Digging Up The Bones Of The Past: Colonial And Indigenous Interplay In Winona Laduke's Last Standing Woman, Eclt Admin Jan 2002

Digging Up The Bones Of The Past: Colonial And Indigenous Interplay In Winona Laduke's Last Standing Woman, Eclt Admin

Faculty Journal Articles

In decolonization, there is the need of a complete calling in question of the colonial situation. If we wish to describe it precisely, we might find it in the well-known words: “The last shall be first and the first last.” Decolonization is the putting into practice of this sentence. That is why, if we try to describe it, all decolonization is successful. —Frantz Fanon, Wretched of the Earth Anishinaabe politician, author, and activist Winona LaDuke is one of the most recognizable tribal figures in modern America. Attaining minor fame as Ralph Nader’s vice-presidential candidate on the Green Party ticket in …

Strategies For Evangelizing The Upper-Class People In Ghana, Ampofo Benjamin Akyiano Jan 2002

Strategies For Evangelizing The Upper-Class People In Ghana, Ampofo Benjamin Akyiano

Doctor of Ministry Projects

Problem

The Seventh-day Adventist Church, which began its ministry in Ghana in 1888, is experiencing difficulty evangelizing upper-class people. The traditional method of soul-winning, public evangelism, has been successful to evangelize middle and lower social classes but not the wealthy and well-educated class. Currently, the church and the upper-class minority are far apart. The church must update its evangelistic methods to reach all classes to finish the gospel commission in Ghana.

Method

This study presents Ghana's upper-class, their social characteristics, lifestyles, world-views, population, and social and religious groups. Interviews and questionnaires were used to discover the factors that hinder the …

In Memoriam: Peter Francis, Jr., 1945-2002, Karlis Karklins Jan 2002

In Memoriam: Peter Francis, Jr., 1945-2002, Karlis Karklins

BEADS: Journal of the Society of Bead Researchers

The bead research community lost a principal member when Peter Francis, Jr., director of the Center for Bead Research in Lake Placid, New York, died December 8, 2002, while on a research trip to Ghana, West Africa. Pete was widely known and respected, and was responsible for significantly increasing people's awareness—on a worldwide scale—of beads and their place in human culture through his many publications, lectures, workshops, symposia, and internet website. He leaves a void that will be very hard, if not impossible, to fill.

Protestant Perspectives On Informed Consent (Particularly In Research Involving Human Participants), James F. Childress Jan 2002

Protestant Perspectives On Informed Consent (Particularly In Research Involving Human Participants), James F. Childress

Fordham Urban Law Journal

This Article examines Protestant positions on informed consent/refusal regarding the use of human subjects in research. Primarily focusing on the work of Paul Ramsey, a Protestant scholar in science and ethics, the article describes the relationship between the God-man covenant and man-to-man covenants and the consequences thereof. Exploring the line between what Ramsey calls "charity" and "justice," the article finds differences between therapeutic and nontherapeutic research and who may participate with or without consent.

Informed Consent Without Autonomy, Daniel P. Sulmasy Jan 2002

Informed Consent Without Autonomy, Daniel P. Sulmasy

Fordham Urban Law Journal

This Essay explains why and how the Roman Catholic basis for informed consent is different from the secular basis. It argues that the Catholic basis, which is rooted in "natural law," is the better model for society to adopt. The author explains that the secular view is rooted in the belief that patient autonomy must never be violated but the Catholic view is based on human dignity, which simply requires doctors to allow patients to exercise their free will within moral limits. This view allows doctors to override patients' decisions if those decisions are morally wrong or irrational.

Self-Government And The Inalienability Of Aboriginal Title, Kent Mcneil Jan 2002

Self-Government And The Inalienability Of Aboriginal Title, Kent Mcneil

Articles & Book Chapters

Aboriginal title to land, as defined by the courts, has a number of sui generis aspects. Prominent among these is its inalienability, other than by surrender to the Crown. Two explanations are usually given for this: the need to protect Aboriginal peoples from exploitation by unscrupulous European settlers, and the incapacity of the settlers to obtain title to land otherwise than by Crown grant. While acknowledging that the need for protection of Aboriginal lands was important historically, this article argues that it is paternalistic to rely on this explanation for inalienability today. The incapacity of settlers is a more satisfactory …

Natural Law And Public Reasons, Kent Greenawalt Jan 2002

Natural Law And Public Reasons, Kent Greenawalt

Faculty Scholarship

In this Lecture I shall discuss the reasons that officials and citizens should rely upon in American politics. In recent years, various theorists have claimed that people in liberal democracies should rely in politics on "public reasons," reasons that are accessible to all citizens. Others have objected that such a counsel is unreasonable, if not incomprehensible. I shall concentrate on two facets of this issue. First, does the law exemplify a structure of public reasons – that is, do judges deciding cases draw on a stock of public reasons that is narrower than all the reasons one might give for …

