Punishment Theory: Moral Or Political?, Guyora Binder

This article argues that the justification of punishment is best conceived as a problem of political theory rather than moral philosophy. Noting the familiar charge that utilitarianism permits framing the innocent, it argues that retributivism is equally vulnerable to the charge that it permits lynching the guilty. It argues that both critiques unfairly attribute lawlessness and dishonesty to the respective punishment theories. As a result, they mischaracterize both as theories about what individuals should do, rather than what acts legitimate government should authorize. In so doing, they disregard how committed the founders of the respective theories were to the rule …

This article offers a critical analysis of the traditional maxim that motive is irrelevant to criminal liability. It retraces the history of this principle to show how its meaning has changed and its validity has declined over time. Originally promoted by reformers, the irrelevance of motive maxim derived meaning from their efforts to codify criminal law. In this context, the irrelevance of motive stood for two related reforms: (1) legislators should condition criminal liability on expectations of harm rather than desires, and (2) courts should require proof of statutory mental elements. Virtual laboratory experiments can be cost effective, convenient instructional resources that have appeal to a wide range of learning styles. Expensive, time-consuming laboratory tests can be experienced repeatedly and remotely using interactive simulations and original video footage or animations. A virtual experiment can incorporate meaningful exercises, procedural options, and background hyperlinks to create a comprehensive "hands on" environment. Also, it may be used as preliminary training for the actual experiment.

The nature of recreation and resource management issues related to the winter season in Yellowstone National Park requires a holistic approach in understanding visitor preferences, perceptions, and support for management actions. A dramatic increase in winter visitation over the past three decades and intense controversy related to bison management in the park have posed difficult challenges to managers. Specific questions such as what do visitors want out of their experience and how do visitors perceive management initiatives are central to these challenges. The Clean Air Act requires the use of complex photochemical models to predict future ozone concentrations and the impact of current and future regulations. In many instances uncertainty in the data input parameters used to operate these models results in uncertainty in the prediction of future air quality. The degree of this uncertainty is often greater than the degreee of air quality improvements proposed by regulations. This study evaluates the sensitivity of a photochemical model to predict future ozone air quality with respect to the uncertainty of several critical input parameters. A lubricant for use in lubricating the shot sleeve of a machine for die casting molten metals is in the form of agglomerated particles. The particles have an inorganic high pressure lubricant agglomerated, with a binder material and with an organic material. The solid lubricant is resistant to dusting, caking and breakage, can be fed through an automatic dispensing machine, and combines inorganic and organic materials to achieve excellent lubrication properties. The product has low flash and low smoke release into the environment.

This study presents a review of literature regarding adolescent anger management. Problematic anger is defined as externalizing or internalizing behaviors that occur frequently enough and at a high enough level of intensity to: (1) disrupt one's everyday functioning at school, home, and/or in the community; and (2) impair one's relationships with others and one's own self-concept. The causes can be traced to a myriad of possible sources: cognitive problems; developmental problems; chronic irritability, agitation, volatility, or mood instability; or environmental stressors.

The topic of lawyers advertising for clients seems prosaic enough, but it is really a subset of a much larger, more theoretical question. What Americans think about the Constitutional right of lawyers to advertise and market their services both reflects and molds what we think about the right to be left alone. In 1928, Justice Brandeis, in his famous dissent in Olmstead v. In one of the most stirring passages in modern ethics, Immanuel Kant famously enjoins: "act that you use humanity, whether in your own person or in the person of any other, always at the same time as an end, never merely as a means." The Thumb Member of the Miocene Horse Spring Formation contains a vertebrate track assemblage of mammal (camel and carnivore) and avian footprints. Camelid tracks identified are Lamaichnum alfi, Lamaichnum macropodum, and Lamaichnum etoromorphum. Carnivore tracks include canid tracks (Canipeda sp.) and a possible felid track ( Felipeda? sp.). One canid trackway records a c-shaped pattern, which is apparently the fist documentation of a rotary gallop gait in Miocene canids. Five types of bird tracks, four of which are previously undescribed, also occur. They are: (1) Alaripeda lofgreni, (2) Avipeda sp. A, (3) Avipeda sp. B, (4) Anatipeda sp. A, and …
