Provocateurs For Justice, Jane H. Aiken

Clinical legal education offers unique opportunities to inspire law students to commit to justice. Merely providing a justice experience is not enough. We must provoke a desire to do justice in our students. As provocateurs, we determine where our students are in the developmental process toward "justice readiness." This article outlines those developmental stages and suggests interventions to assist students in their transition from stage to stage. Being "justice ready" requires sensitivity to the ways in which assumptions color all aspects of our cases. The article closes with suggestions and examples of how to critically reflect on assumptions that hinder …

Signs are prominent elements of the urban landscape; they display messages to the public, orient people in complex environments, act as social landmarks, and serve as a means of cultural expression. Despite the omnipresence of signs, designers have yet to capitalize on their potential urban spaces as creative design tools for enhancing a sense of place. Using literature and urban case studies, this thesis explores several quantitative methods to learn about effects produced by signs in the urban landscape. The use of resorcinarenes in the study of biologically significant phenomena has been the focus of much attention, due to the versatility of these macrocyclic compounds. In this thesis, two applications of resorcinarenes are explored. First, the search for the mechanism by which tetraarylboronic acid resorcinarenes lead to colorimetric detection and quantization of saccharide analyte concentration in solution is described. Second, the extension of the lower rim conjugation of the resorcinarene macrocycle by the fourfold addition of various length oligo(p-phenylene) rods is discussed. To date, most research on the ecology of Hawaiian stream fishes has taken place in the middle and upper reaches of streams. In the terminal reaches of streams in Hawaii, the ecological aspects of the relatively more diverse fish assemblages are largely unknown. This study investigated patterns of microhabitat use in an assemblage of native and introduced stream fishes living in the terminal reach of Wailoa Stream on the Island of Hawaii. Multivariate and univariate analyses of microhabitat data collected through underwater visual surveys indicated that differences in microhabitat preferences were an important factor in the structure of this assemblage. …

The Effect Of Diet/Supplement Intake And Competitive Swimming/Gymnastics Upon The Bone Mineral Density Of Collegiate Females, Teresa Christine Jones

The purpose of this pilot study was to determine if there was a relationship between dietary/supplemental intake and competitive activity (swimming and gymnastics), on the bone mineral density of 18-21 year old females. Five swimmers, 4 gymnasts, and 12 control subjects were recruited from the university student body. All subjects completed a 3-day diet/supplement record, 3-day activity record, past calcium intake form, and a medical history form. Bone mineral density (BMD) was measured for the whole body, L1-L4, the proximal femur and body composition by DEXA. Results indicated the control subjects reported a significantly greater percent of the RDA for …

This case study examined a peer-evaluation program at The Advocate newspaper in Baton Rouge, Louisiana, in which employees took turns serving on committees that critiqued each day’s coverage. Their critique reports, containing both negative and positive comments on all elements of the news pages, were distributed to each employee of the news department. The purpose of the study was to examine the content of the critique reports and to determine whether the participants and the editors thought the program improved the newspaper, whether they wanted to continue it and what changes might improve it. The markets facing nursery producers have changed dramatically in the past decade. These changes in nursery markets have outdated previous research. New research into nursery marketing will assist nursery producers in making marketing decisions. Nursery producers can market their plants to five different marketing channels: Mass-merchandisers, garden centers, other retailers, landscapers and re-wholesalers. This study described the 1998 Louisiana nursery industry, analyzed nursery market changes over the past decade in Louisiana and the Southeast and analyzed characteristics of Louisiana and Southeastern nurseries to estimate marketing channel choice. In Cook v Gralike, the Court - unanimous as to result - struck down a Missouri initiative amending the state constitution to require that the failure of candidates for U.S. Congress to support a particular term-limits amendment to the United States Constitution be noted on the ballot. In an opinion joined by seven Justices, the Court held that the Missouri law exceeded the scope of states' powers to regulate the "time, place and manner" of holding congressional elections . . . This work focused on the regulation of the different isotypes of beta-tubulin during cardiac hypertrophy, with the specific hypothesis that increased levels of the beta I isotype leads to the increase in microtubule density seen during hypertrophy. Partial cDNAs for the three beta-tubulin isotypes expressed in the heart (I, II, and IV) have been cloned and used to show that there is a differential upregulation of the beta I and beta II isotypes during cardiac hypertrophy. Messenger RNA half-life studies of cells isolated from hypertrophied myocardium have shown that this upregulation is due to increased transcription of the genes encoding …

