The Role Of Outdoor Recreation In Family Enrichment, Patti A. Freeman, Ramon B. Zabriskie Jan 2002

The Role Of Outdoor Recreation In Family Enrichment, Patti A. Freeman, Ramon B. Zabriskie

Faculty Publications

The family is the fundamental unit in society and perhaps the oldest and most important of all human institutions. Several studies have indicated a positive correlation between strong, successful families and family participation in outdoor recreational activities. This paper addresses the role of structured outdoor recreation programming in family enrichment. Findings from two studies based in the United States are presented: one on the effect of a one–day family outdoor adventure program on parental and child perceptions of family functioning and the other from a qualitative inquiry into the meaning of family residential camping experiences. The first study collected both …

Birth Of A Paradigm: Digital Technology And Its Effect On Literary Studies, Chad Michael Verbais Jan 2002

Birth Of A Paradigm: Digital Technology And Its Effect On Literary Studies, Chad Michael Verbais

Masters Theses

Digital technology is changing the landscape of literary studies. In essence, the proliferation of computer technology and hypertext is forcing literary scholars to look at how the expanded role of the visual in our society is influencing the way we read and disseminate texts, especially hypertexts, while they also come to a better understanding of the role of the reader in a digital environment and the overall value of electronic literature. Literary studies is witnessing the birth of a new paradigm through digital technology in textual production and dissemination that will not only raise new questions, but further examine age-old …

"Woman Arise!": Political Work In The Writings Of Lu Dalton, Sheree Maxwell Bench Jan 2002

"Woman Arise!": Political Work In The Writings Of Lu Dalton, Sheree Maxwell Bench

Theses and Dissertations

In 1872, Mormon plural wife, educator, and suffragist Lucinda Lee Dalton began writing fiery political essays and insightful poetry for the Woman's Exponent from her small community in southern Utah. Through her writings Dalton endeavors to shape the opinions of Exponent readers by working within public discourse toward the goal of equality for women. At times both optimistic and troubled, she uses the rhetorical strategies of humor, irony, reason, identification, and persuasion to educate men and women on disparities and to encourage women to participate actively in their own emancipation. She often engages in a dialogical process with other writers …

American Prophet, New England Town: The Memory Of Joseph Smith In Vermont, Keith A. Erekson Jan 2002

American Prophet, New England Town: The Memory Of Joseph Smith In Vermont, Keith A. Erekson

Theses and Dissertations

In December 1905, a large granite monument was erected at the birthplace of Joseph Smith on the one hundredth anniversary of his birth. This thesis relates the history of the Joseph Smith Memorial Monument from its origins through its construction and dedication. It also explores its impact on the memory of Joseph Smith in the local, Vermont, and national context. I argue that the history of the Joseph Smith Memorial Monument in Vermont is the story of the formation and validation of the memory of Joseph Smith as an American Prophet.

Nineteenth century Mormons remembered a variety of individual memories …

Activist Desire, Cultural Criticism, And The Situationist International, David Banash Jan 2002

Activist Desire, Cultural Criticism, And The Situationist International, David Banash

Reconstruction: Studies in Contemporary Culture

[First paragraph]

In the world of Anglo-American criticism, Situationism was once the province of hip theorists, progressive art historians, and a few scattered Marxists. No more, for the nineties saw Situationism come from obscure movement to the defiant avant of our cultural-critical-garde. Not only has the past decade seen the publication of a dozen books, countless articles, dissertations, and both academic and activist web-sites, the Situationists have moved right into the main line of pop-culture. Situationist graffiti turns up as the epigraph for gen-xer Elizabeth Wurtzel's Bitch: In Praise of Difficult Women (1988), and, with Rolling Stone darling Greil Marcus's …

The Promise And Pitfalls Of Using Imprecise School Accountability Measures, Thomas J. Kane, Douglas O. Staiger Jan 2002

The Promise And Pitfalls Of Using Imprecise School Accountability Measures, Thomas J. Kane, Douglas O. Staiger

Dartmouth Scholarship

In recent years, most states have constructed elaborate accountability systems using school-level test scores. However, because the median elementary school contains only 69 children per grade level, such measures are quite imprecise. We evaluate the implications for school accountability systems. For instance, rewards or sanctions for schools with scores at either extreme primarily affect small schools and provide weak incentives to large ones. Nevertheless, we conclude that accountability systems may be worthwhile. Even in states with aggressive financial incentives, the marginal reward to schools for raising student performance is a small fraction of the potential labor market value for students.

