The Effect Of Hip Taping On Hip And Knee Muscle Activity, Kyle Barker, Greg Charlton, Grant Goven, Daren Martin Jan 2002

The Effect Of Hip Taping On Hip And Knee Muscle Activity, Kyle Barker, Greg Charlton, Grant Goven, Daren Martin

Physical Therapy Scholarly Projects

Background and Purpose: It has been hypothesized that patellofemoral pain may be precipitated by weak hip abductor musculature that does not pull the pelvis and femurs into correct alignment during gait activities. The misalignment at the pelvis leads to misalignment down the kinetic chain, eventually affecting the knees. It is theorized that hip taping may aid in supporting the pelvis, thus reducing the EMG activity of the hip abductors and normalizing the alignment of the knees. The purpose of this study is to describe muscle activity and joint motion during a step-down test in subjects with and without the hip …

The Effects Of Magnetic Insoles On Lumbar Flexion, Kari Braaflat, Becky Cox, Angela Delacruz, Heather Skarsgard Jan 2002

The Effects Of Magnetic Insoles On Lumbar Flexion, Kari Braaflat, Becky Cox, Angela Delacruz, Heather Skarsgard

Physical Therapy Scholarly Projects

Magnets have been used for therapeutic purposes for hundreds of years. Today, magnetic devices and other alternative therapies are more popular than ever among the general public. The effect of these magnetic devices is dependent on several variables including strength, depth of penetration, placement, time exposed to the magnetic field, and polarity. There are many proposed theories on how magnets affect the body, but there is little research to support them. One of the theories proposed is that magnets alter connective tissue elasticity and allow greater range of motion (ROM). Additional research needs to be conducted to validate or negate …

(Dis)Embedded Women, Rhoda E. Howard-Hassmann

Political Science Faculty Publications

The central question we were asked to address in the Michigan Journal of International Law's Symposium, "Dueling Fates," was, "Which international legal approach more effectively protects women's rights, the collective or the individual?" I am a political sociologist, without legal training, although I have been publishing in the field of international human rights (including women's rights) since 1980. This Article will focus on some underlying assumptions about the nature of society, and women's roles in it, that are pertinent to this central question.

The position argued in this Article is that women's rights are individual rights. To explain this position, …

Ad Rules Infinitum: The Need For Alternatives To State-Based Ethics Governing Legal Services Marketing, William E. Hornsby Jr. Jan 2002

Ad Rules Infinitum: The Need For Alternatives To State-Based Ethics Governing Legal Services Marketing, William E. Hornsby Jr.

University of Richmond Law Review

For most of the Twentieth Century, lawyer advertising was prohibited. Beginning with the Canons of Ethics ("Canons"), adopted by the American Bar Association (the "ABA" or "Association") in 1908, it was unethical for lawyers to advertise or engage in most forms of marketing. The 1977 United States Supreme Court decision of Bates v. State Bar of Arizona held that, under the First Amendment doctrine of commercial speech, states did not have the right to ban lawyer advertising. The decision, however, gave states the responsibility to regulate this activity. This began an experiment to balance consumer protection with the flow of …

Remediation Of Trapped Free-Phase Lnapl, T. M. Whitworth, Andrew Curtis Elmore Jan 2002

Remediation Of Trapped Free-Phase Lnapl, T. M. Whitworth, Andrew Curtis Elmore

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

Free-phase light nonaqueous phase liquids (LNAPLs) may be trapped in certain stratigraphic and structural features near or at contaminated sites due to seasonal or other variations in the water table elevation. The purpose of this article is to point out particular subsurface conditions that are conducive to trapping of free-phase LNAPLs and to suggest approaches to remediating LNAPL-contaminated sites exhibiting similar subsurface geometry and stratigraphy. To trap free-phase LNAPL, a structure must have, in addition to closed contours, an upper boundary with pores small enough so that the LNAPL will not enter them. This boundary usually consists of clay-rich sediments. …

Using Real Options Analysis For Evaluating Uncertain Investments In Information Technology: Insights From The Icis 2001 Debate, Paul P. Tallon, Robert J. Kauffman, Henry C. Lucas, Andrew B. Whinston, Kevin Zhu Jan 2002

Using Real Options Analysis For Evaluating Uncertain Investments In Information Technology: Insights From The Icis 2001 Debate, Paul P. Tallon, Robert J. Kauffman, Henry C. Lucas, Andrew B. Whinston, Kevin Zhu

