Lesbigay Identity As Commodity, David M. Skover, Kellye Y. Testy Jan 2002

Lesbigay Identity As Commodity, David M. Skover, Kellye Y. Testy

Articles

This Essay explores the deep dissonance that exists today between the validation of American LesBiGays in the commercial marketplace and their devaluation in political and legal arenas, and questions the failure of legal scholars and civil rights activists to account meaningfully for this dissonance in their theories and practices. I

n America's popular culture, LesBiGay identities abound. In its political culture, however, they emerge more tentatively. The commercial and entertainment industries increasingly commodify and celebrate LesBiGay identities. The courts and legislatures generally discount and condemn them. Thus, there is a deep dissonance between the validation of LesBiGay identities in the …

Linking Progressive Corporate Law With Progressive Social Movements, Kellye Y. Testy Jan 2002

Linking Progressive Corporate Law With Progressive Social Movements, Kellye Y. Testy

Articles

Professor Testy critically assesses what has been termed a "new" corporate social responsibility project After noting the hegemony of shareholder primacy in corporate law, she critiques four major counter-hegemonic discourses: team production theory, corporate social accountabiity, stakeholder theory, and corporate social responsibility (or progressive corporate law). Finding the first three ineffective foils for the problems of corporate power that have spurred calls for reform, she turns to an examination of the progressive corporate law project. That project, presently poised at a defining juncture as it attempts to use the "master's tools" to "dismantle the master's house," nonetheless holds promise for …

From Having Copies To Experiencing Works: The Development Of An Access Right In U.S. Copyright Law, Jane C. Ginsburg Jan 2002

From Having Copies To Experiencing Works: The Development Of An Access Right In U.S. Copyright Law, Jane C. Ginsburg

Faculty Scholarship

This essay addresses how current U.S. copyright law responds to new forms of distribution of copyrighted works, through the emerging right to control digital access to copyrighted works, as set out in § 1201 of the 1998 Digital Millennium Copyright Act. When the exploitation of works shifts from having copies to directly experiencing the content of the work, the author's ability to control access becomes crucial. Indeed, in the digital environment, without an access right, it is difficult to see how authors can maintain the exclusive Right to their Writings that the Constitution authorizes Congress to secure. Even if Congress …

Education is one of the major aspect to be considered in building a civilized nation. When we speak of education, therefore it must pertain to this reality of man and not simply to his body and his animal aspect Education in the Islamic point of view emphasizes both on the physical and the spiritual aspects of life. If the foundation of the system of education is relevant to the reality of human creation in a civilization, inevitably nation building will produce good citizen of the world and the hereafter. Information Domain Modeling Of Emergent Phenomena, Ron Fulbright Jan 2002

Information Domain Modeling Of Emergent Phenomena, Ron Fulbright

Theses and Dissertations

Study in fields such as distributed artificial intelligence (DAI), decentralized artificial intelligence (DzAI), parallel artificial intelligence (PAl), multiagent systems (MAS), computer supported cooperative work (CSCW), artificial life (AL), and complex adaptive systems (CAS) is concerned with the cooperation, coordination, communication, and coherence of multiple agents working together to achieve a common goal. The notion that the ability of a collective can exceed the sum of the individuals is a fundamental concept and a generally accepted truth. However, no general theoretical explanation exists as to why this could or should be the case. This dissertation explores such an explanation by considering …

On The Edge Of Chaos: A Delphi Study Of The Changing Role Of The Secondary Principal., Rebecca H. Goodwin

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of this study was to describe the changing role of the secondary principal. The study examined the contemporary high school principalship and described changes in the principalship, the role of the contemporary principal, and the preferred future for the principalship. Recognizing the complexity of the position, the study also used chaos and complexity theory to critically analyze the findings and to discern if the theory provided an understanding of these changes and their impact. This was a mixed-method two-stage study conducted electronically with both qualitative and quantitative instruments. The first stage used the Delphi method of research to …

Bullying In Schools : Understanding And Interventions, Donkar Wangmo Jan 2002

Bullying In Schools : Understanding And Interventions, Donkar Wangmo

Graduate Research Papers

Bullying in schools is a worldwide problem that can have negative consequences for the general school climate and for the right of the students to learn in a safe environment without fear (Banks, 1997). Bullying can also have negative lifelong consequences, both for students who bully and for their victims. Although much of the formal research on bullying has taken place in the Scandinavian countries, Great Britain, and Japan, the problems associated with bullying have been noted and discussed wherever formal schooling environments exist (Banks, 1997). Olweus (1993) reported that one child out of every seven is either a bully …

A Preferred Vision For Administering Elementary Schools : A Reflective Essay, Audrey Wallican-Green Jan 2002

A Preferred Vision For Administering Elementary Schools : A Reflective Essay, Audrey Wallican-Green

Graduate Research Papers

All eyes are watching school leaders every day. According to Betty Hollas (2001) in Keeping Your StaffMotivated, administrators are the "CEO's (Chief Example for Others)" (p. 7). Staff, students, parents and the school community are examining and interpreting everything principals do and don't do, say, wear, and our overall behavior. Since administrators are under watchful eyes, we have to be positive, energetic, fair, and confident. My life experiences, including the education I received in the principalship program at the University of Northern Iowa and my goals as a future administrator based on the Iowa Standards for School Leaders have influenced …

Surface Micromachined Force Gauges: Uncertainty And Reliability, Jonathan W. Wittwer, Troy Gomm, Larry L. Howell Jan 2002

Surface Micromachined Force Gauges: Uncertainty And Reliability, Jonathan W. Wittwer, Troy Gomm, Larry L. Howell

