Ambiguous Bleeding: Purity And Sacrifice In Bali, Lene Pedersen Oct 2002

Ambiguous Bleeding: Purity And Sacrifice In Bali, Lene Pedersen

Anthropology and Museum Studies Faculty Scholarship

Menstrual beliefs and practices in Bali defy simple classification. Menstruation may be relegated to the dump, as when a woman had to undergo a rite on a street midden when her monthly period coincided with the ritual time for a purification ceremony. But menstruation is also viewed as conferring raja status, and women do exhibit agency in this supposedly passive process. Experiences of menstruation, furthermore, may vary according to caste status.

Maintaining The Adversarial System: The Practice Of Allowing Jurors To Question Witnesses During Trial, Kristen Debarba Oct 2002

Maintaining The Adversarial System: The Practice Of Allowing Jurors To Question Witnesses During Trial, Kristen Debarba

Vanderbilt Law Review

A defendant sits in the witness stand undergoing examination by his attorney. He is accused of armed robbery, among other criminal acts. During the course of the defendant's testimony, a juror blurts out that he has a question. The judge tells the juror to write his question down and advises the juror that he will be able to ask his question upon completion of the attorneys' examinations. When the juror's question is finally asked, the judge indicates to the defendant's attorney that the attorney should address the matter raised by the juror on reexamination. During the reexamination, the attorney turns …

Press One For Warrant: Reinventing The Fourth Amendment's Search Warrant Requirement Through Electronic Procedures, Justin H. Smith Oct 2002

Press One For Warrant: Reinventing The Fourth Amendment's Search Warrant Requirement Through Electronic Procedures, Justin H. Smith

Vanderbilt Law Review

Numerous rulings by the Supreme Court have confirmed the long-held assertion that the Fourth Amendment's warrant requirement is a "centerpiece for the law of search and seizure, and that prescreening by neutral and detached magistrates is [at] the heart of citizens' protection against police overreaching." On September 21, 1994, however, these assertions proved inaccurate and painfully hollow for Betty Ingram, a fifty-three-year-old diabetic who awoke to the sound of armed police officers charging through her front door. The officers, who were searching for a suspect involved in a buy- and-bust operation, had neither obtained a search warrant nor knocked and …

Text And Image, David Reed Oct 2002

Text And Image, David Reed

Theses

The purpose of this thesis is to create images that juxtapose forms of the English language, with both related and non-related imagery, to create the illusion of realistic situations. My images will be expressed through computer-imaging processes, and non-toxic printmaking techniques, and will include the printing procedures and the problems associated with it. I will discuss not only the similarities and differences of artists who have influenced my work, but also my source material. The latter having been derived from observing and recording various uses of the English language, both as humor or social comment, and in the form of …

The Marriage Of The False Claims Act And The Freedom Of Information Act: Parasitic Potential Or Positive Synergy?, James R. Moncus, Iii Oct 2002

The Marriage Of The False Claims Act And The Freedom Of Information Act: Parasitic Potential Or Positive Synergy?, James R. Moncus, Iii

Vanderbilt Law Review

The qui tam provisions of the False Claims Act ("FCA" or "the Act") allow private citizens to prosecute fraud on the government's behalf. There are at least three primary justifications for such provisions: (1) the need to provide private incentives to expose fraudulent conduct, (2) the Justice Department's unwillingness to aggressively prosecute fraud, and (3) the limited enforcement resources available to the federal government. The FCA contains a jurisdictional bar that provides that no court shall have jurisdiction over a qui tam FCA action if the information on which the action is based has been publicly disclosed. Ostensibly, this jurisdictional …

The Source Of Hip, Shelly J. Eversley Oct 2002

The Source Of Hip, Shelly J. Eversley

Publications and Research

This essay situates Norman Mailer's "The White Negro" (1957) and Jack Keroauc's The Subterraneans (1958) in the context of 1950s racial integration and the transformative potential of interracial sex. It argues that both authors' terms, "beat" and "hip," depend on the idea of "the Negro" whose status allows them to imagine a counter culture essential to their midcentury articulations of individual integrity and creative freedom.

