In Search Of A Balance Between Police Power And Privacy In The Cybercrime Treaty, D.C. Kennedy Jan 2002

In Search Of A Balance Between Police Power And Privacy In The Cybercrime Treaty, D.C. Kennedy

Richmond Journal of Law & Technology

Imagine that you wake up one morning, turn on your computer, and open an e-mail message with a catchy phrase in the subject line. Immediately after opening the e-mail’s attachment, your personal computer is severely damaged. Obviously having a bad day, you head to your job as an attorney for a multinational corporation. By the time you arrive at work, there has been damage to company computers across the globe. The monetary costs of the damage, coupled with the downtime, are astronomical. The CEO of your company is furious. You hope to diffuse the situation by informing your boss that …

Lawyer Advertising And The Philosophical Origins Of The Commercial Speech Doctrine, Ronald D. Rotunda Jan 2002

Lawyer Advertising And The Philosophical Origins Of The Commercial Speech Doctrine, Ronald D. Rotunda

University of Richmond Law Review

The topic of lawyers advertising for clients seems prosaic enough, but it is really a subset of a much larger, more theoretical question. What Americans think about the Constitutional right of lawyers to advertise and market their services both reflects and molds what we think about the right to be left alone. In 1928, Justice Brandeis, in his famous dissent in Olmstead v. United States, wrote that our Constitution "conferred, as against the Government, the right to be left alone-the most comprehensive of rights and the right most valued by civilized men." Justice Brandeis did not speak in a vacuum; …

Treating Persons As Ends In Themselves: The Legal Implications Of A Kantian Principle, R. George Wright Jan 2002

Treating Persons As Ends In Themselves: The Legal Implications Of A Kantian Principle, R. George Wright

University of Richmond Law Review

In one of the most stirring passages in modern ethics, Immanuel Kant famously enjoins: "act that you use humanity, whether in your own person or in the person of any other, always at the same time as an end, never merely as a means." Precisely what Kant means here, however, is not entirely clear. More than one interpretation of this formula is possible. But the importance of Kant's "formula of ends" in modern moral philosophy is impossi- ble to deny.

Cyberian Signals, Steven A. Hetcher Jan 2002

Cyberian Signals, Steven A. Hetcher

University of Richmond Law Review

In Law and Social Norms, Eric Posner offers an original and important theory of the emergence of norms. According to Posner, norms are collections of signals. He develops his signaling account in a variety of contexts, including criminal law, family law, political participation, and racial discrimination. This article extends Posner's theory to cyberspace, a domain of social organization not touched on in Posner's book. In particular, I will test Posner's theory by examining how well it explains the emergence of Web site privacy norms. Part One will examine signaling theory. Part Two will explore privacy norms in some detail, and …

Meeting By Signals, Playing By Norms: Complementary Accounts Of Nonlegal Cooperation In Institutions, Edward Rock, Michael Wachter Jan 2002

Meeting By Signals, Playing By Norms: Complementary Accounts Of Nonlegal Cooperation In Institutions, Edward Rock, Michael Wachter

University of Richmond Law Review

Professor Eric A. Posner has written a fascinating book about "Law and Social Norms." In it, he uses an informal signaling model (derived from Michael Spence's formal model) to explain a wide range of striking social behavior, and to show underlying connections among apparently disparate phenomena. Looking at topics as dissimilar as gift giving, family law, criminal law, voting and political participation, and commercial practice, he argues that much of observed social behavior can be understood as the result of attempts to signal that one is a good cooperator.

Signaling, Legitimacy, And Compliance: A Comment On Posner's Law And Social Norms And Criminal Law Policy, Tracey L. Meares Jan 2002

Signaling, Legitimacy, And Compliance: A Comment On Posner's Law And Social Norms And Criminal Law Policy, Tracey L. Meares

University of Richmond Law Review

Although criminal law can be justified with respect to non-utilitarian goals such as retribution, no one can deny that one way to justify criminal law is with respect to the instrumental ends of deterrence. So, one question of interest to scholars in the field has been how to think about the kinds of criminal law policy that encourage compliance. My own work has focused on this important question. Specifically, I have been concerned with the ways in which different kinds of criminal proscriptions, along with certain methods of law enforcement, could affect crime rates in disadvantaged, urban neighborhoods. In undertaking …

