Changes In The Ticket Distribution Industry: Is This The Beginning Of The End For Ticketmaster?, Joycelyn Stevenson Jan 2001

Changes In The Ticket Distribution Industry: Is This The Beginning Of The End For Ticketmaster?, Joycelyn Stevenson

Vanderbilt Journal of Entertainment & Technology Law

This Note aims to explore the legal underpinnings of consumer frustration with Ticketmaster and the rest of the ticket distribution industry as it moves into the electronic age. First, this Note introduces Ticketmaster and examines its use of exclusive dealing agreements with local venues. It then discusses the relevant federal antitrust statutes affecting the industry and the market in which distributors operate. It also analyzes the role exclusive dealing agreements play in stifling competition. Next, this Note discusses the challenges--both legal and economic--to the industry's most visible member. It then discusses Ticketmaster as a possible product of competition in light …

The Recording Artist Agreement: Does It Empower Or Enslave, Lynn Morrow Jan 2001

The Recording Artist Agreement: Does It Empower Or Enslave, Lynn Morrow

Vanderbilt Journal of Entertainment & Technology Law

In June 2000, Courtney Love, the controversial lead singer of the rock group Hole, lambasts, among other things, record company profits. In an essay entitled "Courtney Love Does the Math," she maintains that a recording artist agreement is itself a form of music piracy. She tells a compelling story about a band and a record company. As a result of a bidding war between the major labels, the band was given what is considered a huge deal-a twenty percent artist royalty and a million dollar advance. Providing a breakdown of how the million dollars was spent, Ms. Love calculates that, …

For Entertainment Purposes Or Ad Majorem Dei Gloriam: Televangelism In The Marketplace Of Ideas, Juan G. Villasenor Jan 2001

For Entertainment Purposes Or Ad Majorem Dei Gloriam: Televangelism In The Marketplace Of Ideas, Juan G. Villasenor

Vanderbilt Journal of Entertainment & Technology Law

This Note discusses the proposed legal responses to the problem of fraud by televangelists. Finding the solutions constitutionally deficient, politically unsound, or practically ineffective as deterrents, it then explores the possibility of a content-based restriction on televangelists' speech. The Note concludes that such a deliberate restriction on speech cannot withstand First Amendment scrutiny, regardless of the dishonesty or disingenuousness one may find in televangelists' tactics. Accordingly, despite the great potential for deception, televangelists' activities are, and should be, absolutely protected by the First Amendment. Any proposed remedy to deal with televangelism must occur in the marketplace of ideas, which is …

Development Of Equilibrium After Preheating, Gary Felder, Lev Kofman Jan 2001

Development Of Equilibrium After Preheating, Gary Felder, Lev Kofman

Physics: Faculty Publications

We present a fully nonlinear study of the development of equilibrium after preheating. Preheating is the exponentially rapid transfer of energy from the nearly homogeneous inflaton field to fluctuations of other fields and/or the inflaton itself. This rapid transfer leaves these fields in a highly nonthermal state with energy concentrated in infrared modes. We have performed lattice simulations of the evolution of interacting scalar fields during and after preheating for a variety of inflationary models. We have formulated a set of generic rules that govern the thermalization process in all of these models. Notably, we see that once one of …

Life On The Edge: Community And Trade On The Anglo -American Periphery, Pemaquid, Maine, 1610--1689, Neill De Paoli Jan 2001

Life On The Edge: Community And Trade On The Anglo -American Periphery, Pemaquid, Maine, 1610--1689, Neill De Paoli

Doctoral Dissertations

Seventeenth-century New England's northern frontier has been an important but poorly understood place of contact between a diverse array of English, French, and Indian actors who traded, socialized, and fought with one another over land, commercial and political alliances. The English fishing settlement of Pemaquid was a key player in this world. Pemaquid emerged as one of New England's earliest year-round settlements after its beginning as a migratory fishing station in the early 1610s. In those early years, Pemaquid benefited and paid for its strategic position on the northern edge of New England. It was situated in a region that …

Development Of Amperometric Enzyme Electrodes For Glucose And Hypoxanthine., Eilish Broderick Jan 2001

Development Of Amperometric Enzyme Electrodes For Glucose And Hypoxanthine., Eilish Broderick

Theses

This thesis is concerned with the immobilisation of enzymes on electrosynthesised poly (o- phenylenediamine) membranes for use on amperometric electrodes. The thesis opens with a discussion of the basic principles of enzymology and a review of a diverse range of biosensors, followed by a consideration of amperometry as governed by the Cottrell equation.

Glucose oxidase and horseradish peroxidase were co-immobilised in poly (o-phenylenediamine) on platinum electrodes at + 0.6 V versus Ag/AgCl. Using this approach the enzymes are entrapped in a strongly adherent, highly reproducible thin membrane, of thickness approximately 10 nm. This one-step procedure produces a glucose sensor with …

Design And Implementation Of An Intranet-Solution Especially With Workflow Aspects, Robert Loew Jan 2001

Design And Implementation Of An Intranet-Solution Especially With Workflow Aspects, Robert Loew

Theses

An Intranet support a new or simply an easier information system for all the workers within a company using internet technology. On the one hand, employees can use Web technology and very simple tools to provide and navigate information. On the other hand, the costly and time-consuming business of installing and maintaining software on local PCs can be avoided by using Browser-based Intranet applications. Ideally, it would be possible to access all forms of information processing using one and the same Web browser. This is the aim of the Intranet Project upon which this thesis is based.

