In a prestigious journal devoted to transnational law, the intramural concerns of American lawyers cannot claim pride of place. Nonetheless, it is difficult to see how we can clear the way for lawyers to move from nation to nation if we cannot move from state to state. Charity, as they say, begins at home. Either we are insular and protectionist or we are not. We cannot have it both ways.

As Prince Bismark noted, however, "Politics is the art of the possible." Like it or not, American lawyers are stuck with a system of state-based regulation for the foreseeable future. …

This Article examines the status of copyright laws in several countries as they pertain to transmissions of music on the Internet. Because the exact legal ramifications of music transmissions over the Internet are currently unclear, the Author compares copyright laws of six major markets and examines the potential application of the copyright laws and other rights that may apply. The Article also discusses rules concerning which transborder transmissions are likely to be covered by a country's national laws, as well as specific rules applying to the liability of intermediaries. In the eight years since its adoption, NAFTA Chapter 11 has escaped significant scrutiny from academics and journalists alike. However, with the recent filing of several Chapter 11 expropriation claims involving U.S. states, Chapter 11 has begun to gain some notoriety in the press and sparked at least two legal symposia this past year.

This Note begins by highlighting the recent Methanex Chapter 11 claim involving the State of California. Methanex, a Canadian chemical manufacturer and importer, claimed $1.6 billion in damages over California's ban of the chemical MTBE. As trade between the United States and Canada continues to increase on the heels of the free trade agreements of the early 1990s, the question of which body of commercial law to apply to these transactions becomes increasingly important. The United Nations Convention on Contracts for the International Sale of Goods (CISG) serves as the default governing law for many of these transactions. Development Of European Corn Borer Larvae On Event 176 Bt Corn: Influence On Survival And Fitness, Blair D. Siegfried, Amelia C. Zoerb, Terrence A. Spencer

European corn borer larvae, Ostrinia nubilalis (Hübner) (Lepidoptera: Crambidae) that have completed development on Event 176 Bt corn hybrids have survived exposure to sublethal doses of the Cry1Ab Bt toxin or are exploiting plant tissues that do not express the toxin. To evaluate the impact of such exposure, diapausing larvae were collected from Event 176 and conventional hybrids and compared for rates of pupation, parasitism, fitness (pupal weight, longevity, and fecundity) and susceptibility to the Cry1Ab toxin. Larvae completing development on Event 176 corn exhibited approximately 10% higher survival rates and correspondingly lower parasitism rates than larvae completing development on …

Induced resistance in soybean was investigated in the greenhouse using different concentrations of the chemical inducer Actigard™ to determine the influence on feeding preference of bean leaf beetle adults. Treatments of 0 (control), 15, 25, 40, 60, and 80 ppm Actigard™, and artificial defoliation followed by 25 ppm Actigard™ were applied to V1 and V6 stages of soybean plants. Dual-choice feeding preference tests with the bean leaf beetle were used to assess induced resistance. The adult beetles were collected from soybean fields in east central Nebraska 2 to 5 days prior to the feeding preference tests. Pair-wise comparisons of leaflets …

We have previously determined that cytochrome P450-based oxidation is involved in resistance to the insecticides methyl parathion and carbaryl in geographically distinct Nebraska western corn rootworm populations. Three new family 4 cytochrome P450 (CYP4) gene fragments (CYP4AJ1, CYP4G18 and CYP4AK1) were cloned and sequenced from insecticide-resistant and -susceptible western corn rootworms. Insecticide bioassays indicated the resistant population employed in this study was significantly resistant to the insecticides methyl parathion and carbaryl. CYP4AJ1 and CYP4G18 were cloned from both genomic PCR and RT-PCR products, although only CYP4AJ1 contains an intronic region. Cross-resistance, and longevity of resistance, induced by the bean leaf beetle, Cerotoma trifurcata, was studied IN the soybean PI 227687 that exhibited induced response in earlier studies. Bean leaf beetle adults and soybean looper, Pseudoplusia includens, larvae were used to induce resistance and to determine beetle feeding preference. Beetles were collected from soybean fields 2 to 5 days prior to the feeding preference test. The level of cross-resistance induced by soybean looper herbivory to subsequent bean leaf beetle feeding was higher when compared to cross-resistance induced by bean leaf beetle herbivory against subsequent feeding by soybean looper. Decapitation Impacting Effect Of Topically Applied Chlorpyrifos On Acetylcholinesterase And General Esterases In Susceptible And Resistant German Cockroaches (Dictyoptera: Blattellidae), No-Joong Park, Shripat T. Kamble

The effect of topically applied chlorpyrifos on acetylcholinesterase and other esterases in heads and decapitated bodies of CSMA and Crawford German cockroaches was examined with spectrophotometric enzyme assay and native polyacrylamide gel electrophoresis. The toxicity of chlorpyrifos was greatly reduced in decapitated CSMA male cockroaches with LD50 value 17.1-fold higher than that of normal CSMA cockroaches. Acetylcholinesterase activity from heads was significantly higher in the Crawford compared with the CSMA strain and did not change until 24 h after chlorpyrifos in vivo treatment in both strains. Arthropod Populations And Rice Yields In Direct-Seeded And Transplanted Lowland Rice In West Africa, I. O. Oyediran, E. A. Heinrichs

Two methods for planting rice in irrigated lowland were evaluated during the wet seasons of 1994 and 1995 to determine their effect on rice arthropod numbers, insect-caused rice plant damage, and rice grain yield. The six treatments tested were: hand transplanting of seedlings at spacings of 14 cm × 14 cm, 20 cm × 20 cm, and 30 cm × 30 cm; and direct-seeding of rice at 60 kg seeds ha–1, 90 kg seeds ha–1, and 120 kg seeds ha–1. Early-juvenile tripletail Lobotes surinamensis (n = 27; range 45–115 mm TL, 0 = 73.0 mm; range 3.2–34.7 g TW, 0 = 12.9 g) captured in pelagic Sargassum algae off coastal Mississippi in mid-July 1999 were reared in a recirculating seawater system for 210 days. Fish were maintained on a natural light-dark cycle and fed to satiation 3 times per day. Water temperature ranged from 25.2° to 29.0° C and salinity was 28.0‰. All fish were measured for length and weight on days 1, 60, 135 and 210 of the study. Between these dates, mean daily TL growth rates were 2.2 …

Although color pattern can vary among and within species of the Crustacea, it can also be a conservative feature that can be very helpful in field identifications. This is often the case in the Crustacea Decapoda, where sibling species can be detected by subtle differences in color (e.g., Williams and Felder 1989, Zimmerman and Felder 1991, Knowlton and Mills 1992). Stomatopods are among the most colorful crustaceans when living. Factors Mediating Cheatgrass Invasion Of Intact Salt Desert Shrubland, Susan E. Meyer, Susan Garvin, Julie Beckstead

Cheatgrass (Bromus tectorum) has recently displaced salt desert shrubland in many areas of the Great Basin. We studied the dynamics of cheatgrass invasion into an intact shadscale-gray molly community in Dugway Valley, Utah, by adding seeds and manipulating disturbance regime and resource availability. Shrub clipping or cryptobiotic crust trampling on large plots increased cheatgrass recruitment and biomass production slightly in a favorable moisture year (1997 to 1998), whereas in a less favorable moisture year (1998 to 1999) these disturbance treatments had a significant negative effect.
