The Potential For Public Opinion To Generate Change In Policy Formation, Peter M. Roguszka
The Potential For Public Opinion To Generate Change In Policy Formation, Peter M. Roguszka
Theses
Towards the end of the Twentieth Century there were a number of examples of change to public policy that were not the product of political debate and public consideration. Rather, they appear to have originated in another less visible, and therefore less open to critique manner. It is argued that it is changes to the general thrust of public opinion that have given validity to these policy changes. The ways in which changes to public opinion are caused to change and by whom are investigated and a theory of 'Australian Public Opinion Change' is developed. This theory is applied to …
Global Antitrust And The Evolution Of An International Standard, William Sugden
Global Antitrust And The Evolution Of An International Standard, William Sugden
Vanderbilt Journal of Transnational Law
This Note explores recommendations for developing a global antitrust regime and ultimately rejects those suggestions in favor of more traditional nationally-based applications of antitrust rules. Part II introduces an economic model of global antitrust to show the systemic difficulties inherent in creating a global regime. Part III contrasts the difficulties in creating a global regime with the greater historical success of developing regional antitrust authorities. Part IV tracks the history of the extraterritorial application of antitrust laws by the United States and the European Union. Part V argues that the path to effective global antitrust lies not in the creation …
Spontaneous Tax Coordination: On Adopting A Comparative Approach To Reforming The U.S. International Tax Regime, Anthony C. Infanti
Spontaneous Tax Coordination: On Adopting A Comparative Approach To Reforming The U.S. International Tax Regime, Anthony C. Infanti
Vanderbilt Journal of Transnational Law
The excessive complexity of the U.S. international tax regime is well documented. Although many commentators have cited the need for simplification, their proposals often maximize other policy goals at the expense of simplicity. Even reform proposals aimed principally at clarifying the tax code are ordinarily focused on the "internal" complexity of the code, seeking improvements only for U.S. taxpayers struggling with a single complex provision of the code or the baffling interaction, of two U.S. rules. This Article focuses on the interaction between U.S. tax law and the rules of other nations, and is intended to illustrate the benefits that …

Avoiding A Nuclear Trade War: Strategies For Retaining Tax Incentives For U.S. Corporations In A Post-Fsc World, Carrie A. Von Hoff
Vanderbilt Journal of Transnational Law
On January 14, 2002, the World Trade Organization (WTO) Appellate Body affirmed that the FSC Repeal and Extraterritorial Income (ETI) Exclusion Act, a replacement for the Foreign Sales Corporation (FSC) Act, was an unlawful export subsidy under WTO agreements. Though the European Union has indicated a willingness to wait before imposing the largest trade sanctions in the history of the WTO, it insists that the United States comply with the ruling. This Note explores the history of the conflict and considers possibilities for the future of international trade taxation.
This Note first examines the background to the conflict, beginning with …

Opportunities For Obtaining And Using Litigation Reserves And Disclosures, Matthew J. Barrett
Journal Articles
In late 1975, the accounting and legal professions reached an accord that led to three new professional standards: (1) a new financial accounting rule for contingencies, (2) an auditing standard addressing the requirement that an auditor obtain evidence about an audit client's contingent liabilities to determine whether the client has properly treated those items in its financial statements, and (3) the American Bar Association's Statement of Policy Regarding Lawyers' Responses to Auditors' Requests for Information under that auditing standard. The Commentary that accompanied the Statement of Policy explicitly stated that the organized bar's expectation that communications between lawyers and auditors …