Research Collection School Of Computing and Information Systems

Business and information systems (IS) executives continue to grapple with issues of risk and uncertainty in evaluating investments in information technology (IT). Despite the use of net present value (NPV) and other investment appraisal techniques, executives are often forced to rely on instinct when finalizing IT investment decisions. Recognizing the shortcomings of NPV, real options analysis has been suggested as an alternative approach, one that considers the risks associated with an investment while recognizing the ability of corporations to defer an investment until a later period or to make a partial investment instead. Responding to a growing interest in real …

Fuel Consumption Modeling Of A Transport Category Aircraft Using Flight Operations Quality Assurance Data: A Literature Review, Alan J. Stolzer Jan 2002

Fuel Consumption Modeling Of A Transport Category Aircraft Using Flight Operations Quality Assurance Data: A Literature Review, Alan J. Stolzer

Publications

"Fuel is a major cost expense for air carriers. A typical airline spends 10% of its operating budget on the purchase of jet fuel, which even exceeds its expenditures on aircraft acquisitions. Thus, it is imperative that fuel consumption be managed as wisely as possible. The implementation of Flight Operations Quality Assurance (FOQA) programs at airlines may be able to assist in this management effort. The purpose of the study is to examine the literature regarding fuel consumption by air carriers, the literature related to air carrier fuel conservation efforts, and the literature related to the appropriate statistical methodologies to …

Adaptive Information Filtering: Concepts And Algorithms, Daniel R. Tauritz Jan 2002

Adaptive Information Filtering: Concepts And Algorithms, Daniel R. Tauritz

Computer Science Faculty Research & Creative Works

Adaptive information filtering is concerned with filtering information streams in dynamic (changing) environments. The changes may occur both on the transmission side — the nature of the streams can change — and on the reception side — the interests of the user (or group of users) can change. While information filtering and information retrieval have a lot in common, this dissertation’s primary concern is with the differences. The temporal nature of information filtering necessitates more flexible document representation methods than does information retrieval where all the occurring terms are known in advance. Also, information filtering typically maintains user interest profiles …

Modelling Of The Glass Phase In Fly Ashes Using Network Connectivity Theory, Mark R. Towler, Kenneth T. Stanton, Patrick Mooney, Robert G. Hill, Natalia Moreno, Xavier Querol Jan 2002

Modelling Of The Glass Phase In Fly Ashes Using Network Connectivity Theory, Mark R. Towler, Kenneth T. Stanton, Patrick Mooney, Robert G. Hill, Natalia Moreno, Xavier Querol

Chemical and Biochemical Engineering Faculty Research & Creative Works

The amorphous phase of fly ash dominates degradation behaviour because glass has a higher potential energy than the equivalent crystal structure and the variation of bond angles and distances in a glass make the bond breakage easier. It would be advantageous to predict the presence and subsequent degradability of glass on the basis of the solid-state chemistry of the fly ash. To this end, and inorganic polymer model was applied to a selection of European fly ashes to determine the value known as cross-link density (CLD). A cross-link density value of less than two implies that the material is amorphous …

Empirical Work In Family Law, Margaret F. Brinig Jan 2002

Empirical Work In Family Law, Margaret F. Brinig

Journal Articles

Until fairly recently, researchers have not done much theoretical work on the subject of family law. Although the move towards theoretical work is a positive one, unfortunately, most of the latest reforms in family law have been uninformed by empirical studies. Furthermore, the few empirical studies that have been conducted are replete with intractable problems.

In this essay, Margaret Brinig discusses some of the problems researchers have encountered in their attempts to conduct empirical work in the area of family law. For example, most researchers have used state cross-sectional data for their experiments. Reliance on this type of data can …

The Rehnquist Court And Criminal Procedure, Stephen F. Smith Jan 2002

The Rehnquist Court And Criminal Procedure, Stephen F. Smith

Journal Articles

Much of recent discussions of conservative judicial activism has concerned the revival of federalism-based limits on Congress during the Rehnquist Court. The allure of federalism as a topic for discussion is understandable, yet I argue that constitutional criminal procedure provides a better context within which to test the Rehnquist Court's commitment to judicial restraint. In this Essay, I examine the topic at hand against the background of the many important developments that have taken place in criminal procedure on Rehnquist's watch. The results of this examination are surprising because they suggest that activism is not necessarily the antithesis of restraint. …

