A Word-And-Flesh Profession: A Response To White And Brueggemann, Marie Failinger Jan 2002

A Word-And-Flesh Profession: A Response To White And Brueggemann, Marie Failinger

Faculty Scholarship

Speech remakes the world through a relationship among words, speaker, and hearer. On one hand, this view of the human encounter as essentially rhetorical precludes an understanding of speech as purely subjectivist or emotivist self-expression. On the other hand, this same view of human speech interaction precludes the understanding of speech acts as mere descriptions of previously discovered or reasoned truth, either empirical or abstract. Professor White reaffirms this triad among words, speaker, and hearer with what he has identified as the “deeply reciprocal” dynamic of language. Professor Brueggemann also describes the speech acts between Moses, Abraham, and their God …

Long On Substance, Short On Process: An Appeal For Process Long Overdue In Eyewitness Lineup Procedures, Michael R. Headley Jan 2002

Long On Substance, Short On Process: An Appeal For Process Long Overdue In Eyewitness Lineup Procedures, Michael R. Headley

UC Law Journal

Eyewitness identifications play an important role in the criminal justice system. However, the procedures surrounding these identifications are fraught with potential for error, and the Supreme Court has recognized the "vagaries of eyewitness identification." Over the past thirty years, researchers have established a considerable body of evidence demonstrating that simultaneous lineup procedures result in greater error than sequential lineups. Nevertheless, most law enforcement agencies persist in utilizing the simultaneous lineup procedure. This Note argues that the Due Process Clause mandates the implementation of sequential lineups on the basis of both a moral and an historical reading of the phrase "due …

"Public Use" And The Original Understanding Of The So-Called "Takings" Clause, Matthew P. Harrington Jan 2002

"Public Use" And The Original Understanding Of The So-Called "Takings" Clause, Matthew P. Harrington

UC Law Journal

Eminent domain has evolved to encourage almost every conceivable type of economic development. In response, opponents have argued that the proposed takings are not for a "public use" as that term is used in the Fifth Amendment. They argue that "public use" was intended to operate as a substantive limit on government takings. Part I of this Article will explore the civil law theories that inform most modem judicial and scholarly commentary on eminent domain and the confusion that has resulted from this relatively recent misreading of the constitutional history and text. However, judicial supervision of legislative expropriations would have …

From Katz To Kyllo: A Blueprint For Adapting The Fourth Amendment To Twenty-First Century Technologies, Ric Simmons Jan 2002

From Katz To Kyllo: A Blueprint For Adapting The Fourth Amendment To Twenty-First Century Technologies, Ric Simmons

UC Law Journal

In 1967, the Supreme Court decided the landmark case of United States v. Katz, which engineered a paradigm shift in Fourth Amendment law: instead of focusing solely on property interests in determining whether or not a "search" had occurred, the Court broadened the scope of the Amendment's protection to include any activity in which an individual has a "reasonable expectation of privacy." However, subsequent decisions by lower courts-as well as recent decisions by the Supreme Court itself-have shown a continuing tension in the Katz legacy.

This Article argues that an accurate application of the Katz test considers only the result …

Early Spatial And Temporal Validation Of Modis Lai Product In The Southern Africa Kalahari, J. L. Privette, R. B. Myneni, Y. Knyazikhin, M. Mukelabai, G. Roberts, Y. Tian, Y. Wang, S. G. Leblanc Jan 2002

Early Spatial And Temporal Validation Of Modis Lai Product In The Southern Africa Kalahari, J. L. Privette, R. B. Myneni, Y. Knyazikhin, M. Mukelabai, G. Roberts, Y. Tian, Y. Wang, S. G. Leblanc

United States National Aeronautics and Space Administration: Publications

We evaluate the operational MODIS Leaf Area Index (LAI) product using field-sampled data collected at five sites in southern Africa in March 2000. One site (Mongu, Zambia) was sampled monthly throughout the year. All sites were along the International Geosphere Biosphere Programme’s (IGBP) Kalahari Transect, which features progressively lower annual precipitation, and hence, lower vegetation productivity, from north to south. The soils are consistently sandy. At each site, we sampled the vegetation overstory along three 750-m transects using the Tracing Radiation and Architecture in Canopies (TRAC) instrument. The resulting plant area index values were adjusted with ancillary stem area data …

High Order Numerical Simulation Of Sound Generated By The Kirchhoff Vortex, Bernhard Müller, Helen C. Yee Jan 2002

High Order Numerical Simulation Of Sound Generated By The Kirchhoff Vortex, Bernhard Müller, Helen C. Yee

United States National Aeronautics and Space Administration: Publications

An improved high order finite difference method for low Mach number computational aeroacoustics (CAA) is described. The improvements involve the conditioning of the Euler equations to minimize numerical cancellation errors, and the use of a stable non-dissipative sixth-order central spatial interior scheme and a third-order boundary scheme. Spurious high frequency oscillations are damped by a third-order characteristic-based filter. The objective of this paper is to apply these improvements in the simulation of sound generated by the Kirchhoff vortex.