Defeating Terrorism: Strategic Issue Analyses, John R. Martin Professor
Books, Monographs & Collaborative Studies
Within only a few days after the terrorist attacks of September 11, 2001, the U.S. Army War College initiated a series of short studies addressing strategic issues in the war on terrorism. This collection of essays analyzes a broad array of subjects of great strategic importance. This volume provides historical documentation of some of the advice given the military leadership in the early days of the war, but it also continues to be a source of solid strategic analysis as the war lengthens and perhaps broadens.
Colombian Army Adaptation To Farc Insurgency, Thomas A. Marks Dr.
Colombian Army Adaptation To Farc Insurgency, Thomas A. Marks Dr.
Books, Monographs & Collaborative Studies
The author points out that Revolutionary Armed Forces of Colombia (FARC) insurgents actively are pursuing a strategy to mobilize the disaffected and disposed people of Colombia, and to control the entire national territory. At the same time, he argues that no one in the national political establishment has taken the initiative to conduct an appropriate effort to deny FARC its objective. As a result, the Colombian Army has been left alone to direct the fight, without a coordinated and integrated national campaign plan or other resources that would allow for success. The author concludes that the Army has bought time, …
The Intervention Debate: Towards A Posture Of Principled Judgment, John Garofano Dr.
The Intervention Debate: Towards A Posture Of Principled Judgment, John Garofano Dr.
Books, Monographs & Collaborative Studies
The author argues that American policymakers must take an approach based on "principled judgment" when deciding on the use of force. The 1990s showed the extremes of deciding when and how to use force, one of the central elements of strategy. Throughout American history, debate has raged over whether force is appropriate only in defense of the homeland and vital national interests or whether it should also be used to promote more expansive objectives like regional security and stopping humanitarian disasters in regions with few tangible U.S. interests. He concludes with a discussion of Army roles and requirements for future …

Random Amplified Polymorphic Dna Markers For Discriminating Cochliomyia Hominivorax From C. Macellaria (Diptera: Calliphoridae), S. R. Skoda, Saowaluck Pornkulwat, John E. Foster
Department of Entomology: Faculty Publications
The screwworm, Cochliomyia hominivorax (Coquerel), is one of the most important pests of livestock in the Western Hemisphere. During early immature stages it is morphologically very similar (first instars are virtually indistinguishable) to the secondary screwworm, C. macellaria (Fabricius). Here, the utility of the random amplified polymorphic DNA–polymerase chain reaction (RAPD–PCR) was explored as a technique for developing molecular genetic markers for these two species. Of the 120 arbitrary primers screened, 21 primers produced markers that were further investigated. Seven of the 21 primers produced clear and reproducible markers that were tested with DNA of five individuals from four populations …
A Simulation Based Experiment For Comparing Amhs Performance In A Semiconductor Fabrication Facility, Gerald Mackulak, Paul Savory
A Simulation Based Experiment For Comparing Amhs Performance In A Semiconductor Fabrication Facility, Gerald Mackulak, Paul Savory
Department of Industrial and Management Systems Engineering: Faculty Publications
As the cost and complexity of constructing a semiconductor fabrication facility increases, responsive tools are needed for designing and planning its operations. Discrete-event simulation paired with design of experiments is an effective combination. This article demonstrates how simulation in combination with design of experiments is used to compare the intrabay layout of two automated material handling systems. The difference in stocker robot utilization, number of vehicle moves per hour, and average delivery time for the two intrabay layouts will be compared using a fractional factorial experimental design. The study demonstrates that the distributed storage option is preferable for maximizing manufacturing …

Alcohol And Young People: Promoting Benefits And Reducing Risks, Ian Newman
Alcohol And Young People: Promoting Benefits And Reducing Risks, Ian Newman
Department of Educational Psychology: Faculty Publications
For young people, alcohol used in ways prescribed by tradition and indigenous practices are suggested to be of lower risk than those encouraged by modem marketing and western images. Data from the USA and China are presented and discussed to support this hypothesis. Limited data suggest Chinese adolescents may be adopting higher-risk Western-style drinking practices and moving away from traditional drinking styles. It is suggested that policies which promote traditional and indigenous alcohol use should be encouraged and high-risk Western-style drinking practices discouraged.

Influence Of Protein Tyrosine Kinases On Cell Volume Change-Induced Taurine Release, Herminia Pasantes-Morales, Rodrigo Franco
Influence Of Protein Tyrosine Kinases On Cell Volume Change-Induced Taurine Release, Herminia Pasantes-Morales, Rodrigo Franco
School of Veterinary and Biomedical Sciences: Faculty Publications
Taurine efflux occurs in association with cell swelling in both hyposmotic and isosmotic conditions and during cell shrinkage in apoptotic death. Release occurs through a leak pathway, is largely Ca2+-independent and is sensitive to Cl– channel blockers. Taurine efflux elicited by hyposmolarity is reduced or suppressed by tyrosine kinase blockers and increased by tyrosine phosphatase inhibitors. The specific kinases involved are still unknown and may be different in the various cell types. Non-receptor and scr-related protein kinases have been identified in some cells as elements that directly phosphorylate the taurine efflux pathway. Possible tyrosine kinase targets are …

