Convictions Of Innocent Persons In Massachusetts: An Overview, Stanley Z. Fisher Oct 2002

Convictions Of Innocent Persons In Massachusetts: An Overview, Stanley Z. Fisher

Faculty Scholarship

Scholars documenting the incidence and causes of wrongful convictions in the United States have focused on cases arising all across the country. Because reform of the practices that lead to such errors of justice must largely take place on the state level, there is value in examining wrongful convictions in particular jurisdictions. This article attempts to identify and briefly describe all known cases of conviction of innocent persons in Massachusetts from 1800 to the present time. Part I discusses the criteria for identifying "the innocent." For the purpose of gaining support for needed reforms in the law, the most persuasive …

Speckle Observations Of Binary Stars With The Wiyn Telescope. Iii. A Partial Survey Of A, F, And G Dwarfs, Elliott P. Horch, Sarah Robinson, Zoran Ninkov, William F. Van Altena, Reed D. Meyer, Sean E. Urban, Brian D. Mason

Articles

Two hundred thirty nearby main-sequence stars with spectral types in the range of A to G have been observed by way of speckle interferometry using the WIYN 3.5 m telescope at Kitt Peak, Arizona. The stars had no previous mention of duplicity in the literature. Of those observed, 14 showed clear evidence of a companion, and 63 were classified as suspected nonsingle based on a power spectrum analysis. The remaining stars discussed show no evidence of duplicity to the limit of the detection system in high-quality observations.

Negotiating And Analyzing Electronic License Agreements, Duncan E. Alford Oct 2002

Negotiating And Analyzing Electronic License Agreements, Duncan E. Alford

Faculty Publications

Mr Alford analyzes license agreements for electronic resources and suggests certain negotiation points to consider when entering into such an agreement. He begins by describing the results of a survey of law librarians about their preparation for and techniques used when negotiating electronic license agreements and the legal strategies used by publishers to support the licensing of electronic information. After reviewing selected principles of licensing issued by library associations and several standardized electronic license agreements, he identifies provisions in a typical agreement that should concern libraries and suggests certain arguments to use in negotiating terms more favorable to the library.

Quibbles'n Bits: Making A Digital First Sale Doctrine Feasible, Victor F. Calaba Oct 2002

Quibbles'n Bits: Making A Digital First Sale Doctrine Feasible, Victor F. Calaba

Michigan Telecommunications & Technology Law Review

Whereas the first sale doctrine historically permitted the transfer and resale of copyrighted works, license agreements used by software companies and the DMCA's strict rules prohibiting tampering with access control devices frustrate exercise of the first sale doctrine with respect to many forms of digital works[...] This article explores the first sale doctrine as it pertains to digital works and proposes ways to make a digital first sale doctrine feasible. Part II describes the first sale doctrine as it has traditionally been applied to non-digital works. Part III discusses modern technology's impact on the distribution and use of copyrighted material. …

Researching Remedies In Intellectual Property Actions Involving Computer Technology: A Research Guide, Daniel N. Kassabian

Michigan Telecommunications & Technology Law Review

The purpose of this research guide is not to answer the question "What remedies are available to an owner of computer related technology whose rights have been infringed?" but to provide a methodology by which a legal practitioner can find the answer to this question. This guide sets forth materials and methods of research that can be used for an inquiry that is broad in scope, such as researching which legal scheme's remedial component best suits a client's technology, but that are also capable of being used for a narrow or limited inquiry, such as looking for specific remedies available …

The Development And Validation Of The Ethical Climate Index For Middle And High Schools, Laura E. Schulte, Franklin Titus Thompson, Jeanie Talbott, Ann Luther, Michelle Garcia, Shirley Blanchard, Laraine Conway, Melanie Mueller

Counseling Faculty Publications

One school characteristic that needs to be considered as important in keeping schools safe is school climate. The purposes of this study were to develop and validate an instrument that measures the ethical climate of middle and high schools. To create the School Ethical Climate Index (SECI), we adapted the Ethical Climate Index for graduate and professional school programs to apply to middle and high schools. The SECI measures a school’s sense of community by assessing student and teacher interactions and relationships through the application of five ethical principles: respect for autonomy, nonmaleficence, beneficence, justice, and fidelity. To provide evidence …

