[Excerpt] "Few scientific issues have aroused passions more than the dispute about the health effects attributable to low levels of exposure to ionizing radiation (or radiation in short) and the currently authoritative dose response hypothesis, termed “linear non-threshold,” or LNT. Finding out whether health effects are induced by low-level radiation exposures, and if so, what they are, has become a kind of contest rather than a serious scientific inquiry. Sometimes it seems that rationality, or a methodical examination of the unknown, has disappeared from this debate. In Defense Of "Old" Public Health: The Legal Framework For The Regulation Of Public Health, Richard A. Epstein

The traditional forms of public health law were directly largely toward communicable diseases and other externalities, such as pollution, with negative health impacts. The more modern view treats any health issue as one of public health so long as it effects large numbers of individuals, which would include such matters as obesity and diabetes. Historically, this paper examines the constitutional evolution of the public health principle from the narrower to the broader conception. It then argues that the narrower principle better defines the appropriate scope of coercive government intervention than the broader definition, which could easily authorize those forms of …

The case of Eldred v. Ashcroft, argued before the U. S. Supreme Court on October 9, 2002, is the most important copyright case since 1834, when the court decided its first, Wheaton v. Peters. In Wheaton, the court ruled that under the Copyright Clause of the U.S. Constitution only Congress can grant copyright for published works. In Eldred, the court will decide the scope of Congress’ copyright power. "See Me, Touch Me, Feel Me": (Im) Proving The Bodily Sense Of Masculinity, Marc A. Ouellette

Ultimately, this paper stems from two cultural strands which intersect in one cultural form, self-improvement advertising aimed at men. The first of these is the figure of the "new man," which appeared in the mid-1980s. The novelty lies in the positioning of masculine bodies precisely for the purpose of being seen. The available criticism was not equipped to account for these positionings. The second cultural strand, the proliferation of technologies which alter the body itself, as opposed to its coverings, makes the gap in the criticism more apparent. A major tenet of African Tertiary biogeography posits that lowland rainforest dominated much of Africa in the late Cretaceous and was replaced by xeric vegetation as a response to continental uplift and consequent widespread aridification beginning in the late Paleogene. The aridification of Africa is thought to have been a major factor in the extinction of many African humid-tropical lineages, and in the present-day disparity of species diversity between Africa and other tropical regions. This primarily geologically based model can be tested with independent phylogenetic evidence from widespread African plant groups containing both humid- and xeric-adapted species. We estimated the …

The company now has three customer service divisions and the regional division is the biggest customer service division of the company.The objectives of this study are to evaluate the performance of the contact center of the regional division and improve its performance through the simulation while still maintaining the standard service level required by the BlueCross BlueShield Association. Coastal and ocean management is a constantly evolving practice. For at least two decades, coastal communities around the world have been experimenting with new ways to control a multitude of activities in their urban and rural harbors. The number and diversity of Marine Protected Areas are growing, with an increasing focus on protecting integrated biological communities, rather than individual species of concern. The United States and Canada are each developing new, comprehensive ocean polices, looking to better integrate management functions at all levels of government.

Urban travel demand modeling in the United States has a rich history in both practice and academic research. The same cannot be said, however, of freight demand modeling despite the intermodel planning requirements of IS TEA and TEA21. In most instances, agencies responsible for state transportation planning (e.g. Kentucky Transportation Cabinet) have applied, in a limited way, the methodology developed for urban travel demand modeling (i.e., Urban Transportation Modeling System or UTMS 1) to the freight arena (see, for example, Black 1997). Pre-Logging Liana Cutting Reduces Liana Regeneration In Logging Gaps In The Eastern Brazilian Amazon, Jeffrey J. Gerwing, Christopher Uhl

The cutting of all lianas prior to logging is a reduced-impact logging technique that is predicted to reduce liana proliferation in logging gaps. This study compares liana abundance and species composition in gaps created during conventional and reduced-impact logging in a forest of the eastern Brazilian Amazon. Logging treatments were conducted in side-by-side plots. Shortly following logging, 50-m2 plots were located in the approximate centers of four single treefall and four multiple treefall gaps in each logging area. Six years following logging, there were ∼40% fewer climbing lianas in reduced-impact gaps than in conventional logging gaps. In both logging …

