Patents On Dna Sequences: Molecules And Information, Rebecca S. Eisenberg
Patents On Dna Sequences: Molecules And Information, Rebecca S. Eisenberg
Book Chapters
As public and private sector initiatives raced to complete the sequence of the human genome, patent issues played a prominent role in speculations about the significance of this achievement. How much of the genome would be subject to the control of patent holders, and what would this mean for future research and the development of products for the improvement of human health in a patent system developed to establish rights in mechanical inventions of an earlier era up to the task of resolving competing claim, to the genome on behalf or the many sequential innovators who elucidate its sequence and …
Alternatives To Economic Sanctions, Christine M. Chinkin
Alternatives To Economic Sanctions, Christine M. Chinkin
Book Chapters
Considering the merits of non-coercive alternatives to economic sanctions inevitably risks the charges of idealism and naIvete. However a number of speakers in this conference have raised considerable doubts about the efficacy of sanctions: even on their own terms sanctions rarely work and the material costs to non-targeted states and the implications for human rights make their justification problematic, even when they can in some sense be said to have worked. It therefore makes sense at least to give consideration to some non- coercive alternatives, either in conjunction with sanctioning policies or separate from them. The other alternative is the …
The Breadth Of The Anti-Trafficking Provisions And The Moral High Ground, Jessica D. Litman
The Breadth Of The Anti-Trafficking Provisions And The Moral High Ground, Jessica D. Litman
Book Chapters
This is a cautionary tale. Back in 1996, 1997 and 1998, the law prohibiting circumvention of "access controls" was conceived, described and defended on the ground that it was very narrow. Initially, "access" was intended to mean initial access - the digital equivalent of breaking into a bookstore to steal a book. Copyright owners, though, insisted that "access controls" should also include devices to facilitate pay-per-view. Since that would require protecting works against continuing access, copyright owner lobbyists resisted any narrowing language. Still, when opponents of section 1201 complained to Congress that the language before it might give copyright owners …
The Writings Of John Barker Waite And Thomas Davies On The Search And Seizure Exclusionary Rule, Yale Kamisar
The Writings Of John Barker Waite And Thomas Davies On The Search And Seizure Exclusionary Rule, Yale Kamisar
Articles
After browsing through many volumes of the Michigan Law Review, searching for the article I would discuss on the occasion of the law review's 100th anniversary, I wound up with two "finalists": a 1955 article by Professor John Barker Waite on the law of arrest search and seizure (on further reflection, four Michigan Law Review commentaries on the general subject written by Waite between 1933 and 1955)' and a monumental 200-page article (surely one of the longest articles ever to appear in the Michigan Law Review) by Thomas Davies on the "original Fourth Amendment. 2
Looking Back On Planned Parenthood V. Casey, Christina B. Whitman
Looking Back On Planned Parenthood V. Casey, Christina B. Whitman
Articles
Scholarship that tells us what is really at stake in the lives of people affected makes the law honest and responsive. Whether or not it directly shapes doctrine, this type of scholarship can capture imagination and influence judgment. The Michigan Law Review has published some of the best of this work: Yale Kamisar's articles on coerced confessions, Terry Sandalow's essay on affirmative action, Joe Sax and Phillip Hiestand's description of the emotional impact of living in a slum, Martha Chamallas and Linda Kerber's demonstration of how injuries that uniquely befall women have been dismissed as merely emotional wrongs, and, most …
Justice Frank Murphy And American Labor Law, Theodore J. St. Antoine
Justice Frank Murphy And American Labor Law, Theodore J. St. Antoine
Articles
Working people and disfavored groups were central concerns of Frank Murphy, the last Michigan Law School graduate to sit on the United States Supreme Court. In the pages of this Review, just over a half century ago, Archibald Cox wrote of him: "It was natural ...th at his judicial work should be most significant in these two fields [labor law and civil rights] and especially in the areas where they coalesce."' In this Essay, after a brief overview of Murphy the man, his days at the University of Michigan, and his career prior to the Court appointment, I shall review …
A Footnote For Jack Dawson, James J. White, David A. Peters
A Footnote For Jack Dawson, James J. White, David A. Peters
Articles
Jack Dawson, known to many at Michigan as Black Jack, taught at the Law School from 1927 to 1958. Much of his work was published in the Michigan Law Review, where he served as a student editor during the 1923-24 academic year. We revisit his work and provide a footnote to his elegant writing on mistake and supervening events. In Part I, we talk a little about Jack the man. In Part II, we recite the nature and significance of his scholarly work. Part III deals briefly with the cases decided in the last twenty years by American courts on …
Loop Detection And Prevention Mechanism In Multiprotocol Label Switching, Vasu Jolly
Loop Detection And Prevention Mechanism In Multiprotocol Label Switching, Vasu Jolly
UNLV Retrospective Theses & Dissertations
The extended color thread algorithm is based on running a thread hop by hop before the labels are distributed inside a MPLS Cloud Since the path for the data packets is set beforehand, the loop formation occurs at the control path. The shortest paths between selected source and destination have been calculated using Dijkstra's shortest path algorithm and threads are allowed to extend through the routers. With the passage of each next hop, a distributed procedure is executed within the thread, generating a unique color at nodes. This keeps a track on router's control path and at the same time …