European Courts, American Rights: Extradition And Prison Conditions, Daniel J. Sharfstein Jan 2002

European Courts, American Rights: Extradition And Prison Conditions, Daniel J. Sharfstein

Vanderbilt Law School Faculty Publications

Part I of this Article discusses the rising number of extradition requests by the United States, the common grounds for denial of extradition, and the controversies that such denials have aroused. Part II examines Soering v. United Kingdom against this background and analyzes its scholarly reception, influence on international and foreign jurisprudence, and lack of effect in the United States. Part III explores the implications of SOERING for defenses to extradition based on prison conditions: whether prison conditions in the United States could conceivably rise to the level of a human rights violation, whether the European Court of Human Rights …

Regulatory Traffic Jams, J.B. Ruhl, James Salzman, Kai-Sheng Song Jan 2002

Regulatory Traffic Jams, J.B. Ruhl, James Salzman, Kai-Sheng Song

Vanderbilt Law School Faculty Publications

Notwithstanding the tremendous amount of attention environmental agencies, policy analysts, and scholars have paid to "regulatory reinvention," it has been pitched primarily as a refinement of the sanction and facilitation models, and thus intended to be channeled through the firm-specific behavioral responses predicted under the rational polluter and good-apple models. Little attention has been paid to the systems level question. The relevant question under the systems model is whether there is a component of noncompliance that does not respond to sanction and facilitation policies that are intended to illicit firm-specific behavioral responses. To answer this will require (1) identifying instances …

Democracy's Baby Blocks: South Africa's Electoral Commissions, Vijay Padmanabhan Jan 2002

Democracy's Baby Blocks: South Africa's Electoral Commissions, Vijay Padmanabhan

Vanderbilt Law School Faculty Publications

Like many other transitional democracies, South Africa has chosen to run its two national postapartheid elections by an independent electoral commission, not by the existing government. Although the results were widely considered legitimate, the perception of legitimacy was due in large part to the public's low expectations. To keep the public confidence, and to avoid the sorts of large-scale breakdowns in the electoral process that might undermine it, the current Electoral Commission must embrace major reforms. One of the Electoral Commission's most pressing problems is the fact that opposition parties believe it is strongly biased in favor of the ruling …

On Apology And Consilience, Erin O'Connor Jan 2002

On Apology And Consilience, Erin O'Connor

Vanderbilt Law School Faculty Publications

This article chimes in on the current debate about the proper relationship between apology and the law. Several states are considering legislation designed to shield apologies from the courtroom, and mediators are increasing their focus on the importance of apologies. The article develops an evolutionary economic analysis of apology that combines the tools of economics, game theory and biology to more fully understand its role in dispute resolution. When the analysis is applied to the uses of apology before and at trial, a more sophisticated understanding of the relationship between apology and the law emerges.

The Jurisprudence And Politics Of Forum-Selection Clauses, Erin O'Connor Jan 2002

The Jurisprudence And Politics Of Forum-Selection Clauses, Erin O'Connor

Vanderbilt Law School Faculty Publications

Recent US court enforcement of foreign forum-selection clauses is durable only to the extent that the clauses make the contracts more valuable to the parties. The clauses can create value by making dispute resolution more certain, reliable, sensible, or efficient. In a few cases, the clauses can create value by significantly increasing the costs of formal dispute resolution. However, sometimes forum-selection clauses create no value. Rather, they simply reflect the stronger contracting party's desire to litigate at home. In these cases, both parties to the contract prefer a legal rule under which foreign forum-selection clauses are not enforced. Forum-selection clauses …

Responding To District Systemic Change: A Case Study Of Campus Leadership Team Member Responses Regarding School-Based Management, Mona Rae Davidson Briggs Jan 2002

Responding To District Systemic Change: A Case Study Of Campus Leadership Team Member Responses Regarding School-Based Management, Mona Rae Davidson Briggs

Theses and Dissertations

The intent of this study was to explore to what extent school-based management (SBM) was being implemented in one urban middle school and to specifically analyze attitudes and perceptions of participants' beliefs and opinions around issues of power, information, knowledge, and rewards. A qualitative case study approach was used that included interviews with the Campus Leadership Team (CLT) members, observations, and review of relevant school and district documents. Study findings revealed that SBM was intended to be a strategy for ensuring that fundamental changes would take place to support improved student performance. While student academic achievement was the primary focus, …

Clinical Significance Of Molecular Expression Profiles Of Hürthle Cell Tumors Of The Thyroid Gland Analyzed Via Tissue Microarrays, A. Hoos, A. Stojadinovic, B. Singh, M. Dudas, Denis H. Y. Leung, A. Shaha

Research Collection School Of Economics

Hürthle cell tumors are rare thyroid neoplasms for which disease biology is poorly understood and diagnosis of carcinoma can be challenging. The aim of the study was to characterize molecular expression profiles of Hürthle cell tumors and to determine the clinical significance of identified phenotypes. Paraffin-embedded tissue cores of normal thyroid (n = 18), and histopathologically well-defined Hürthle cell adenomas (n = 27), Hürthle cell tumors of unknown malignant behavior (n = 7), and minimally (n = 14) and widely (n = 21) invasive Hürthle cell carcinomas were arrayed in triplicate on tissue microarrays. Expression profiles of p53, mdm-2, p21, …