Initial Mortality Of Black Bass In B.A.S.S. Fishing Tournaments, Gene R. Wilde, Calub E. Shavlik, Kevin L. Pope

Nebraska Cooperative Fish and Wildlife Research Unit: Staff Publications

We studied the initial mortality of black bass Micropterus spp. that were captured, weighed in, and released in fishing tournaments conducted by the Bass Anglers Sportsman Society between 1972 and 1998. Mean annual initial mortality (i.e., mortality before weigh-in and release) ranged from 1% to 30%. Initial mortality was greatest during the 1970s (15.2%) and decreased during the 1980s (5.7%) and 1990s (1.9%). Because initial mortality was uniformly low ( ≤5%) after 1982, we used results for 1983–1998 to assess relationships involving initial mortality. Initial mortality was correlated with bag size, mean fish weight per angler, and number of fish …

Billowing folds, exquisite pleats, tightly wound turbans, flowing burqas, short square kerchiefs-the dramatic drapery of Islamic fashion fills the quiet spaces of our daily news coverage; yet the garments illustrated and their significance often pass without verbal notice. Little would Yedida Stillman ever have anticipated the widespread presence of the Islamic vestimentary system in Western media a short three years after her death …

Michigan Bovine Tuberculosis Bibliography and Database

In 1994, a free-living white-tailed deer (Odocoileus virginianus) in Michigan was diagnosed with tuberculosis caused by Mycobacterium bovis (Schmitt and others 1997). Subsequent surveys conducted by the Michigan Department of Natural Resources and Michigan State University Animal Health Diagnostic Laboratory identified an epidemic of M bovis infection in free-living white-tailed deer in northeast Michigan (Schmitt and others 1997, O'Brien and others 2001). This represents the first known reservoir of M bovis in free-living wildlife in the USA, and the first known epidemic of tuberculosis in white-tailed deer anywhere in the world.

Bovine Tuberculosis In Michigan Wildlife And Livestock, Stephen M. Schmitt, Daniel J. O'Brien, Colleen S. Brunning-Fann, Scott D. Fitzgerald

Michigan Bovine Tuberculosis Bibliography and Database

Since 1994, the state of Michigan has recognized a problem with bovine tuberculosis (TB), caused by Mycobacterium bovis, in wild white-tailed deer from a 12-county area in northeastern Lower Michigan. A total of 65,000 free-ranging deer have been tested, and 340 have been found to be positive for M. bovis. The disease has been found in other wildlife species, and, in 1998, in domestic cattle, where to date 13 beef cattle and 2 dairy cattle herds have been diagnosed with bovine TB. Unfortunately, the situation is unique in that there have never been reports of self-sustaining bovine TB …

An Examination Of The Eastern Nebraska And Western Iowa Flash Flood Event Of 6-7 August 1999, Catherine M. Zapotocny, Stephen F. Byrd

National Oceanographic and Atmospheric Administration: Technical Reports and Related Materials

Flash flooding occurs each summer in eastern Nebraska and western Iowa. While 10-inch rains are extraordinary, it is not uncommon to have at least one excessive rain event during the annual convective season. A significant flash flood occurred in east central Nebraska and western Iowa the night of August 6, 1999 into the morning of August 7, 1999. Antecedent hydrologic conditions limited the loss of life, however considerable property damage resulted as the heavy rain fell over the urbanized areas in eastern Nebraska and western Iowa.

Several flash flood ingredients came together over the area. These meteorological factors are typical …

Application And National Geographic Information System Database To Support Two-Year Flood And Threshold Runoff Estimates, Seann Reed, Dennis Johnson, Timothy Sweeney Jan 2002

Application And National Geographic Information System Database To Support Two-Year Flood And Threshold Runoff Estimates, Seann Reed, Dennis Johnson, Timothy Sweeney

United States Department of Commerce: Staff Publications

A computer application and national geospatial database have been developed to support the calculation of flooding flow (Qf) and threshold runoff across the conterminous United States and Alaska. Flooding flow is the flow required to cause a stream to slightly overflow its bank and cause damage. Threshold runoff [L], defined as the depth of runoff required to cause flooding, is computed as flooding flow divided by the unit hydrograph peak flow. A key assumption in this work is that the two-year return flood (Q2) is a useful surrogate for flooding flow. The application described here computes …

Progress On Geoenvironmental Models For Selected Mineral Deposit Types, Robert R. Seal Ii, Nora K. Foley Jan 2002

Progress On Geoenvironmental Models For Selected Mineral Deposit Types, Robert R. Seal Ii, Nora K. Foley

United States Geological Survey: Publications

Since the beginning of economic geology as a subdiscipline of the geological sciences, economic geologists have tended to classify mineral deposits on the basis of geological, mineralogical, and geochemical criteria, in efforts to systematize our understanding of mineral deposits as an aid to exploration. These efforts have lead to classifications based on commodity, geologic setting (Cox and Singer, 1986), inferred temperatures and pressures of ore formation (Lindgren, 1933), and genetic setting (Park and MacDiarmid, 1975; Jensen and Bateman, 1979). None of these classification schemes is mutually exclusive; instead, there is considerable overlap among all of these classifications. A natural outcome …