Activism As Restraint: Lessons From Criminal Procedure, Stephen F. Smith Jan 2002

Activism As Restraint: Lessons From Criminal Procedure, Stephen F. Smith

Journal Articles

In this Article, I advance a limited defense of judicial activism by the Burger and Rehnquist Courts in constitutional criminal procedure. My basic claim is that even if the so-called "Counterrevolution" in criminal procedure is viewed as activist -- as I think much of it must be -- it nevertheless was normatively defensible as a necessary condition, in a “second-best” world, of reaching an equilibrium closer to the judicial restraint model than would be possible if activism were only a one-way ratchet. Though my thesis supplies a justification for the Burger and Rehnquist Court's basic approach to legal change, it …

Electronic Real Estate Records: A Model For Action, Arthur R. Gaudio Jan 2002

Electronic Real Estate Records: A Model For Action, Arthur R. Gaudio

Faculty Scholarship

The legal, technological, and structural components are in place to allow the legal community to embark on the process of creating a uniform real property recording act. Certain jurisdictions have started the process by adopting various provisions allowing counties to implement electronic recording systems. These provisions are, however, disparate and inconsistent. Given the inconsistencies in the manner in which the electronic recording systems are developing, national commercial and lending practices would have a difficult time attempting to comply with all the possible permutations. In the near future, Fannie Mae, the Property Records Industry Association, and the Mortgage Industry Standards Maintenance …

Financial Holding Company Liability After Gramm-Leach-Bliley, Eric J. Gouvin Jan 2002

Financial Holding Company Liability After Gramm-Leach-Bliley, Eric J. Gouvin

Faculty Scholarship

This Article examines the extent to which financial holding companies formed under the Gramm-Leach-Bliley Act (GLB Act) will bear the costs of the failure of their bank subsidiaries. Pre-GLB Act banking law provided numerous ways to impose liability on bank holding companies for bank failure. The GLB Act itself added some provisions dealing with holding company liability, providing protections for receivers of failed institutions and adding ammunition to the regulators' "source of strength" theory for imposing liability on bank holding companies, and, by extension, on financial holding companies. But despite tinkering at the edges, the GLB Act did not provide …

Veteran Teacher Perceptions Of The Grossmont Model Of Peer Assistance And Review. Is It A Viable Alternative To Traditional Evaluation?, Edwin L. Basilio Edd Jan 2002

Veteran Teacher Perceptions Of The Grossmont Model Of Peer Assistance And Review. Is It A Viable Alternative To Traditional Evaluation?, Edwin L. Basilio Edd

Dissertations

This study looked at factors that influenced veteran teacher perceptions of the newly implemented Peer Assistance and Review (PAR) program in the Grossmont Union High School District. More specifically, the study explored (1) reasons why teachers with at least five years of successful teaching experience voluntarily chose to forfeit their regularly scheduled traditional evaluation and substitute it with a peer review, (2) factors that contributed to positive perceptions of the PAR program, (3) factors that contributed to negative perceptions of the PAR program, and (4) perceived differences between the traditional and PAR methods of teacher evaluation. This study incorporated multiple …

Gender Contests, Susan Frelich Appleton Jan 2002

Gender Contests, Susan Frelich Appleton

Scholarship@WashULaw

This contribution for the “Law, Ethics, and Gender in Medicine” column in the Journal of Gender Specific Medicine interrogates the understanding of gender itself, at a time when transgender and intersex issues were just beginning to “come out” in both popular culture and case law. Against this background, the column explores the roles that physicians have played in such gender contests and considers how evolving medical attitudes can help achieve reform.

Common Law Courts In An Age Of Equity Procedure: Redefining Appellate Review For The Mass Tort Era, Melissa A. Waters Jan 2002

Common Law Courts In An Age Of Equity Procedure: Redefining Appellate Review For The Mass Tort Era, Melissa A. Waters

Scholarship@WashULaw

From expansion of tort liability rules, to novel claims aggregation and settlement techniques, to statistically derived liability and damages assessments, mass tort litigation is producing unprecedented innovations at every level of the federal legal system. What is particularly striking about these innovations is that they are almost exclusively the product of a handful of federal trial judges who specialize in mass tort cases. Because appellate courts lack the necessary tools to supervise their decisions, these few mass tort trial judges are shaping the rules that govern the mass tort legal regime with little or no appellate supervision. The result is …