Mammal And Bird Trackways In The Miocene Horse Spring Formation, Clark County, Nevada, Michele Marie Jones

UNLV Retrospective Theses & Dissertations

The Thumb Member of the Miocene Horse Spring Formation contains a vertebrate track assemblage of mammal (camel and carnivore) and avian footprints. Camelid tracks identified are Lamaichnum alfi, Lamaichnum macropodum, and Lamaichnum etoromorphum. Carnivore tracks include canid tracks (Canipeda sp.) and a possible felid track ( Felipeda? sp.). One canid trackway records a c-shaped pattern, which is apparently the fist documentation of a rotary gallop gait in Miocene canids. Five types of bird tracks, four of which are previously undescribed, also occur. They are: (1) Alaripeda lofgreni, (2) Avipeda sp. A, (3) Avipeda sp. B, (4) Anatipeda sp. A, and …

Collegiate Connection: A Program To Encourage The Success Of Student Participation In High School/University Dual Enrollment, Beverly Parke, Joe Nichols, Ann Souligny Brown

Mid-Western Educational Researcher

This project is a comparative exploration of academic success rates for high school students enrolled in a high school/university dual enrollment program. Four-hundred-eighty-four high school student grades in university courses were compared to grades of the general university population and university freshmen (n = 4,552) in specific courses. In several specific courses, the earned grades of high school students participating in the program were found to be significantly greater than the grades of university freshmen in matching courses. The Collegiate Connection dual enrollment program is explained in detail and suggestions for additional future research are also included.

Gtap-E: An Energy-Environmental Version Of The Gtap Model, Jean-Marc Burniaux, Truong P. Truong

GTAP Technical Papers Archive

Energy is an important commodity in many economic activities. Its usage affects the environment via CO2 emissions and the Greenhouse Effect. Modeling the energy-economy-environment-trade linkages is an important objective in applied economic policy analysis. Previously, however, the modeling of these linkages in GTAP has been incomplete. This is because energy substitution, a key factor in this chain of linkages, is absent from the standard model specification. This technical paper remedies this deficiency by incorporating energy substitution into the standard GTAP model. It begins by first reviewing some of the existing approaches to this problem in contemporary CGE models. It then …

Circulatory Adjuncts: Newer Methods Of Cardiopulmonary Resuscitation, Charles F. Babbs Jan 2002

Circulatory Adjuncts: Newer Methods Of Cardiopulmonary Resuscitation, Charles F. Babbs

Weldon School of Biomedical Engineering Faculty Publications

Current standard CPR only provides about one fifth of normal forward blood flow and only about one quarter of the blood flow that is theoretically possible with advanced external techniques. Two such techniques are now approved as optional alternatives in resuscitation guidelines. This chapter reviews modern understanding of the physiology of blood flow during CPR and practical aspects of utilizing more advanced resuscitation methods. When properly performed these methods produce statistically significant increases in survival.

The performance limits of carbon nanotube field-effect transistors (CNTFETs) are examined theoretically by extending a one-dimensional treatment used for silicon metal–oxide–semiconductor field-effect transistors (MOSFETs). Compared to ballistic MOSFETs, ballistic CNTFETs show similar I–VI–V characteristics but the channel conductance is quantized. For low-voltage, digital applications, the CNTFET with a planar gate geometry provides an on-current that is comparable to that expected for a ballistic MOSFET. Significantly better performance, however, could be achieved with high gate capacitance structures. Because the computed performance limits greatly exceed the performance of recently reported CNTFETs, there is considerable opportunity for progress in device performance.

Optimum Compression To Ventilation Ratios In Cpr Under Realistic, Practical Conditions: A Physiological And Mathematical Analysis, Charles F. Babbs, Karl B. Kern

Weldon School of Biomedical Engineering Faculty Publications

Objective: To develop and evaluate a practical formula for the optimum ratio of compressions to ventilations in CPR. The optimum value of a parameter is that for which a desired result is maximized. Here the desired result is assumed to be either oxygen delivery to peripheral tissues or a combination of oxygen delivery and waste product removal. Method: Equations describing oxygen delivery and blood flow during CPR as functions of the number of compressions and the number of ventilations delivered over time were developed from principles of classical physiology. These equations were solved explicitly in terms of the compression/ventilation ratio …