Various technologies for …

An Evaluation Of Fás's Excellence Through People Award, Antoinette Hogan Jan 2001

An Evaluation Of Fás's Excellence Through People Award, Antoinette Hogan

Theses

In 1997 FAS introduced the Excellence Through People Award, a human resource based quality standard. The main objective was to increase the level, relevance and quality of training being conducted in Ireland. It had become apparent that it was no longer sufficient to offer customers low cost products to try to gain advantage over competitors. Customers were becoming more sophisticated, with more disposable income. Also, technological developments were constantly shortening product lifecycles. Thus, what companies required was for their employees to know in real time what their customers value and to know how to provide it for them. It has …

Does The Individuals With Disabilities Education Act Exclude Gifted And Talented Children With Emotional Disabilities - An Analysis Of J.D. V. Pawlet., Laura Ketterman Jan 2001

Does The Individuals With Disabilities Education Act Exclude Gifted And Talented Children With Emotional Disabilities - An Analysis Of J.D. V. Pawlet., Laura Ketterman

St. Mary's Law Journal

Disabled children benefit from federal legislation which guarantees a free, appropriate education. While no federal mandate requires providing special education for gifted and talented children, the government encourages schools to offer gifted and talented programs. Gifted and talented children with emotional disabilities, however, often fall between these two groups and do not qualify for special education under any legislation. Unfortunately, in many gifted and talented children with disabilities the gift hides the disability—or the disability hides the gift. To compound the problem, legislation and recent court decisions fail to recognize that gifted and talented children have unique needs which should …

Trust, Trustworthiness, And The Behavioral Foundations Of Corporate Law, Margaret M. Blair, Lynn A. Stout Jan 2001

Trust, Trustworthiness, And The Behavioral Foundations Of Corporate Law, Margaret M. Blair, Lynn A. Stout

Cornell Law Faculty Publications

Conventional legal and economic analysis assumes that opportunistic behavior is discouraged and that cooperation is encouraged within firms primarily through the use of legal and market incentives. This presumption is embedded in the modern view that the corporation is best described as a "nexus of contracts, " a collection of explicit and implicit agreements voluntarily negotiated among the rationally selfish parties who join in the corporate enterprise. In this Article we take a different approach. We start from the observation that, in many circumstances, legal and market sanctions provide, at best, imperfect means of regulating behavior within the firm. We …

Director Accountability And The Mediating Role Of The Corporate Board, Margaret M. Blair, Lynn A. Stout Jan 2001

Director Accountability And The Mediating Role Of The Corporate Board, Margaret M. Blair, Lynn A. Stout

Cornell Law Faculty Publications

One of the most pressing questions facing both corporate scholars and businesspeople today is how corporate directors can be made accountable. Before addressing this issue, however, it seems important to consider two antecedent questions: To whom should directors be accountable? And for what?

Contemporary corporate scholarship often starts from a "shareholder primacy" perspective that holds that directors of public corporations ought to be accountable only to the shareholders, and ought to be accountable only for maximizing the value of the shareholders' shares. This perspective rests on the conventional contractarian assumption that the shareholders are the sole residual claimants and …

A Policy Makers Guide To Systemwide Assessment Programs, Margaret Forster Jan 2001

A Policy Makers Guide To Systemwide Assessment Programs, Margaret Forster

Policy maker's guides

This guide provides policy makers with research-based information about systemwide assessment programs. Good decision making at all levels of an education system is facilitated by easily accessible, relevant, and reliable information. Many indicators provide useful input to educational decision making; but the most important indicators are those which address the central concern of education: the promotion of student learning. Education systems monitor student learning—with the fundamental intention of promoting learning—by collecting, analysing and reporting student achievement data. Given that state, national and international achievement studies are both time consuming and expensive, it seems prudent to reflect on this effort: What …

Free Speech For Lawyers, W. Bradley Wendel Jan 2001

Free Speech For Lawyers, W. Bradley Wendel

Cornell Law Faculty Publications

One of the most important unanswered questions in legal ethics is how the constitutional guarantee of freedom of expression ought to apply to the speech of attorneys acting in their official capacity. The Supreme Court has addressed numerous First Amendment issues involving lawyers, of course, but in all of them has declined to consider directly the central conceptual issue of whether lawyers possess diminished free expression rights, as compared with ordinary, non-lawyer citizens.

The arguments of this Article are synthetic in structure. I do not aim just to criticize reported cases, but rather to show how the regulation of lawyers' …

Dispute Resolution In The Boundaryless Workplace, Katherine V.W. Stone Jan 2001

Dispute Resolution In The Boundaryless Workplace, Katherine V.W. Stone

Cornell Law Faculty Publications

Since the Supreme Court's decision Gilmer v. Interstate/Johnson Lane Corp. which compelled an employee to submit his age discrimination claim to arbitration under the Federal Arbitration Act (FAA), there has been a dramatic increase in the number of nonunion firms adopting arbitration systems. At the same time, there has been a flood of lawsuits challenging these employment systems, and a corresponding avalanche of judicial opinions addressing the legal issues left open in Gilmer – issues such as the problematic nature of consent in employment arbitration, the deficiencies in due process, and the applicability of the FAA to employment contracts. These …