Use Of Spectral Radiance To Estimate In-Season Biomass And Grain Yield In Nitrogen- And Water-Stressed Corn, S.L. Osborne, James S. Schepers, D.D. Francis, Michael R. Schlemmer
Department of Agronomy and Horticulture: Faculty Publications
Current technologies for measuring plant water status are limited, while recently remote sensing techniques for estimating N status have increased with limited research on the interaction between the two stresses. Because plant water status methods are time-consuming and require numerous observations to characterize a field, managers could benefit from remote sensing techniques to assist in irrigation and N management decisions. A 2-yr experiment was initiated to determine specific wavelengths and/or combinations of wavelengths indicative of water stress and N deficiencies, and to evaluate these wavelengths for estimating in-season biomass and corn (Zea mays L.) grain yield. The experiment was …

Critical Period For Weed Control: The Concept And Data Analysis, Stevan Z. Knezevic, Sean P. Evans, Erin E. Blankenship, Rene C. Van Acker, John L. Lindquist
Department of Agronomy and Horticulture: Faculty Publications
The critical period for weed control (CPWC) is a period in the crop growth cycle during which weeds must be controlled to prevent yield losses. Knowing the CPWC is useful in making decisions on the need for and timing of weed control and in achieving efficient herbicide use from both biological and economic perspectives. An increase in the use of herbicide-tolerant crops, especially soybean resistant to glyphosate, has stimulated interest in the concept of CPWC. Recently, several studies examined this concept in glyphosate-resistant corn and soybean across the midwestern United States. However, these studies presented various methods for data analysis …
Growth Response Of Velvetleaf To Three Postemergence Herbicides, Cheryl A. Murphy, John L. Lindquist
Growth Response Of Velvetleaf To Three Postemergence Herbicides, Cheryl A. Murphy, John L. Lindquist
Department of Agronomy and Horticulture: Faculty Publications
Knowledge of how reduction in the rate of herbicide application or rotation of their mode of action influences weed growth will provide insight into how successful these practices will be in an integrated weed management program. Field experiments were conducted in 1996 and 1997 to quantify velvetleaf growth response to three postemergence herbicides, each with a different mode of action. A monoculture of velvetleaf was treated with halosulfuron, dicamba, and flumiclorac at 0, 0.10, 0.25, 0.50, 0.75, and 1.0 X the labeled rate for weed control in corn. Percent plant mortality increased with rate of application; the greatest mortality occurred …

Impact Of Manure Application On Phosphorus Runoff And Soil Erosion, Daniel T. Walters, C. Gossin, Gregory J. Teichmeier, Galen E. Erickson
Department of Agricultural and Biological Systems Engineering: Faculty Publications
Phosphorus (P) losses from agricultural land is a serious environmental issue because of the impact of P on freshwater eutrophication (McDowell, et al., 2001). The movement of P from soil to surface water is impacted by P input to soil and manure management practices that impact P transport processes. Twenty-one natural runoff plots were established to monitor the effect of time and method of composted beef feedlot manure application and feed P input on net losses of bio-available P and sediment in surface runoff. Reducing feed P inputs resulted in a 33% reduction in manure P content. Runoff losses of …

‘Neuroecologists’ Are Not Made Of Straw, Robert R. Hampton, Susan D. Healy, Sara J. Shettleworth, Alan Kamil
Papers in Behavior in Biological Sciences
In the October issue of Trends in Cognitive Sciences, Bolhuis and Macphail criticized the functional/evolutionary approach to the neural mechanisms of learning and memory, and concluded that the approach is ‘often misleading and might provide us with the wrong answers’ [1]. Their critique touches on a number of interesting issues, and provides a useful prompt to examine the role of an adaptationist approach to the study of cognition. In their effort to stimulate discussion, however, Bolhuis and Macphail have overstated positions they attribute to ‘neuroecologists’.

Spatial And Social Cognition In Corvids: An Evolutionary Approach, Russell P. Balda, Alan Kamil
Papers in Behavior in Biological Sciences
The central research questions that have guided our studies since 1981 combine issues and techniques from both comparative psychology and avian ecology. Most of our questions originate from the cognitive implications of extensive field studies on the natural history, ecology, and behavior of seed-caching corvids. Because our questions have evolved as our studies progressed, we have chosen to give a historical perspective outlining the progression of our ideas and questions.