The Electronic Jungle: The Application Of Intellectual Property Law To Distance Education, Jon Garon
The Electronic Jungle: The Application Of Intellectual Property Law To Distance Education, Jon Garon
Vanderbilt Journal of Entertainment & Technology Law
The tension between academic institutions as creators and consumers of intellectual property seems to be most directly felt in the new areas of distance education. Despite the significant opportunities to use new media to expand the reach of the classroom to an ever-growing body of students, concerns regarding copyright, trademark and defamation law continue to limit and dictate what schools attempt to do. These limitations are more directly felt by individual instructors, who must enforce appropriate usage policies for their students, create copyrighted materials and negotiate with their schools over the ownership of the valuable content created.

Co-Productions: The Future Feature, Jenica Yurcic
Co-Productions: The Future Feature, Jenica Yurcic
Vanderbilt Journal of Entertainment & Technology Law
This Article argues that California should devise an incentive plan to attract film production projects rather than take a defensive posture to deter film flight. The objective of the incentive plan is to consolidate government funding while capitalizing on California's film marketing and distribution expertise, as well as the growing demand for digital post-production services. In an increasingly global film industry, this incentive plan would lower the bottom-line of international productions. The prospect of earning increased profits through international production efforts should attract more business to the California film industry. However, while such a business plan is easy to envision, …

An Analysis Of The Role Of Pay Among Low-Income Earners, Yu Pun Leung
Bachelor Degree - Management - Final Year Project
The project aims to investigate the relationship between pay and motivation in a low-income group in Hong Kong.
The low-income earners from different industries in Hong Kong were selected, as they comprise a large amount of workers in Hong Kong. Much of the work that has examined the relationship between pay and motivation tends to focus on middle and higher income groups. However, since much of the work force in Hong Kong falls into the low-income category, it is hoped that this study is of some significance.
In carrying out the study, a survey will be carried out with the …

Closed Industrial Water Cycles, Celine Bellec
Closed Industrial Water Cycles, Celine Bellec
Theses
Due to this decade of rapid growth, Ireland has to face difficulties created by an increase use of water as well as a decreasing water quality due to sewage discharges, agriculture and industries.
The awareness of the danger to the environment, resulting from the over extraction and stricter discharge regulations, has caused the cost of freshwater and wastewater treatment to rise. Therefore there is a growing interest in the manufacturing industries to reduce both freshwater consumption and wastewater production by improving the efficiency of their processes.
Three industrial sectors were studied following the same methodology: the pharmaceutical sector, the textiles …