For the purpose of this study, she was seen over a six-month period beginning in January 2002. Major emphasis was on reducing depression and anxiety related to TBI and increasing her social and vocational functioning. Anxiety and depression were pre- and post-tested using the Beck Depression Inventory and Sheehan Anxiety Scale. Post-testing suggested significant decreases in …

The Pickup Truck Being A Scholarly Paper On The Efficiencies Effected By Modern Technology, Don Tucker Oct 2002

The Pickup Truck Being A Scholarly Paper On The Efficiencies Effected By Modern Technology, Don Tucker

Journal of the National Collegiate Honors Council Online Archive

Sometime last spring, Dr. Bill bought a two-year-old pickup truck from one of his patients who is a used car dealer. Dr. Bill2 and I are hunting and fishing buddies, and the pickup seemed a good idea for towing a boat and such things. The pickup has an extended cab where my chocolate lab girl-dog can ride on our outings. I asked if the truck could be repaired with bailing wire and spit. He said one might also need a roll of duct tape since friction tape was hard to find these days. I said that I thought he’d made …

Review Of Voices Of A New Chicana/O History By Refugio Rochín And Dennis Valdes, James A. Garza Oct 2002

Review Of Voices Of A New Chicana/O History By Refugio Rochín And Dennis Valdes, James A. Garza

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

The demographic changes affecting America's ethnic populations are a reminder that history is in constant flux. In particular, the Latina/o population is seeing its social and political influence grow, especially in the Midwest. How will mainstream America deal with this new reality? As politicians struggle over this issue, Chicana/o scholars are also finding that past definitions no longer fit today's academic environment. Voices of a New Chicanalo History, an informative and stimulating compilation of fourteen essays, represents this new historical debate. Edited by Refugio I. Rochfn and Dennis N. Valdes, the volume brings together a diverse group of Chicana/o …

Flooding In Kansas Respondents’ Satisfaction With Emergency Response Measures And Disaster Aid, Bimal Kanti Paul Oct 2002

Flooding In Kansas Respondents’ Satisfaction With Emergency Response Measures And Disaster Aid, Bimal Kanti Paul

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Several counties of south-central and southeast Kansas experienced floods in the first week of November 1998. The communities of Arkansas City and Augusta were among those most severely affected by these floods. This study is based primarily on a mail questionnaire survey of residents of these two communities, and it examines respondents' satisfaction with four emergency response measures employed by local officials and emergency management agencies before and during the flood event. The extent of external support victims received and the level of their satisfaction with that support were also investigated. The analysis of the survey data shows that the …

Court Review: Volume 39, Issue 3 - Going To Scale: A Conversation About The Future Of Drug Courts, Greg Berman Oct 2002

Court Review: Volume 39, Issue 3 - Going To Scale: A Conversation About The Future Of Drug Courts, Greg Berman

Court Review: Journal of the American Judges Association

Drug courts are the most prominent example of a wave of “problem-solving” innovation that has sought to change the way courts operate in this country. Alongside drug courts, domestic violence courts, community courts, family treatment courts, mental health courts, and other specialized courts are using the authority of the judicial branch in new ways—in an effort to improve outcomes for victims, communities, and defendants. These problem-solving courts employ new tools and new methods— such as requiring defendants to appear regularly before judges to report on their compliance with court orders, or adding social scientists, drug treatment counselors, and other service …

Court Review: Volume 39, Issue 3 - Merit Selection And Retention: The Great Compromise? Not Necessarily, Victoria Cecil Oct 2002

Court Review: Volume 39, Issue 3 - Merit Selection And Retention: The Great Compromise? Not Necessarily, Victoria Cecil

Court Review: Journal of the American Judges Association

In the November 2000 election, the citizens of Florida had the opportunity to switch from the nonpartisan elective system to a merit selection and retention system for selecting trial judges in their respective circuits and counties. Although the majority of Florida voters favored electing their trial judges, this issue has spurred intense debate in the legal community concerning which is the better method for judicial selection. The crux of the debate centers on whether the judiciary should be independent or accountable to the public. On one end of the spectrum, judges are seen as heads of a branch of government …

