This Comment criticizes a pair of decisions by the United States Court of Appeals for the Second Circuit, FCC v. NextWave Personal Communications, Inc. (In re NextWave Personal Communications, Inc.) and In re FCC, which held that a bankruptcy court lacks jurisdiction to determine whether the Federal Communications Commission is stayed from revoking a debtor's licenses. The Comment argues that the Second Circuit interpreted the bankruptcy court's jurisdiction too narrowly because it failed to distinguish properly between an agency's action as a creditor and as a regulator. It concludes that bankruptcy courts and courts of appeals have concurrent jurisdiction to …

This paper explores issues of psychological plausibility in modeling natural language understanding within Soar, a symbolic cognitive model. It focuses on constructing syntactic and semantic representations in simulated real time, with particular emphasis on word sense disambiguation (WSD). We discuss (i) what level of WSD should be modeled and (ii) how to use resources such as WordNet to inform these models. A preliminary model of coarse-grained WSD is included to show how syntactic, semantic, and other knowledge sources interact in Soar. Finally, we explore issues of interleaving, learning, and integrating other WSD approaches with Soar's native model of learning.

The high spectral intensity of X-rays produced by the undulator at the Basic Energy Sciences Synchrotron Radiation Center of Argonne's Advanced Photon Source has allowed us to perform small-angle X-ray scattering (SAXS) studies of the initial distribution of soot particles formed by various fuels. SAXS provides an in situ probe of the morphology of soot in the region between 1 and 100 nm and complements the ex situ technique of electron microscopy. The basic aspects of SAXS and its potential are illustrated with measurement on a laminar flame of acetylene in air. The more complex fuel toluene has been studied …

A CO/H₂/O₂/N₂ flame was operated under fuel-rich conditions in a flat flame reactor to provide a high-temperature, oxygen-free environment to study secondary reactions of coal volatiles. The distributions of fuel nitrogen in the devolatilization products of four coals, ranging from high volatile bituminous to lignite, were obtained at gas temperatures ranging from 1159 to 1858 K. It was found that the initial nitrogen released was contained almost exclusively in the tar for all coals. Release of nitrogen from the char as light gases started at a later stage than tar nitrogen release. During secondary reactions, …

Reaction of coal in a plasma jet is complex and extremely rapid, and acetylene and carbon monoxide are the main products in the pyrolysis gas. Coal pyrolysis is assumed as the first step reaction when coal is injected into hot plasma jet with initial average temperature of 3700 K. Chemical percolation devolatilization (CPD) is employed first to simulate this procedure in mechanism. The calculation results indicate coal pyrolysis rate in plasma jet is very fast and the retention time of coal staying in reactor is only several milliseconds. Coal pyrolysis experiments were performed in the post-flame region of a CH₄/H₂/air flat-flame burner operating under fuel-rich conditions, where the temperature and gas compositions were similar to those found in the near-burner region of an industrial pulverized coal-fired furnace. Volatiles released from the coal particles formed a cloud of soot particles surrounding a centrally fed coal/char particle stream. Soot samples were collected from the cloud at different residence times using a water-cooled, nitrogen-quenched probe. The soot samples were then analyzed for their elemental compositions of carbon, hydrogen, nitrogen, sulfur, and (by difference) oxygen plus inorganic matter. …

The "Seven Principles for Good Practice in Undergraduate Education," originally published in the AAHE Bulletin (Chickering & Gamson, 1987), are a popular framework for evaluating teaching in traditional, face-to-face courses. The principles are based on 50 years of higher education research (Chickering & Reisser, 1993). A faculty inventory (Johnson Foundation, "Faculty," 1989) and an institutional inventory (Johnson Foundation, "Institutional," 1989) based on these principles have helped faculty members and higher-education institutions examine and improve their teaching practices.

When we see teenagers do things that are seriously wrong or illegal we often ask, “Why did they do such a stupid thing?” “What in the world were they thinking?” In fact, teenagers do many stupid things and sometimes it appears they were not really thinking. But when we examine what goes through their minds it is easier to understand why they sometimes act dishonestly. We also learn that the excuses teenagers make for being dishonest are not much different than the rationalizations used by adults.