A Different Face Of Faith-Based Politics: Social Capital And Community Organizing In The Public Arena, Richard L. Wood, Mark R. Warren

Sociology Faculty and Staff Publications

The role of religion in American politics and civil society has drawn significant scholarly focus, but most of the recent attention has fallen on the religious rights political influence and, more recently, on new initiatives to broaden the channeling of social service funding through faith- based organizations. These are important issues, but they exclude another historically important face of religiously-grounded public engagement: religious pressure for deeper political and economic democracy. We examine a widespread contemporary aspect of such engagement, faith-based community organizing (FBCO), through which poor and middle-income religious congregations advance the interests of their members. We analyze data from …

Legal Orientalism, Teemu Ruskola Oct 2002

Legal Orientalism, Teemu Ruskola

Michigan Law Review

Fifty years ago comparative law was a field in search of a paradigm. In the inaugural issue of the American Journal of Comparative Law in 1952, Myres McDougal remarked unhappily, "The greatest confusion continues to prevail about what is being compared, about the purposes of comparison, and about appropriate techniques." In short, there seemed to be very little in the field that was not in a state of confusion. Two decades later, referring to McDougal's bleak assessment, John Merryman saw no evidence of progress: "few comparative lawyers would suggest that matters have since improved." And only a few years ago, …

Suspecting The States: Supreme Court Review Of State-Court State-Law Judgments, Laura S. Fitzgerald Oct 2002

Suspecting The States: Supreme Court Review Of State-Court State-Law Judgments, Laura S. Fitzgerald

Michigan Law Review

At the Supreme Court these days, it is unfashionable to second-guess states' fealty to federal law without real proof that they are ignoring it. As the Court declared in Alden v. Maine: "We are unwilling to assume the States will refuse to honor the Constitution or obey the binding laws of the United States. The good faith of the States thus provides an important assurance that 'this Constitution, and the Laws of the United States which shall be made in Pursuance thereof ... shall be the supreme Law of the Land.'" Accordingly, without proof that a state has "systematic[ally]" …

American Legal Ethics, Thomas L. Shaffer Oct 2002

American Legal Ethics, Thomas L. Shaffer

Journal Articles

The ethics of American lawyers come from the English gentleman-lawyer of the nineteenth century, with the steady addition of an elitist Jeffersonian gloss. But they have, within the last century, been seperated, so that reulation claims to operate without conscience. The result is that the law of lawyers is now the principal, if not only, feature of the official codes, and ethics as ethics is is spread oer insignificant consensus statements by bar associations and promising scholarship from academic lawyers, some small part of which deserves to be called ethics and even, from small beginnings to be called religious ethics.

Zola(R) Energy: On The Film Adaptations Of Emile Zola's La Bete Humaine, Walter C. Metz Oct 2002

Zola(R) Energy: On The Film Adaptations Of Emile Zola's La Bete Humaine, Walter C. Metz

Publications

This essay reads the Fritz Lang film noir, Human Desire (1954) as an intertextual reworking of La Bete humaine (Jean Renoir, 1938), in turn an adaptation of Emile Zola's eponymous novel (1890). I argue that whereas Renoir's film worries about the impending World War II, Lang's grapples with the noir legacy of a post-war world devoid of hope. This traps Zola's novel in a middle ground: the novel is set on the brink of the French destruction in the Franco-Prussian War of 1871, but is written twenty years afterward.

How Important Are Classroom Peer Effects? Evidence From Boston's Metco Program, Joshua David Angrist, Kevin Lang Oct 2002

How Important Are Classroom Peer Effects? Evidence From Boston's Metco Program, Joshua David Angrist, Kevin Lang

Upjohn Institute Working Papers

Most integration programs transfer students between schools within districts. In this paper, we study the impact of Metco, a long-running desegregation program that sends mostly black students out of the Boston public school district to attend schools in more affluent suburban districts. We focus on the impact of Metco on the students in one of the largest Metco-receiving districts. In the 2000 school year, Metco increased the proportion black in this district from about 7.5 percent to almost 12.5 percent. Because Metco students have substantially lower test scores than local students, this inflow generates a significant decline in scores, with …

The Paradox Of Auxiliary Rights: The Privilege Against Self-Incrimination And The Right To Keep And Bear Arms, Michael Steven Green Oct 2002

The Paradox Of Auxiliary Rights: The Privilege Against Self-Incrimination And The Right To Keep And Bear Arms, Michael Steven Green

Duke Law Journal

According to Locke's theory of the social contract, which was widely accepted by the Founders, political authority is limited by those natural moral rights that individuals reserve against the government. In this Article, I argue that Locke's theory generates paradoxical conclusions concerning the government's authority over civil disobedients, that is, people who resist the government because they believe it is violating reserved moral rights. If the government lacks the authority to compel the civil disobedient to abide by its laws, the result is anarchism: The limits on governmental authority are whatever each individual says they are. If the government has …

