor of Psychology (PsyD) Program

The treatment of adolescents with behavior disorders represents significant challenges. This article reviews some of the most effective behavioral and pharmacological treatments identified in the research. The study used outcome data from a residential treatment program to identify variables that predicted level of functioning post-discharge. Significant variables included diagnosis (mood vs. behavior disorder spectrum), co-morbidity and discharge placement.

Marine & Environmental Sciences Faculty Reports

The following report on the status of US Caribbean coral reef ecosystems has been summarised from more extensive reports submitted to the US Coral Reef Task Force (USCRTF) working group that implemented in 2000 ‘A National Program to Assess, Inventory, and Monitor US Coral Reef Ecosystems’. The more-lengthy reports are also the basis for the biennial-issued document, ‘Status and Trends of US Coral Reef Ecosystems’. Each author is a recognised technical expert with responsibility for monitoring and/or managing aspects of their respective coral reef ecosystems.

Boater Manatee Awareness System, Edward O. Keith Jan 2002

Boater Manatee Awareness System, Edward O. Keith

Marine & Environmental Sciences Faculty Reports

A variety of "see-in-the-dark" technologies have been evaluated with the objective of adapting them to detect Florida manatee (Trichechus manatus latirostris) aggregations in specific highuse areas, such as warm water refuges in the winter time. Once it is possible to passively detect manatee aggregations in these sites, the construction of boater awareness signs that would indicate how many manatees are in the area, on a real-time basis, is envisioned. The contention is that boaters would be more likely to obey speed restrictions if these restrictions were accompanied by this type of information. The ability to do this also …

Ischemic Monomelic Neuropathy: A Complication Of Vascular Access Procedure, Malik Anas Rabbani, Aasim Ahmad, Syed Mansoor Ahmed Shah, Tahseen Mozzaffar, Mahesh Moolani, Syed Sohail Ali

Section of Nephrology

Ischemic monomelic neuropathy (IMN) is an infrequently recognized type of ischemic neuropathy produced by shunting blood or acute occlusion of a major proximal artery in the extremities. IMN predominantly occurs in diabetic patients with evidence of peripheral atherosclerotic vascular disease and neuropathy. We report a case of ischemic monomelic neuropathy occurring in a diabetic patient with end-stage renal disease following the placement of polytetrafluoroethylene (PTFE) graft as a vascular access in the proximal upper arm for chronic hemodialysis.

Towards Sustainable Charcoal Production And Use: A Systems Approach, Evans Kituyi Jan 2002

Towards Sustainable Charcoal Production And Use: A Systems Approach, Evans Kituyi

East Africa Institute

The majority of African households will continue depending on traditional fuels to meet their daily energy needs for many decades to come. In particular, the demand for charcoal in most countries in the region continues to grow at high rates owing to the ever-increasing rural-urban migration. These trends, coupled with inefficient charcoal production and consumption practices, and inaccessibility by most households to reliable and affordable commercial energy forms puts in deep uncertainty the future dependence on the already-dwindling biomass resource for energy. A systems approach to sustainable biomass production and consumption as regards charcoal is proposed. Based on the life-cycle …

A Comparison Of Aeration Methods And Diets For Larval Culture Of The Edible Sea Urchin, Tripneustes Ventricosus (Echinodermata: Echinoidea), Ray Wolcott

HCNSO Student Theses and Dissertations

Tripneustes ventricosus (Lamarck 1816), a major near-shore herbivore in the Atlantic and Caribbean, has been harvested for human consumption in the Caribbean for centuries (Lawrence 2001a, b), occasionally at rates that exceed sustainability (Smith & Berkes 1991), and is among the species having economic importance (Lawrence & Bazhin 1998). Tripneustes ventricosus has recently been observed on the forereef controlling macroalgal growth in the absence of Diadema antillarum (Woodley 1999, Aronson & Precht 2000, Haley & Solandt 2001).

Large-scale culturing has the potential to produce T. ventricosus in sufficient numbers to be used for: bioremediation of coral reef degradation, restocking of …

Mortality Benefit Of Angiotensin-Converting Enzyme Inhibitors After Cardiac Events In Patients With End-Stage Renal Disease, Peter A. Mccullough, Keisha R. Sandberg, Jerry Yee, Michael P. Hudson

Nephrology Articles

Hypothesis/introduction. The risks and benefits of angiotensin-converting enzyme (ACE) inhibitors in patients with end-stage renal disease (ESRD) after cardiac events are unknown. We sought to determine the independent effect of ACE inhibitors (ACE-I) on long-term mortality in ESRD patients after cardiac events. Materials and methods. We analysed a prospective coronary care unit registry and identified 527 ESRD patients, 368 with complete data on medications prescribed, over eight years at a single, tertiary centre. Results. The overall mean age was 64.4±13.8 years with 54.9% men, and 59.2% African-American. A total of 143/386 (37.0%) were prescribed ACE-I during the hospital stay for …

"I Went To Learn," Meanings Of The European Tour Of Senator Robert M. La Follette, 1923, Nancy Unger

History

In 1923, progressive Senator Robert M. La Follette, an astute observer of government, economics, and social conditions, toured Europe in preparation for his third-party presidential bid. This article examines that trip and its legacy, particularly in relation to Daniel T. Rodgers' 1998 book Atlantic Crossings: Social Politics in a Progressive Age.1

It Takes A Community To Prosecute, Anthony C. Thompson Jan 2002

It Takes A Community To Prosecute, Anthony C. Thompson

Faculty Articles

Serious treatment of the concept of community prosecution would seem to require deeper thinking about the goals, values, and optimal methods of a community-oriented approach than is currently apparent. This Article will attempt to explore some of these issues, using the programs that have already been developed as a basis for identifying approaches likely to prove successful as well as the pitfalls that such programs may encounter. Part I of the Article lays the foundation for this inquiry by reviewing those core elements of the traditional approach to prosecution that are most germane to a discussion of an alternative community-based …

Performance Limits Of Labriform Propulsion And Correlates With Fin Shape And Motion, Jeffrey A. Walker Phd, Mark W. Westneat Jan 2002

Performance Limits Of Labriform Propulsion And Correlates With Fin Shape And Motion, Jeffrey A. Walker Phd, Mark W. Westneat

Faculty Publications

Labriform locomotion, which is powered by oscillating the paired pectoral fins, varies along a continuum from rowing the fins back and forth to flapping the fins up and down. It has generally been assumed (i) that flapping is more mechanically efficient than rowing, a hypothesis confirmed by a recent simulation experiment, and (ii) that flapping should be associated with wing-shaped fins while rowing should be associated with paddle-shaped fins, To determine whether these hypotheses and the results of the simulation experiment are consistent with natural variation, we compared the steady swimming performance (critical swimming speed) of four species of labrid …