Despite the persistence of the question, social science literature is replete with reasons why a victim does not or cannot leave a battering relationship. Commonly cited explanations include lack of financial resources; fear of physical retribution; lack of access to information about options for escape; enduring love for the batterer and belief he will change; learned helplessness; and depression. This Article, however, focuses on a pervasive and previously unexamined reason: the victim's fear that the batterer will publicize truthful confidential information that will hurt her. If the victim were to seek the court's protection, most state courts have the authority …

The debate over human embryonic stem cell research-scientific and clinical prospects as well as ethical implications-became front-page news only after two teams of university researchers reported in November 1998 that they had isolated and cultured human pluripotent stem cells. The discovery caused a flurry of excitement among patients and researchers and drew attention from President Clinton, who instructed the National Bioethics Advisory Commission (NBAC) to "conduct a thorough review of the issues associated with. .. human stem cell research, balancing all medical and ethical issues.”

In a recent article published in this journal, Jon Dubrow examines the acquisitions of passive minority equity interests. The focus of his article is the treatment of these transactions by the courts and the federal antitrust agencies, including their treatment of the investment-only exemption from Section 7 of the Clayton Act. One section of the article discusses the economic foundation for the competitive effects analysis of these acquisitions, focusing mainly on our article recently published in this journal. It is natural - I suppose it is expected - for every Solicitor General to hold forth at some point during his tenure with pearls of wisdom on the Twelve Secrets, or Ten Commandments, or Five Essential Rules of effective oral advocacy. I have always been reluctant to do that . . . reluctantly, after years of resistance, I too will unburden myself of a few principles. First, though, I would like to reach back in history for some inspiration by reflecting a bit on Daniel Webster.

In this Article we offer one small idea with potentially large implications. We propose the recognition arid development of a special tort for toxic exposures, where the exposures have not yet led to a physical illness such as cancer. We argue, in brief, that this new tort would, in one simple step, accomplish three things: it would address many of the problems with the courts' current handling of toxic torts; it would consolidate the many overlapping causes of action now pressed in toxic tort cases into one single claim; and it would give expression to the real injury motivating these …

I argue that while our criminal justice system is explicitly based on the premise and promise of equality before the law, the administration of criminal law—whether by the officer on the beat, the legislature, or the Supreme Court—is in fact predicated on the exploitation of inequality. My claim is not simply that we have ignored inequality’s effects within the criminal justice system, nor that we have tried but failed to achieve equality there. Rather, I contend that our criminal justice system affirmatively depends on inequality. Absent race and class disparities, the privileged among us could not enjoy as much constitutional …

It is an enormous delight for me to contribute to this dedication ceremony honoring Norman Dorsen. It did require, however, that I go back and note the fact that I wrote for the Annual Survey thirty-seven years ago. Not only did I discuss antitrust, I made some confident predictions. I noted with alarm that there had been five hundred corporate mergers in the previous year, but pointed out that that would level off as time went on. Despite the gradual move towards integration in the United States, segregated communities, divided along socio-economic and racial lines, continue to exist, and indeed have taken on new forms. Given the choice between racial segregation and integration as minority members of a community, some middle-class African Americans have chosen to create their own communities, thus forming the modern day middle-class black suburb. Now, majority African-American suburbs rest adjacent to majority-white suburbs, but the segregated communities share little but the town line.

Harvard Professors David Rosenberg and Charles Fried have presented a provocative, sweeping critique of the theoretical foundations of tort liability that leaves virtually no aspect of our current tort system untouched, or perhaps more accurately, unscathed. Their article throws down the gauntlet to defenders of traditional tort law. For instance, Rosenberg and Fried take aim at the jury system, arguing that ex post liability rules created by juries are inefficient and should be replaced, whenever possible, by ex ante liability rules set by legislative bodies. And they attack the idea that compensation plays a legitimate role in structuring our tort …
