The purpose of this paper is to review existing literature and research on peer mediation ip schools. A critical review is necessary due to the increasing popularity of peer mediation programs despite limited empirical evidence to support their usage. Examining the strengths and weaknesses of previous research is an important part of establishing program effectiveness and overcoming barriers to successful implementation. A critique of the research and implications for future research are also provided.

On The Classical Ramsey Number R(3,3,3,3), Susan Fettes

The classical Ramsey Number R(3, 3, 3, 3), which is the smallest positive integer n such that any edge coloring with four colors of the complete graph on n vertices must contain at least one monochromatic triangle, is discussed. Basic facts and graph theoretic definitions are given. Papers concerning triangle-free colorings are presented in a historical overview. Mathematical theory underlying the main result of the thesis, which is Richard Kramers unpublished result, i?(3,3,3,3) < 62, is given. The algorithms for the com putational verification of this result are presented along with a discussion of the software tools that were utilized to obtain it.

State Cybercrime Legislation In The United States Of America: A Survey, Susan W. Brenner

In the United States, cybercrimes are the focus of legislation adopted at both the state and federal levels. The U.S. Constitution allocates lawmaking authority between the two levels according to certain principles, one of which is that even when federal jurisdiction to legislate exists, federal legislation is appropriate only when federal intervention is required. And while federal legislative authority can pre-empt the states' ability to legislate in a given area, it rarely does, so it is not unusual for federal criminal laws to overlap with state prohibitions that address essentially the same issues.

Jay Cohen's Brave New World: The Liability Of Offshore Operators Of Licensed Internet Casinos For Breach Of United States' Anti-Gambling Laws, Adrian Goss

On February 28, 2000, Jay Cohen, co-owner of an Antiguan-based Internet casino called World Sports Exchange, was convicted by a U.S. District Court jury in Manhattan of breaching the Wire Communications Act of 1961 (hereinafter Wire Act). A New York federal judge subsequently fined Cohen $5,000 and sentenced him to serve a twenty-one month jail term. A few days prior to his conviction, Cohen's lawyer stated that "Jay strongly believes that he did not commit a crime, that he ran [World Sports Exchange] in a completely legitimate manner."

The strength of a patent as a legal instrument to protect an invention rests primarily on the drafting quality of its claims. The claims of a patent recite the invention "that is deemed by [the] applicant to be operable and patentable." Furthermore, the claims define the legal metes and bounds of an invention so that a patent owner can prevent others from making, using, and selling a patented product in the United States for a period of twenty years from the filing of the patent application. The Fate Of The Native Hawaiians: The Special Relationship Doctrine, The Problem Of Strict Scrutiny, And Other Issues Raised By Rice V. Cayetano, William E. Spruill

Harold "Freddy" Rice is a Native Hawaiian in the sense that he was born in the Hawaiian Islands and can "trace[ ] his ancestry to two members of the legislature of the Kingdom of Hawaii, prior to the Revolution of 1893. " He is a taxpayer and a qualified elector of the United States, the State of Hawaii, and the County of Hawaii. When Rice applied to vote in the 1996 election for the trustees of the Office of Hawaiian Affairs ("OHA"), however, his application was denied. Why? Because, according to a state statute, he was not Hawaiian enough.

Years after his death, John Wayne sells beer in television commercials. Eons after their extinction, lifelike dinosaurs continue to terrorize actors and thrill moviegoers. The highest- grossing film of all time4 employs "virtual" passengers aboard the Titanic, worrying some members of the Screen Actors Guild. All of these feats have been accomplished using sophisticated computer graphics software that blurs the distinction between imagination and reality. This manipulative digital power has raised concerns about such things as "digital kidnapping," the unauthorized misuse of digital images. Annual Survey Of Virginia Law: Labor And Employment Law, Thomas M. Winn Iii

This article discusses six areas of labor and employment law in which there was significant activity in Virginia's courts over the past year: (1) covenants not to compete and employee's fiduciary duties to employers; (2) the doctrine of respondeat superior; (3) negligent hiring, retention, and supervision; (4) wrongful discharge in violation of public policy; (5) workers' compensation exclusivity; and (6) employment agreements. Beyond the scope of this article are decisions rendered in other areas of law that affect the employment relationship, including defamation, claims under Virginia's Occupational Safety and Health Act, public employment claims, and unemployment compensation claims.