The infamous extermination order issued 27 October 1838 by Missouri Governor Lilburn W. Boggs caused thousands of Latter-day Saints to flee the state and seek refuge in Illinois across the Mississippi River. Illinois, established in 1817, had high hopes for its future, but just two decades later it was smitten, like the rest of America, with the economic depression of 1837. Many legal rules turn on a party's state of mind or intent with respect to some action or consequence. Legal scholars have long debated the contours of such requirements and the sorts of proof required for them. Intent has been an especially controversial issue in antitrust law. This paper provides a theory of legal standards that explains the role of intent analysis in antitrust and in other areas of the law. We argue that intent requirements, and many other legal rules, can be understood by focusing on the goal of minimizing the expected costs from legal errors. After developing a …

The specificity of the Social Interaction Self-Statement Test (SISST) was evaluated in sample of 277 patients seeking treatment for anxiety. Both the positive and negative scales significantly discriminated between patients diagnosed with social phobia and other anxiety disorder patients. Patients with social phobia scored significantly higher on the negative scale and significantly lower on the positive scale as compared with other treatment-seeking anxiety disorder patients. Negative SISST scores were significantly correlated with the Beck Anxiety Inventory (BAI) and Beck Depression Inventory (BDI). The positive scale was significantly correlated with the BDI. Following the seemingly endless debate over managed care liability, I cannot suppress thoughts of Yeats’s poem, “The Second Coming.” It is not the wellknown phrase, “Things fall apart; the centre cannot hold,” that comes to mind; although that could describe the feeling of a health-care system unraveling. The poem’s depiction of lost innocence — “The best lack all conviction, while the worst/Are full of passionate intensity” — does not allude to the legislature, the industry, the public, or the medical or legal profession. The problem for investigation encompassed three domains that identified the One Stop Career Center's (OSCC) remedial programs, the ability of its clients to enter federally funded job training programs, and clients' success in the programs they entered. Another facet of the study examined whether OSCC was using its current instructional software effectively in client remediation. The purpose of the project was to evaluate the use and effectiveness of computer assisted instruction (CAI) in basic skills remediation.

This paper compares the effectiveness of two instructional approaches for teaching the names of alphabet letters to 5 and 6 year-old elementary students who were at risk for academic failure. The literature review examines investigations which had previously addressed the direct instructional model and parameters of active learning. The problem is that a gap exists between the Frankford Hospital School of Nursing (FHSN) curriculum design, increased National Council Licensure Examination for Registered Nurses (NCLEX-RN) passing standards, and the revised NCLEX-RN examination that has integrated leadership and management concepts. The FHSN curriculum design does not adequately prepare students to address leadership and management concepts that are being tested on the NCLEX-RN.

Objective: To pilot test an inexpensive, home-based water decontamination and storage system in a low-income neighborhood of Karachi.Methods: Fifty households received a 20-L plastic water storage vessel with a high-quality spout and a regular supply of diluted hypochlorite solution. Twenty-five control households were recruited. Water samples were collected at baseline and during unannounced follow-up visits 1, 3, 6, and 10 weeks later.Results: Baseline drinking water samples among intervention households were contaminated with a mean 9397 colony-forming units (cfu)/100 mL of thermotolerant coliforms compared with a mean 10,990 cfu/100 mL from controls. The language pedagogy literature stresses the importance of the quality of second/foreign language teaching/learning in learners' acquisition, development of communicative competence, or both. The change literature equally emphasizes the importance of the quality of innovation in change audience’s resolution to reconceptualize current practices and espouse the new practice being advocated. Both literatures underline the need to use multiple research strategies in order to depict the product and process of learning and/or shifting experiences. The article explores the intersection of law, rhetoric, and corporeality, arguing that law is deeply embedded in the human body and its emotional and sensory experiences. It posits that legal dogmatics, while often seen as abstract, is shaped by the body's characteristics and movements, which serve as a substrate for legal logic. The analysis centers on Abraham Fraunce and his contemporaries, who critique the strict legality by emphasizing rhetoric, decorum, and the form of life that rhetoric implies. This critique challenges the notion of law as a detached, abstract system by highlighting its corporeal and emotional dimensions.