Measured Interpretation: Introducing The Method Of Correspondence Analysis To Legal Studies, Bernard E. Harcourt Jan 2002

Measured Interpretation: Introducing The Method Of Correspondence Analysis To Legal Studies, Bernard E. Harcourt

Faculty Scholarship

Professor Harcourt develops and advocates a method to more rigorously measure and evaluate how qualitative “social meaning” variables relate to legal practices and public policies. The method integrates in-depth qualitative interviews with an experimental free associational component, map analysis of the interviews, and a methodology, correspondence analysis, that remains little known in the United States despite its acceptance in other parts of the world. Correspondence analysis, according to Professor Harcourt, is a tool that allows researchers to visually represent the relationship between structures of social meaning and the contexts and practices within which they are embedded. This method opens up …

An Examination Of The Perceived Need And Recommended Competencies For A Secondary School Principal Internship Program In The Seventh-Day Adventist Educational System, Robert L. Caskey Jan 2002

An Examination Of The Perceived Need And Recommended Competencies For A Secondary School Principal Internship Program In The Seventh-Day Adventist Educational System, Robert L. Caskey

Dissertations

Purpose. The of this study was to examine the perceived need for, the recommended competencies of, and the delivery systems suggested, for a secondary school principal internship program in the Seventh-day Adventist educational system.

This study evolved from the belief that the significant turnover of principals represents a challenge for Adventist education. Because of this, the supply of qualified and experienced candidates is not available in sufficient numbers to meet the current personnel needs for secondary school administrators.

The review of related literature traced the history of principal internship training in the public school system from the early 1800s to …

The Refugee Jurist And American Law Schools, 1933-1941, Kyle Graham Jan 2002

The Refugee Jurist And American Law Schools, 1933-1941, Kyle Graham

Faculty Publications

This paper documents an important episode in the development of the “modern” American law school. Starting in 1933, law schools were invited to “host” or permanently welcome onto their faculties European jurists displaced by the German National Socialist government. At first, law schools sensed an opportunity to affiliate themselves with some of the leading lights of German “scientism.” Over time, however, these same institutions concluded that younger émigré scholars were more capable than their older counterparts were of embracing “American” practices of law teaching and scholarship. This article, drawing upon various archival sources, traces this transition, its causes, and its …

A Qualitative Analysis For Sex Determination In Humans Utilizing Posterior And Medial Aspects Of The Distal Humerus, Veronica L. Wanek Jan 2002

A Qualitative Analysis For Sex Determination In Humans Utilizing Posterior And Medial Aspects Of The Distal Humerus, Veronica L. Wanek

Dissertations and Theses

Visual and metric analysis both provide accepted methods for sex determination in humans. Visual ascertainment uses differing morphological traits in males and females to establish sex. Researchers have continually sought accurate methods of sexing long bones when skulls or pelves are absent or fragmented. These long bone elements may not have sexually distinct characteristics, but tend to survive in the field quite well.

Metric analysis depends on size dimorphism between males and females to correctly assign sex. Metric methods fail where the sexes overlap or when skeletal elements cannot be assigned to their correct biological population. Under these conditions, visual …

A Theoretical Proposal For Reaching Irreligious Czech People Through A Mission Revitalization Movement, Petr Činčala Jan 2002

A Theoretical Proposal For Reaching Irreligious Czech People Through A Mission Revitalization Movement, Petr Činčala

Dissertations

The main goal of this study was to develop a theory of missionary outreach to unchurched Czech people which is biblically informed and culturally relevant. The theoretical proposal for a plausible model of churching in the Czech Republic builds on basic theological, philosophical, and conceptual assumptions (chapter 2), a societal analysis of the problem of Czech churching (chapter 3), and a review of the issues relating to the situation of existing churches and religious movements.

Based on Wallace’s theory of revitalization movements a model is developed for starting a missionary movement that aims at reaching today’s unchurched and seemingly irreligious …

Patterns In Glass : The Interpretation Of European Glass Trade Beads From Two Protohistoric Sites In The Greater Lower Columbia Region, Gretchen Anne Kaehler Jan 2002

Patterns In Glass : The Interpretation Of European Glass Trade Beads From Two Protohistoric Sites In The Greater Lower Columbia Region, Gretchen Anne Kaehler

Dissertations and Theses

The issue of social status as it manifests in the archaeological record has long been a problematic one. Glass beads are often the most numerous class of historic artifacts recovered in protohistoric sites in the Pacific Northwest. Ethnohistoric accounts indicated that these beads might have functioned as prestige items and as a form of "primitive cash" among the aboriginal peoples of the Lower Columbia River in the early to mid 1800s. To what extent were glass beads indicative of status and can their spatial distribution within protohistoric sites be used to address this question?

The purpose of the present study …
