Ranked Set Sampling From Location-Scale Families Of Symmetric Distributions, Ram C. Tiwari, Paul H. Kvam

Statistical inference based on ranked set sampling has primarily been motivated by nonparametric problems. However, the sampling procedure can provide an improved estimator of the population mean when the population is partially known. In this article, we consider estimation of the population mean and variance for the location-scale families of distributions. We derive and compare different unbiased estimators of these parameters based on independent replications of a ranked set sample of size n. Large sample properties, along with asymptotic relative efficiencies, help identify which estimators are best suited for different location-scale distributions.

Constitutional Formalism And The Meaning Of Apprendi V. New Jersey, Benjamin Priester

In June 2000, the United States Supreme Court decided Apprendi v. New Jersey,' a case that likely will have a significant impact on the administration of criminal justice in federal and state courts. The Court imposed a procedural limitation on prosecutors by restricting the types of facts that may be proven at sentencing rather than at trial. Specifically, the Court adopted a constitutional principle that "any fact that increases the penalty for a crime beyond the prescribed statutory maximum" is an element of the offense of conviction. Part I of this Article examines the historical and conceptual foundations of the specific intent standard as applied both outside and within the environmental law context. Part II addresses the historical and conceptual foundations of the general intent standard, also outside and within the environmental law context. Part III reviews the history of the conflict between application of the specific intent and general intent standards in prosecutions for knowing violations of the Clean Water Act. This Article analyzes the view that to be taken seriously as an athlete, women must replicate the behaviors prevalent in male-dominated sports. The Article focuses on sports in the educational context as an important opportunity for legal intervention. Because the law involves the allocation of resources and the policing of behavior by the government, this discussion prompts us to ask how resources should be allocated and what kinds of behavior should be encouraged and discouraged in promoting gender equity. This Article seeks to examine the preparedness of certain African regional actors to protect displaced persons in times of armed conflict, and to prescribe formulas to strengthen the capabilities of such actors. The objective is to assess the conflict maintenance capacities of African regional actors and their partners to provide physical and legal protection to displaced persons in times of armed conflict, and likewise to recommend strategies to increase protection.

"This Great Modern Abomination": Orthodoxy And Heresy In American Religion, Terryl Givens

In chapter 4, Terryl Givens provides a new view not only of the Christianity of Mormons but also more specifically of the religious motivations and methods for persecuting LDS people in nineteenth-century America. Givens's chapter is especially important as an examination of one of the worst examples of systematic religious intolerance in American history. According to Givens, for Americans' self-conception as a religiously tolerant nation to remain intact, a hegemonic rhetoric needed to emerge in the public sphere that denied the religious nature of Mormonism and instead described it as a political threat or social evil. "Hair Drama" On The Cover Of "Vibe" Magazine, Bertram D. Ashe

This study consists of a cultural reading of the cover photograph of the June-July 1999 issue of Vibe magazine. It explores the relationship between Mase, an African-American male rap star, and the three anonymous African-American female models that surround him. The study interprets the cover through the long, straightened hair of the models, locating the models' hair in a historically-informed context of black hair theory and practice. The study argues that the models' presence on the cover, particularly their "bone straight and long" hair, "enhances" Mase in much the same way breast-augmented "trophy women" "enhance" their mates. “You know the horror of buying clothes” (L2 232), wrote Virginia Woolf to her sister in 1918. This statement takes us to the heart of early critical assumptions about Woolf and consumerism. Following good modernist principles, the argument ran, Woolf’s art was naturally above shopping, distinct from and even a reaction against consumer culture. More recently, critics such as Jennifer Wicke, Rachel Bowlby, and Reginald Abbott have unsettled this separation and have started to consider the complex relations among consumption, the market, and Woolf’s writing. Adam Smith was trying to counter medieval church theology, which held that any self-interested behavior was sinful and detrimental. Smith countered that self-interest could yield valuable outcomes for society as people pursued specialization and market trade. Much later these quotes would be used to justify the greedy and grasping personae of homo economicus, illustrating how a little Adam Smith can prove to be a dangerous thing. For example, Max Lerner in 1937 would say that Adam Smith "sanctified predatory impulses" and "gave a new dignity to greed." By the 1980s the movie Wall Street has the financial tycoon Gordon …
