Constitutional Issues In Information Privacy, Fred H. Cate, Robert Litan
Constitutional Issues In Information Privacy, Fred H. Cate, Robert Litan
Michigan Telecommunications & Technology Law Review
The U.S. Constitution has been largely ignored in the recent flurry of privacy laws and regulations designed to protect personal information from incursion by the private sector despite the fact that many of these enactments and efforts to enforce them significantly implicate the First Amendment. Questions about the role of the Constitution have assumed new importance in the aftermath of the September 11, 2001 terrorist attacks on the World Trade Center and the Pentagon. Recent efforts to identify and apprehend terrorists and to protect against future attacks threaten to weaken constitutional protections against government intrusions into personal privacy. However, these …

Researching Remedies In Intellectual Property Actions Involving Computer Technology: A Research Guide, Daniel N. Kassabian
Michigan Telecommunications & Technology Law Review
The purpose of this research guide is not to answer the question "What remedies are available to an owner of computer related technology whose rights have been infringed?" but to provide a methodology by which a legal practitioner can find the answer to this question. This guide sets forth materials and methods of research that can be used for an inquiry that is broad in scope, such as researching which legal scheme's remedial component best suits a client's technology, but that are also capable of being used for a narrow or limited inquiry, such as looking for specific remedies available …

A Case Study In The Use Of Cognitive-Behavioral Treatment Of Emotional And Behavioral Symptoms Related To A Traumatic Brain Injury, Urszula Kobylinska
Theses and Dissertations
The purpose of this study was to examine the effectiveness of cognitive-behavioral therapy techniques with traumatic brain injury (TBI) individuals using a case study format. The subject of this study was a 54-year-old woman who suffered a traumatic brain injury in an automobile accident. For the purpose of this study, she was seen over a six-month period beginning in January 2002. Major emphasis was on reducing depression and anxiety related to TBI and increasing her social and vocational functioning. Anxiety and depression were pre- and post-tested using the Beck Depression Inventory and Sheehan Anxiety Scale. Post-testing suggested significant decreases in …

While the honors program at Clemson University has not developed its own technology plan, the university’s efforts have opened interesting opportunities. Most of our interdisciplinary honors seminars are taught in a smart classroom, with a computer that projects onto a screen, so Internet resources can easily be accessed. I’ve taught honors seminars there, such as one on “2001: The History of the Future,” and use the computer projection to show web pages to the class. I am particularly fond of the Oxford English Dictionary on line, to which Clemson subscribes; looking up the definition of a word that has become …

Journal of the National Collegiate Honors Council Online Archive
In the spring of 2001, an Introduction to Literature course was integrated with a Western Civilization II course, creating an honors learning community taught by two full-time Red Rocks Community College instructors. Of the eighteen students enrolled, approximately half were in the honors program. The hybrid course met twice a week for 2 1⁄2 classroom hours total (the typical hours for a traditional class); other course work was completed online.
The hybrid learning community presented a wonderful opportunity to utilize technology to enhance this unusual learning environment. The strength of the community turned out to be online discussions using WebCT, …

“The honors program, in distinguishing itself from the rest of the institution, serves as a kind of laboratory within which faculty can try things they have always wanted to try but for which they could find no suitable outlet. When such efforts are demonstrated to be successful, they may well become institutionalized, thereby raising the general level of education within the college or university for all students. In this connection, the honors curriculum should serve as a prototype for educational practices that can work campus-wide in the future.” (NCHC. “Basic Characteristics of a Fully-Developed Honors Program.” National Honors Report 22(7), …

Western Harvester Ants’ Foraging Success And Nest Densities In Relation To Grazing Intensity, Shaharra Usnick, Richard Hart
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
Western harvester ants, Pogonomyrmex occidentalis, are seed eaters that occur in short- and mid-grass prairies. Harvester ants are efficient seed predators but they may also be seed dispersers. We examined what ants collect to address that question. We also studied how different cattle grazing intensities affected harvester ant nest densities. Items collected by western harvester ant foragers returning to their nests were categorized as non-seeds, seeds, and nothing. Harvester ants collected large amounts of non-seeds (48%), followed by seeds (33%) and nothing (19%). Western harvester ants tolerate some environmental stress caused by grazing because nest densities were highest in …

Review Of Bounty And Benevolence: A History Of Saskatchewan Treaties By Arthur J. Ray, Jim Miller, And Frank Tough, Jennifer S. H. Brown
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
This is a solid and useful contribution to the growing literature on the so-called "numbered treaties" with Native Peoples in the Canadian West. Its focus is on the five treaties negotiated with the First Nations whose homelands included parts of the present province of Saskatchewan: Treaties 4, 5, 6, 8, and 10, signed during the period from 1874 into the early twentieth century. Initially advertised with the subtitle A Documentary History of Saskatchewan Treaties, the volume indeed emphasizes evidence from and interpretations of written documents, some quoted at length. The authors note that the original intent was "to embody …