Multiyear regulatory commitments, or their absence, are an important part of the functioning of the telecommunications services and products industries. In this Article, Warren G. Lavey argues that, under some conditions, it is both possible and beneficial for regulators to commit to a well-defined, multiyear sequence of regulatory changes. First, this Article examines several examples of how efforts for comprehensive reform fared in real multiyear implementations. It also explores how some piecemeal regulatory changes evolved into efforts for comprehensive reform based on a well-defined sequence. The fossil record represents a history of life on this planet. Attempts to obtain molecular information from this record by analysis of nucleic acids found within fossils of extreme age have been unsuccessful or called into question. However, previous studies have demonstrated the long-term persistence of peptides within fossils and have used antibodies to extant proteins to demonstrate antigenic material. In this study we address two questions: Do immunogenic/antigenic materials persist in fossils? and; Can fossil material be used to raise antibodies that will cross-react with extant proteins? The purpose of this study is to explore the constructions of race, marriage, and love insofar as these components promote the exclusion of interracial intimacy and marriage from the dominant discourse. The study focuses on the ways in which the social sciences have polarized "blacks" and "whites" (linguistically, socially, and economically) thus, making it difficult for persons living in black and white skin to experience social affirmation through literature, media, and agents in everyday life.

LARGE quantities of reactive oxygen species (ROS) released during reperfusion after coronary artery occlusion damage proteins responsible for intracellular homeostasis, produce tissue injury, depress contractile function, and increase myocardial infarct size. In contrast, small quantities of ROS may exert beneficial effects during ischemia and reperfusion when released before a prolonged ischemic event. ROS derived from mitochondria during a brief ischemic episode produce preconditioning. Free radical scavengers administered during ischemic preconditioning (IPC) markedly attenuate the protective effect of the preconditioning stimulus on infarct size. These data suggest that IPC is mediated in part by small quantities of ROS released during preconditioning. …

The effects of two levels of red clover (low and high) and three levels of N fertilizer (0, 28, 56 N kg ha-1) on herbage accumulation and quality of grass-legume mixed swards were studied. Total herbage accumulation of the mixtures with high legume percentage was significantly higher than those with low legume percentage and this was most pronounced at second harvest. Swards high in legumes also had higher crude protein concentrations and lower weed percentages than those low in legumes. Although the effect of N on herbage accumulation was not significant, an increase was observed for crude protein concentration of …

Neurons using gamma-aminobutyric acid (GABA) as a neurotransmitter are critically important as inhibitory neurons in the CNS. A major hindrance to further studies of this important and highly diverse class of neurons is their relative scarcity, which makes it difficult to identify and target them for morphological and physiological studies. To overcome this difficulty, we developed a novel protocol for visualizing detailed morphology of GABAergic neurons in living mouse brain slice cultures, using biolistic transfection with GAD67-GFP. The morphological, immunocytochemical and physiological characteristics of GAD67-GFP expressing neurons indicated that they were functional GABAergic neurons. B lymphocytes are continually produced in bone marrow from pluripotential hematopoietic stem cells. Lymphopoiesis is characterized by a series of highly regulated genotypic and phenotypic changes resulting in immunocompetent effector cells which express cell surface immunoglobulin. Our laboratory has focused on defining extracellular signals regulating lymphoid progenitor cell survival, proliferation, and differentiation. These studies have demonstrated that pro-B cell survival, proliferation, and differentiation are regulated by interactions with fibroblastic stromal cells in the hematopoietic microenvironment. However, specific molecular mechanisms by which stromal cells regulate B lymphoid development are largely unknown. In an attempt to better understand molecular mechanisms regulating maturation …

The NCRP has recently defined RBE values and a new quantity (Gy-Eq) for use in estimation of deterministic effects in space shielding and operations. The NCRP's RBE for neutrons is left ambiguous and not fully defined. In the present report we will suggest a complete definition of neutron RBE consistent with the NCRP recommendations and evaluate attenuation properties of deterministic effects (Gy-Eq) in comparison with other dosimetric quantities.

As the two primary modes of filmic representation, fiction and documentary have long been separated by their distinct associations with subjectivity and objectivity respectively. Documentary film, with its ties to lived reality, has been especially hampered by a too direct connection with objectivity. Regarding the documentary film's representation of actuality, there is a tendency for the authority behind the construction of the documentary image to go unexplored and unquestioned when the documentary subject is thought to be objectively represented.