Court Review: Volume 39, Issue 3 - Trial By Metaphor: Rhetoric, Innovation, And The Juridical Text, Benjamin L. Berger Oct 2002

Court Review: Volume 39, Issue 3 - Trial By Metaphor: Rhetoric, Innovation, And The Juridical Text, Benjamin L. Berger

Court Review: Journal of the American Judges Association

The judicial decision-making process is not one for which resolution arises from counting, measuring, or weighing. Rather, the courtroom is a field for debate about the interpretation and application of values as embodied in or reflected by the law. Decisions reached in court are judgments and not mathematical conclusions in that the inherently contestable nature of the issues at stake precludes an outcome that is selfevident to all. As such, although there is an element of factfinding that emerges in a judicial opinion, there is also always a subjective valuation of the principles at stake; to draw on Socrates, there …

Modeling Of Acoustic Emission Failure Mechanism Data From A Unidirectional Fiberglass/Epoxy Tensile Test Specimen, Daniel R. Lendzioszek Oct 2002

Modeling Of Acoustic Emission Failure Mechanism Data From A Unidirectional Fiberglass/Epoxy Tensile Test Specimen, Daniel R. Lendzioszek

Master's Theses - Daytona Beach

The purpose of this work was to model the acoustic emission (AE) flaw growth data that resulted from the tensile test of a unidirectional fiberglass/epoxy specimen. The data collected and stored during the test were the six standard AE quantification parameters for each event. A classification neural network was used to sort the data into five failure mechanism clusters. The resulting frequency histograms of the sorted data were then mathematically modeled herein using the three types of Johnson distributions: bounded, lognormal, and unbounded. These provided a reasonably good fit for all six AE parameter distributions for each of the five …

The Effect Of Simulator Platform Motion On Pilot Training Transfer: A Meta-Analysis, Eric A. Vaden Oct 2002

The Effect Of Simulator Platform Motion On Pilot Training Transfer: A Meta-Analysis, Eric A. Vaden

Master's Theses - Daytona Beach

A meta-analytic (MA) approach was used to generate an estimate of true mean effect size (δ) for simulator motion with regard to pilot training transfer. The analysis was based on the techniques developed by Hunter and Schmidt (1990). A d statistic was used for effect size calculations based on information available in the included sources. Eleven studies were reviewed and considered for analysis, but only seven of these included the information necessary for calculating effect size and were included in the study. The result of the MA suggest a small, positive effect for motion, d = .16. No credibility interval …

The Effectiveness Of An Augmented Reality Learning Paradigm, Brian Valimont Oct 2002

The Effectiveness Of An Augmented Reality Learning Paradigm, Brian Valimont

Master's Theses - Daytona Beach

For decades the learning and training community has searched for a means that will incorporate the ever-growing body of research into everyday practice. While simulation and virtual reality dominate the community, the lack of real world cues in some systems and expense of others has imposed many limitations on these methods. Augmented reality (AR) incorporates computer-generated images overlaid onto real world objects. Although this technology seems to present distinct advantages over present mediums, it has yet to be determined if AR is effective for intentions of knowledge acquisition. The purpose of this study is to determine if augmented reality is …

Piecing Together The Ponca Past Reconstructing Degiha Migrations To The Great Plains, Beth R. Ritter Oct 2002

Piecing Together The Ponca Past Reconstructing Degiha Migrations To The Great Plains, Beth R. Ritter

Great Plains Quarterly (through 2013)

The twenty-first century presents opportunities, as well as limitations, for the American Indian Nations of the Great Plains. Opportunities include enhanced economic development activities (e.g., casino gambling, telecommunications, and high-tech industries) and innovative tribal programming such as language immersion programs made possible through enhanced self-governance initiatives. Limitations include familiar scripts that perpetually threaten tribal sovereignty and chronically underfunded annual appropriations for Native American health, housing, and social service programs.

The Ponca Tribe of Nebraska, terminated in 1965 and restored to federally recognized status in 1990,1 embraces these challenges by exploring the limits of self-governance, economic development opportunities, and cultural …
