A quarter century ago, in a provocative and prophetic article, David E. Feller lamented the imminent close of what he described as labor arbitration's "golden age." I have expressed reservations about that characterization, insofar as it suggested an impending shrinkage in the stature of arbitration. But Professor Feller was right on target in one important respect. Labor arbitration was going to change dramatically from the autonomous institution in the relatively self-contained world of union-management relations which it had been from the end of World War II into the 1970s. Can a privately negotiated arbitration agreement deprive employees of the statutory right to sue in court on claims of discrimination in employment because of race, sex, religion, age, disability, and similar grounds prohibited by federal law? Two leading U.S. Supreme Court decisions, decided almost two decades apart, reached substantially different answers to this questionand arguably stood logic on its head in the process. In the earlier case of Alexander v. Gardner-Denver Co., involving arbitration under a collective bargaining agreement, the Court held an adverse award did not preclude a subsequent federal court action by the black grievant alleging racial discrimination. …

Like Jane Ginsburg, I would like to drop back a bit, to talk about more general principles. Essentially, both of our primary speakers focused on a distinction between property and non-property modes of protecting data. I would like to highlight the economic and ethical reasons for maintaining that distinction.

Synthesis Of Cyclopropanes Via Organoiron Methodology: Preparation Of 2-(2′-Carboxy-3′-Ethylcyclopropyl)Glycine, Kamil Godula, William A. Donaldson

A route to 1,2,3-trisubstituted cyclopropanes has been developed. The relative stereochemistry at the three cyclopropane centers is established by nucleophilic attack on the pentadienyl ligand on the face opposite to iron and subsequent oxidatively induced reductive elimination with retention of configuration. This methodology was applied to the synthesis of 2-(2′-carboxy-3′-ethylcyclopropyl)glycines. The diastereomeric glycine dimethyl esters are separable as their diphenylmethylene imines.

The conformationally restricted glutamate analogs (2S,1′S,2′S,3′R)- and (2R,1′S,2′S,3′R)-ECCG's 5a and5b were prepared in five steps (17 and 15% yield, respectively) from (pentadienyl)Fe(CO) …

Two historical changes have impacted on women's relationship with work in the last century. The influx of young single women into the paid work force and the participation of married women in the paid work force have changed the world of work for men and women. Middle and upper class women gained access into the public sphere through the caring work of teaching, nursing and social work. Although the roles of women have expanded and in many ways changed, the struggle for equity is far from over. Women still earn, on average, significantly less than males in Canada. Female Social …

Adolescent Development In The Context Of Canadian-Chinese Immigrant Families, Ching Man Lam

This study investigates the developmental processes and outcomes of Canadian-Chinese adolescents in families who had immigrated from Hong Kong to the Toronto, Canada area between seven and fifteen years previously. In-depth qualitative interviews with nineteen adolescents, between the ages of sixteen and twenty-one, and ten parents were conducted between February and August 1997. The study's results describe the dynamic interplay of culture and migration that shapes the developmental processes and outcomes of adolescence in Canadian-Chinese Hong Kong immigrant families. The results also address the meanings constructed by the parents and the adolescents as a result of their experiences. Studies show …

Genomic Southern blotting analyses of Bombyx mori and B. mandarina were performed with the 5′-exons or 5′-flanking sequences of two members of genes A/B.L11 and A/B.L12. They represent multigene families encoding chorion proteins that are expressed in the middle period of choriogenesis. Many bands cross-hybridized with the probes in B. mandarina and in different strains and races of B. mori, supporting the idea that the middle chorion multigene families have remained essentially the same in the two species. Both the exon and the 5′-flanking probes exhibited similar patterns within the European stocks of B. mori, indicating that the examined …

Following the Civil War, black Americans began acquiring land in earnest; by 1920 almost one million black families owned farms. Since then, black rural landownership has dropped by more than 98% and continues in rapid decline-there are now fewer than 19,000 black-operated farms left in America. By contrast, white-operated farms dropped only by half, from about 5.5 million to 2.4 million. Commentators have offered as partial explanations the consolidation of inefficient small farms and intense racial discrimination in farm lending. However, even absent these factors, the unintended effects of old-fashioned American property law might have led to the same outcome. …

On 29 December 2000, the U.S. Treasury Department released its long-awaited study of Subpart F, entitled “The Deferral of Income Earned through U.S. Controlled Foreign Corporations." This study was commenced in the aftermath of the controversy that ensued from the issuance and subsequent withdrawal of Notice 98-11. The study was originally expected to be issued in 1999 in response to the report published that year by the National Foreign Trade Council, which advocated significant changes in Subpart F. The Treasury Study’s delayed issuance at the end of the Clinton Administration means that it only has (at best) persuasive force for …

Human Immunodeficiency Virus Type 1 Quasi Species That Rebound After Discontinuation Of Highly Active Antiretroviral Therapy Are Similar To The Viral Quasi Species Present Before Initiation Of Therapy, Keith A. In an effort to identify the sources of the viruses that emerge after discontinuation of therapy, analyses of human immunodeficiency virus (HIV) quasi species were done for 3 patients with sustained levels of HIV RNA of <50 copies/mL for 1-3 years. The sequences found in the rebounding plasma virus were closely related to those of the actively replicating form of viruses present before the initiation of combination therapy. All quasi species found in the rebounding plasma virus were also present in proviral DNA, cell-associated RNA in peripheral blood mononuclear cells (PBMC), and virion RNA derived from PBMC coculture during periods when plasma HIV RNA levels were <50 copies/mL. These findings suggest that the rapid resurgence of plasma viremia observed after discontinuation of therapy and the viruses cocultured from PBMC are derived from a relatively stable pool of the replicating form of virus rather than from activation of a previously latent pool.

Gravitational Descendants And The Moduli Space Of Higher Spin Curves, Tyler J. Jarvis, Takashi Kimura, Arkady Vaintrob

The purpose of this note is introduce a new axiom (called the Descent Axiom) in the theory of r-spin cohomological field theories. This axiom explains the origin of gravitational descendants in this theory. Furthermore, the Descent Axiom immediately implies the Vanishing Axiom, explicating the latter (which has no a priori analog in the theory of Gromov-Witten invariants), in terms of the multiplicativity of the virtual class. We prove that the Descent Axiom holds in the convex case, and consequently in genus zero.

The study of children's social and emotional development requires that attention be paid to such factors as dispositional/biological factors (e.g., temperament), familial interactions and relationships, social contexts (e.g., school, neighborhood), and culture. For example, Hinde (1995) has advanced the notion that development be considered from a multi-level perspective beginning with individual characteristics and progressing the interaction, relationship, and group levels of analysis and conjecture. At the level of the individual child, developmental scientists have studies such constructs as temperament that might lead to problematic social or behavioral outcomes. One such interpersonal characteristic is that of "difficult" temperament – a phenomenon …

Children spend much of their youthful energy engaged in play. Indeed, play, in its various forms, represents a serious business – not only for the active participations, but also for students of the phenomenon. To many researchers, play is viewed as a generative fore in children's social, emotional, and cognitive development (see Rubin, Fein, & Vandenberg, 1983; Saracho & Spodek, 1998; Fromberg & Bergen, 1998). The 4 articles in this special issue make important contributions to both family and religious studies as well as to their interface. This commentary begins by considering 4 unifying themes present across all of the articles, including meaningful religion-family linkages, the importance of gender differences in the faith-family interface, the significance of intergenerational relationships, and the need for better theory. The authors then discuss the unique major strength and secondary limitations of each study.