GLBTQ (Gay, Lesbian, Bisexual, Transgendered, Queer/Questioning) people often appear as guests on daytime television talk shows. Using cultivation analysis, the author explored television talk show viewers' perceived realism of television talk shows and GLBTQ people. This quantitative study tested seven hypotheses. Support was found for the first two hypotheses, indicating that heavy viewers of television talk shows perceived television talk shows to be more realistic or true to life than light viewers. Support was not found for the other hypotheses. There was no significance difference between heavy and light viewers of television talk shows and their perception of the GLBTQ …

The Effect Of Anaerobic Exercise On The Thermic Effect Of Food, Charlene Marie Denzer

The thermic effect of food (TEF) is the increment in energy expenditure above resting metabolic rate associated with the cost of absorption, metabolism, and storage of food. Previous studies have shown that TEF is enhanced by aerobic exercise. The purpose of this study was to determine if a similar effect occurs with anaerobic exercise (weight lifting). VO2 was measured after ingestion of a 660 kcal meal with and without prior completion of a weight-training regimen. TEF was 42% higher after the exercise trial (t = 2.539, p < .017), compared with the control trial. These results indicate that prior anaerobic exercise also leads to an enhanced TEF.

Work-related hand-arm disorders (HAVS) caused by exposure to vibration while operating vibrational tools were discussed; no clear dose-effect relationship between vibration exposure and HAVS was found yet. Ways to avoid or delay harmful impact on workers were explored, one means of which is using antivibration gloves during operation. Four types of antivibration gloves were tested per standard ISO 10819, test setup and procedures were presented. Two models of hand-arm-glove system were developed and analyzed; the models were used for predicting the gloves' transmissibility before carrying out actual tests. Characterization Of 2-Methyl-8-Quinolinolato Gallium (Iii) Chelates, Sanjini Ushika Nanayakkara

We present a detailed photophysical (absorption and emission), thermal and X-ray absorption (NEXAFS) study of gallium (III) bis(2-methyl-8-quinolinolato) carboxylate (2Meq2GaOR) chelates, where OR = acetato (OAc), trifluoroacetato (OTF) and dimethylpropianato (ODMP). These materials are compared with aluminum (III) tris(8-quinolinolato) (Alq3) chelates. We show that regardless of changing the carboxylato ligand the 2Meq2 GaOR chelates have similar unoccupied (LUMO) states. This implies that charge injection should be constant in these materials when used as emitter materials in organic light emitting devices. We also present the first detailed evaluation in to the mer/fac isomerization of gallium (III) tris(2-methyl-8-quinolinolato) (2Meq3Ga) chelate in both …

This thesis carefully examines the relationship between the commercial air travel and tourist industries in Las Vegas, especially highlighting their unprecedented growth in the second half of the twentieth century. This study analyzed the mean tips earned per table game dealer of a mega-resort casino located on the Las Vegas "strip" during Comdex, a large annual computer convention located in Las Vegas. Members of the media and gaming authorities have claimed that Comdex conventioneers do not gamble or tip as much as most convention attendees, yet no substantiated and documented explanation has been offered to explain why. This study hypothesized that Comdex conventioneers have the "programmer personality," which is low in the personality dimensions of neuroticism and extraversion. The Geochemistry Of Gold-Bearing And Gold-Free Pyrite And Marcasite From The Getchell Gold Deposit, Humboldt County, Nevada, Kelli Diane Weaver

Petrographic and geochemical investigations of pyrite and marcasite from the Getchell Carlin-type gold deposit show that elevated concentrations of a characteristic suite of trace metals correlate with ore-stage pyrite morphology. Secondary ion mass spectrometry analyses revealed a significant positive correlation between As and Au in ore-stage Fe-sulfide minerals. High-resolution transmission electron microscopy analyses revealed that gold-bearing Fe-sulfide crystals are arsenic-rich marcasite, rather than pyrite. These analyses failed to identify gold as microinclusions in ore-stage pyrite/marcasite, and support the conclusion that gold is present in solid solution; Analyses reflect the chemistry of fluids responsible for precipitation of the pyrite and marcasite. …