Court Review: Volume 39, Issue 3 - Going To Scale: A Conversation About The Future Of Drug Courts, Greg Berman
Court Review: Journal of the American Judges Association
Drug courts are the most prominent example of a wave of “problem-solving” innovation that has sought to change the way courts operate in this country. Alongside drug courts, domestic violence courts, community courts, family treatment courts, mental health courts, and other specialized courts are using the authority of the judicial branch in new ways—in an effort to improve outcomes for victims, communities, and defendants. These problem-solving courts employ new tools and new methods— such as requiring defendants to appear regularly before judges to report on their compliance with court orders, or adding social scientists, drug treatment counselors, and other service …

Court Review: Volume 39, Issue 3 - Trial By Metaphor: Rhetoric, Innovation, And The Juridical Text, Benjamin L. Berger
Court Review: Journal of the American Judges Association
The judicial decision-making process is not one for which resolution arises from counting, measuring, or weighing. Rather, the courtroom is a field for debate about the interpretation and application of values as embodied in or reflected by the law. Decisions reached in court are judgments and not mathematical conclusions in that the inherently contestable nature of the issues at stake precludes an outcome that is selfevident to all. As such, although there is an element of factfinding that emerges in a judicial opinion, there is also always a subjective valuation of the principles at stake; to draw on Socrates, there …
Review Of Indian Orphanages By Marilyn Irvin Holt, Michael C. Coleman
Review Of Indian Orphanages By Marilyn Irvin Holt, Michael C. Coleman
Great Plains Quarterly (through 2013)
During research on American Indian schooling, I sometimes noticed references to orphan children, yet never pursued the matter. Fortunately, Marilyn Irvin Holt did, and her carefully-researched and moving book is the first comprehensive study of Indian orphanages. Although critical of their failings, Holt comes to a surprisingly positive conclusion. Located on reservations, they "offered a way for youngsters to maintain contact with their tribal groups" and "provided a point of identity for both residents and the larger Indian community." When mounting criticism of institutionalization forced the closure of many orphanages in the twentieth century, tribal people became more vulnerable to …

Review Of Working The Garden: American Writers And The Industrialization Of Agriculture By William Conlogue, Mary Paniccia-Carden
Great Plains Quarterly (through 2013)
In Working the Garden William Conlogue critiques readings of American literature dependent on pastoral assumptions, proposing instead a georgic perspective that would examine "the history of the intersections we have made among human work, human imagination, and the physical environment." While he takes a somewhat reductive view of previous critical approaches and of American applications of pastoral modes, his demonstration of the ways in which georgic questions alter our understanding of our literature promises to be of significant importance to the study of Great Plains literature.
The georgic, Conlogue explains, "explores the lived landscapes of rural experience" where "our ambiguous …

Extinct And Extirpated Birds Of Texas, Stanley D. Casto
Extinct And Extirpated Birds Of Texas, Stanley D. Casto
Bulletin of the Texas Ornithological Society
Twenty-four species or subspecies, some based on isolated skeletal fragments and of questionable status, have been reported from paleontological and archeological sites in Texas. One species dates from the Late Triassic, 3 from the Cretaceous, 7 from the Pliocene, 8 from the Pleistocene and 5 from the Holocene. Two species, the Passenger Pigeon and Carolina Parakeet, are known to have been extirpated from Texas in modern times.

An Automated Technique For Monitoring Nocturnal Avian Vocalizations, James B. Johnson, Daniel Saenz, D. Brent Burt, Richard N. Conner
Bulletin of the Texas Ornithological Society
We used audio recording dataloggers known as Frogloggers to collect nocturnal bird vocalizations at eight different sites within the Davy Crockett National Forest and the Stephen F. Austin Experimental Forest in eastern Texas from 9 May 2000 to 31 June 2001. We programmed the dataloggers to record for one-minute intervals at the beginning of each hour starting at 2100 and ending at 0200 DST. Our technique has the potential to determine the relative seasonal occurrence of nocturnally vocalizing species. Originally developed for amphibians, this technology is proving useful for avian monitoring.

Review Of American Women Of Letters And The Nineteenth-Century Sciences: Styles Of Affiliation By Nina Baym, Melissa J. Homestead
Department of English: Faculty Publications
As in her previous books on nineteenth-century American women writers, Baym's most recent book presents an impressive survey and synthesis of women cultural producers and their products. Even though nineteenth-century American women had neither the education nor the opportunities to be research scientists in the modern sense (a sense that was only beginning to be formulated and institutionalized), Baym contends that they nevertheless "affiliated" themselves with the sciences and used print culture to promote science and (male) scientists to America as essential to its national identity. "Ceding most of the doing of science-the production of new scientific knowledge in the …