An Exploration Of Bass And Avolio's Transformational And Transactional Leadership Styles And Values Of South Texas And Northern Mexico Small Business Owners, Rosie V. Decosmo
Graduate Student Dissertations, Theses, Capstones, and Portfolios
Global business initiatives, increasingly diverse populations, and permeable geographical boundaries have catapulted interest in studying the impact of these events on multi-national companies, and to a lesser degree, small businesses along the South Texas and Mexican border. The enactment of the North American Free Trade Act agreement that exists between Mexico, Canada, and the United States amplifies these issues. Consequently, companies may face a changing business landscape. However, one constant factor is the owner. This dissertation investigated South Texas and northern Mexico small business owners' leadership behaviors and personal values. First, this study represents an attempt to ascertain similarities and …

Conceptualizing Privacy, Daniel J. Solove
Conceptualizing Privacy, Daniel J. Solove
GW Law Faculty Publications & Other Works
In this Article, Professor Solove develops a new approach for conceptualizing privacy. He begins by examining the existing discourse about conceptualizing privacy, exploring the conceptions of a wide array of jurists, legal scholars, philosophers, psychologists, and sociologists. Solove contends that the theories are too narrow or too broad. With a few exceptions, the discourse seeks to conceptualize privacy by isolating one or more common essential or core characteristics of privacy. Expounding upon Ludwig Wittgenstein's notion of family resemblance, Solove contends that privacy is better understood as drawing from a common pool of similar characteristics. Rather than search for an overarching …

Tanaidacea (Crustacea: Peracardia) Of The Gulf Of Mexico. X. The Question Of Being Male, Kim Larsen
Tanaidacea (Crustacea: Peracardia) Of The Gulf Of Mexico. X. The Question Of Being Male, Kim Larsen
Gulf and Caribbean Research
Three new species Parafilitanais mexicana, Collettea elongata, and Paragathotanais medius are described from deep-sea localities in the Gulf of Mexico. The male of Parafilitanais does not vary conspicuously from the female, except for possessing pleopods. Male Paragathotanais reveal that the mouthparts display some degree of sexual dimorphism. Males of all 3 species possess functional mouthparts. The problems identifying male Tanaidacea are discussed. The number of terminal spiniform setae on the maxillule is considered invalid as a diagnostic character. Keys to the species of Parafilitanais and Paragathotanais are given.

Tanapseudes Gutui, A New Species Of Apseudomorphan Tanaidacea (Crustacea: Peracarida) From The Caribbean Sea And The Taxonomic Status Of The Family Tanapseudidae Băcescu, Thomas Hansknecht, Richard W. Heard, Roger Bamber
Gulf and Caribbean Research
Tanapseudes gutui, n. sp., is described from depths of 3–34 m off San Juan, Puerto Rico, and 4– 5 m off Goat Island, Tobago. Tanapseudes sinensis Bamber from Hong Kong waters is re-examined and determined to represent a junior synonym of the type species T. ormuzana Băcescu which was originally collected in the Straights of Hormuz off Iran. Tanapseudes gutui can be distinguished from T. ormuzana by several characters including details of the mouth parts, the presence of a reduced spiniform seta on the distotergal margin of the propodus of pereopod 1, pereonites 3–6 with rounded anterior margins, and …

Integrating Academic And Non-Academic Instruction For Students With Emotional/Behavioral Disorders, Robert A. Gable, Jo M. Hendrickson, Stephen W. Tonelson, Richard Van Acker
Communication Disorders & Special Education Faculty Publications
Students with emotional/behavioral disorders exhibit a wide range of academic and behavioral problems. Not surprisingly, there is growing support for integrating instruction to address overlapping students' needs in both areas. In this article, we discuss instructional variables that contribute to a positive classroom climate and that serve as setting events for more focused group-individual instructional programs. We draw on the accumulated research to identify common non-academic challenges that should be incorporated into those programs. We examine issues that relate to the efficacy of instruction and also the cultural and chronological age differences among students and how they relate to planning …