Faculty Publications

Surface micromachining of micro-electro-mechanical systems (MEMS), like all other fabrication processes, has inherent variation that leads to uncertain material and dimensional parameters. By considering the effects of these variations during the design of micro force gauges, the gauge uncertainty and reliability can be estimated. Without means of calibrating micro gauges, these effects are often significant when compared to experimental repeatability. The general force gauge model described in this paper can be used to measure a wide range of forces, and simple design changes can lead to improved accuracy in measurement. A method of probabilistic design is described that is not …

Bringing Online Learning To Campus: The Hybridization Of Teaching And Learning At Brigham Young University, Gregory L. Waddoups, Scott L. Howell Jan 2002

Bringing Online Learning To Campus: The Hybridization Of Teaching And Learning At Brigham Young University, Gregory L. Waddoups, Scott L. Howell

Faculty Publications

The primary purpose of Brigham Young University (BYU) is to provide students with a combination of sacred and secular education often described as the BYU experience. Achieving this purpose is challenged by the rapid growth in Church membership and an enrollment cap of 30,000 students. To address these challenges, BYU sponsors the use of technology to bridge the gap between the increased Church membership and the number of students allowed under the enrollment caps. This institutional case study shows how these challenges have influenced the hybridization of teaching and learning for on campus (resident) and off campus (distance) students. It …

The Investment Opportunity Set And Capitalization Versus Expensing Methods Of Accounting Choice, Dan S. Dhaliwal, William G. Heninger, K.E. Hughes Ii Jan 2002

The Investment Opportunity Set And Capitalization Versus Expensing Methods Of Accounting Choice, Dan S. Dhaliwal, William G. Heninger, K.E. Hughes Ii

Faculty Publications

This paper examines the effects of the investment opportunity set (IOS) on management's decision to capitalize or expense significant costs in two diverse settings: (1) in accounting for exploration and development (E&D) costs by firms in the oil-and-gas industry, and (2) in accounting for research and development (R&D) costs by firms (across industries) prior to 1974. We argue that the relation between the IOS and the decision to capitalize versus to expense is based upon managerial incentives to reduce the variance of accounting earnings. High-growth firms are more likely to have more variable earnings, which therefore creates greater incentives to …

The Influence Of Pitch And Loudness Changes On The Acoustics Of Vocal Tremor, Christopher Dromey, Paul Warrick, Jonathan Irish Jan 2002

The Influence Of Pitch And Loudness Changes On The Acoustics Of Vocal Tremor, Christopher Dromey, Paul Warrick, Jonathan Irish

Faculty Publications

The effect of tremor on phonation is to modulate an otherwise steady sound source in its amplitude, fundamental frequency, or both. The severity of untreated vocal tremor has been reported to change under certain conditions that may be related to muscle tension. In order to better understand the phenomenon of vocal tremor, its acoustic properties were examined as individuals volitionally altered their pitch and loudness. These voice conditions were anticipated to alter the tension of the intrinsic laryngeal muscles. The voices of 10 individuals with a diagnosis of vocal tremor were recorded before participating in a longitudinal treatment study. They …

Vibrato Rate Adjustment, Christopher Dromey, Neisha Carter, Arden Hopkin Jan 2002

Vibrato Rate Adjustment, Christopher Dromey, Neisha Carter, Arden Hopkin

Faculty Publications

Summary: The goal of the present study was to document the acoustic changes that occur as singers attempt to increase or decrease their vibrato rate to match target stimuli. Eight advanced singing students produced vowels with vibrato in three registers, both naturally and while attempting to match faster or slower rate stimuli. Slower rates were associated with lower intensity and less steady vibrato. Faster rates involved increased vibrato extent in the chest register and increased intensity in the head register. Singers whose spontaneous vibrato rates were naturally either slower or faster tended to also be relatively slower or faster when …

Investing In The Arts: Financial And Aesthetic Returns To Prints, Adam Finkelstein Jan 2002

Investing In The Arts: Financial And Aesthetic Returns To Prints, Adam Finkelstein

University Avenue Undergraduate Journal of Economics

This paper will revisit the economic question “is buying art profitable?” facing any potential investor by focusing specifically on the market for prints. The answer will account for both pecuniary and aesthetic benefits. Previous inquiry into the returns of investments in art and their methodologies is first reviewed. Then a framework for measuring utility from prints from market-observed leasing prices is described. Various price indexes for returns to Picasso and Chagall prints are compiled for the years 1977 to 1997 using a market basket technique. The indexes are then combined with the utility framework. Real and nominal returns to prints, …

English Language Proficiency And Wage Rates Of Mexican Immigrants, Jeremy Sandford Jan 2002

English Language Proficiency And Wage Rates Of Mexican Immigrants, Jeremy Sandford

University Avenue Undergraduate Journal of Economics

This paper studies the effect of English language deficiency on the wage rates of Mexican immigrants. Using a sample of 81,059 labor market male Mexican Immigrants taken from Census PUMS data, I find that the direct effect of English language deficiency on earnings is virtually nonexistent for immigrants with low education and experience levels. The results show that only immigrants with at least a high school education or some US labor market experience will make less than their immigrant counterparts who speak English very well. The cost of language deficiency to those with some education or experience, however, is large. …

Discrimination Against Canadian Colours, Veevek Thankey Jan 2002

Discrimination Against Canadian Colours, Veevek Thankey

University Avenue Undergraduate Journal of Economics

Canada is a nation of immigrants. Decades of open and compassionate immigration policies have earned Canada a solid reputation abroad in this regard. However, as long as there has been immigration in this country, concerns have existed over the impact of immigration on the labour market and, more importantly, the role that discrimination plays regarding income differentials. This paper will analyze the earning differentials of immigrants, which shall be defined as ethnic minorities.