The Development Of A Multipurpose Trap (The Nzi) For Tsetse And Other Biting Flies, S. Mihok Oct 2002

The Development Of A Multipurpose Trap (The Nzi) For Tsetse And Other Biting Flies, S. Mihok

All Peer-Reviewed Publications

New trap designs for tsetse (Glossinidae), stable flies (Muscidae: Stomoxyinae), and horse flies (Tabanidae) were tested in Kenya to develop a multipurpose trap for biting flies. Many configurations and colour/fabric combinations were compared to a simplified, blue-black triangular trap to identify features of design and materials that result in equitable catches. New designs were tested against conventional traps, with a focus on Glossina pallidipes Austen and G. longipennis Corti, Stomoxys niger Macquart, and Atylotus agrestis (Wiedemann). A simple design based on minimal blue and black rectangular panels, for attraction and contrast, with a trap body consisting of an innovative configuration …

Research Collection School Of Computing and Information Systems

This paper discusses new challenges and possible approaches for developing and evolving mobile information systems, with focus on model-based approaches on the conceptual and logical level. We have experienced these new challenges through several research and industrial projects on mobile solutions, usability and model-based approaches over the last years. We summarize the main challenges on how model-based approaches can support the development of mobile information systems that are to be used together with other types of systems, primarily in a professional setting and indicate upcoming research issues in this very dynamic area. We argue that this research area is also …

Faculty Publications and Presentations

This research generates a method for easy comparison of national military doctrines as they pertain to peacekeeping operations by using the Conceptual Model of Peace Operations (CMPO) as an organizational framework. Microsoft Excel is utilized as an interface as a means for individuals or organizations to compare individual national peacekeeping doctrines on an independent framework. This project also utilizes graphing techniques to allow users to view more generalized comparisons of doctrine so conclusions might be more readily drawn with regards to specific areas of coverage, areas of doctrine needing to be more fully or less extensively addressed, and the political …

The State of the Union and Recommendation Clauses of Article II, Section 3provide that the President "shall from time to time give to the Congress Information of the State of the Union, and recommend to their consideration such Measures as he shall judge necessary and expedient. "Those thirty-one words envision the President as the lead active participant in the embryonic stages of the making of laws. Eight separate principles animate the President's legislative duties and powers before the presentment process. When the State of the Union and Recommendation Clauses are seen to have this textual and analytical subtlety, they reveal …

Recruitment Of Engaged Couples For Premarital Counseling: An Empirical Examination Of The Importance Of Program Characteristics And Topics To Potential Participants, Kieran T. Sullivan, Carmen Anderson Oct 2002

Recruitment Of Engaged Couples For Premarital Counseling: An Empirical Examination Of The Importance Of Program Characteristics And Topics To Potential Participants, Kieran T. Sullivan, Carmen Anderson

Psychology

The recent emphasis on prevention in helping couples to avoid marital distress may be limited by lack of participation in prevention programs by engaged couples. The purpose of this study is to understand what potential participants perceive are attractive characteristics in premarital prevention approaches. Eighty-six engaged couples completed questionnaires assessing demographics, personality and the relative importance of premarital program characteristics. The results indicate that leader characteristics, content, and topics such as communication, finances, and problem-solving are the most important elements of premarital counseling to couples. Differences based on gender and risk level are reported. Suggestions are made for more effective …

The Relationship Of Ethnicity Ethnic Identity And Problem Type To Preferences For Counselor Race In College Students: A Survey Of African-American And European-American Students, Sara H. Bausch

Psychology Theses & Dissertations

African-American and European-American participants were surveyed to determine the relationship of ethnicity, ethnic identity, and type of presenting problem on preferences for counselor ethnicity. Participants indicated their preferences for counselor characteristics, including ethnicity, for personal and academic problems. Data were analyzed using analysis of variance and regression techniques. The results indicated that African American participants prefer ethnically similar counselors and all participants with high ethnic identity prefer ethnically similar counselors. The results suggested that participants prefer different characteristics for different problems. Participants indicated more willingness to seek help for academic problems. Ethnicity was a significant predictor of preference for an …

Fathers play a critical role in the development of their children. Recent research indicates that fathers who are actively and responsibly involved in raising their children can make a lasting difference in their lives. Fathers play a particularly important role in their children's academic success. One activity that fathers can engage in with their children that has been consistently linked with better school performance is reading. The Fathers Reading Every Day (FRED) program was developed to encourage fathers to become active in their children's early literacy development. This article provides an introduction to the FRED program.
