The Relationship Between Income And The Ability To Follow The Prescribed Medication Plan In Elderly Persons With Heart Failure, Lori Houghton-Rahrig Jan 2001

The Relationship Between Income And The Ability To Follow The Prescribed Medication Plan In Elderly Persons With Heart Failure, Lori Houghton-Rahrig

Masters Theses

The purpose of this study was to determine if there was a relationship between income, and obtaining and taking of medications as prescribed. The conceptual framework used for this study was Madeleine Leininger's cultural care diversity and universality theory. This secondary analysis used the initial data from the primary study. “ Home Care Outcomes for Heart Failure: A Test of Two Nursing Approaches" (Kline, 1999). A convenience sample of 70 home care clients with heart failure were interviewed using a Likert scale format. A non-parametric correlation using Spearman’s rho depicted a weak relationship between annual income and taking the medication …

The Effect Of Supportive-Educative Nursing Interventions On The Hospital Readmission Rates Of Patients With Heart Failure, Patrice M. Whitaker Jan 2001

The Effect Of Supportive-Educative Nursing Interventions On The Hospital Readmission Rates Of Patients With Heart Failure, Patrice M. Whitaker

Masters Theses

The prevalence of heart failure (HF) is increasing and patients with HF are frequently readmitted to hospitals soon after discharge, at great cost. Improving self-care and reducing hospitalizations in this group is vital. This study, based on Dorothea Orem’s ( 1995) self-care deficit theory, evaluated supportive-educative vs. placebo nursing interventions. The study results were drawn from a larger longitudinal study done by Dr. Kay Setter-Kline, Ph.D., R.N.

The study sought to determine if supportive-educative nursing interventions reduced the rehospitalization rate for patients with HF. The Self-Management Tool was utilized for data collection, after being adapted from the Chronic Disease Self-Management …

The Effects Of Mentoring On Staff Nurses' Job Satisfaction, Karen Delrue Jan 2001

The Effects Of Mentoring On Staff Nurses' Job Satisfaction, Karen Delrue

Masters Theses

The shortage of registered nurses in the nation’s healthcare organizations calls for an exploration of avenues that can impact recruitment and retention. The practice of mentoring has demonstrated a positive impact on job satisfaction in previous studies. The purpose of this study was to determine if RNs would identify having mentors in their professional careers and to examine differences in levels of job satisfaction compared to those without a mentor. This study also explored whether or not the perceived quality of the mentor affected job satisfaction. Data were collected through the use of standardized questionnaires from a probability sample of …

Standardized Group Achievement Tests And The Accommodation Of Additional Time, Kevin Lance Buehler Jan 2001

Standardized Group Achievement Tests And The Accommodation Of Additional Time, Kevin Lance Buehler

All-Inclusive List of Electronic Theses and Dissertations

Statewide assessment test data are increasingly being used to make important decisions for students and teachers. Since the re-authorization of the Individuals with Disabilities Act (PL 105-17) in 1997, states are mandated to include students with disabilities in state and district assessment programs, using appropriate accommodations. Research on the value of specific accommodations, and on the effects of accommodations on test data, though, is scarce. Studies conducted on the accommodation of additional time have not consistently found that students with disabilities obtain greater benefit from this accommodation than students without disabilities. In addition, school personnel have few objective methods to …

Introduction To Torture As Tort: From Sudan To Canada To Somalia, Craig M. Scott Jan 2001

Introduction To Torture As Tort: From Sudan To Canada To Somalia, Craig M. Scott

Articles & Book Chapters

The present work is chapter 1 of the edited volume, Torture as Tort: Comparative Perspectives on the Development of Transnational Human Rights Litigation (Hart Publishing, Oxford, 2001). At the time the book was generated, the controversial nature of seeking globalised justice through national courts had become starkly apparent in the wake of the Pinochet case in which the Spanish legal system sought extradition of the former President of Chile from the United Kingdom in order to bring him to account under Spanish criminal law for a variety of alleged violations in Chile of human rights, most notably involving torture. Yet, …

Entropy Generation Method To Quantify Thermal Comfort, S. C. Boregowda, S. N. Tiwari, S. K. Chaturvedi Jan 2001

Entropy Generation Method To Quantify Thermal Comfort, S. C. Boregowda, S. N. Tiwari, S. K. Chaturvedi

Mechanical & Aerospace Engineering Faculty Publications

The present paper presents a thermodynamic approach to assess the quality of human-thermal environment interaction and quantify thermal comfort. The approach involves development of entropy generation term by applying second law of thermodynamics to the combined human-environment system. The entropy generation term combines both human thermal physiological responses and thermal environmental variables to provide an objective measure of thermal comfort. The original concepts and definitions form the basis for establishing the mathematical relationship between thermal comfort and entropy generation term. As a result of logic and deterministic approach, an Objective Thermal Comfort Index (OTCI) is defined and established as a …

Judgment Proofing The Profession, Poonam Puri Jan 2001

Judgment Proofing The Profession, Poonam Puri

Articles & Book Chapters

In the law of business organizations, individuals have generally been unrestrained in choosing which legal form they will use to carry on productive endeavors. Professionals, however, have not been afforded such freedom. They have found themselves prohibited by their self-regulatory bodies from practicing their profession in a corporate form. As a result, members of professions have practiced either as sole practitioners or in partnership with other members of the same profession. Professionals practicing in partnership expose themselves to personal liability for the obligations of the partnership and wrongdoing by their partners. This Article analyzes the rise of limited liability partnerships …

Aboriginal Rights In Transition: Reassessing Aboriginal Title And Governance, Kent Mcneil Jan 2001

Aboriginal Rights In Transition: Reassessing Aboriginal Title And Governance, Kent Mcneil

Articles & Book Chapters

In a series of important decisions, the Court has come to grips with a number of issues that it did its best to avoid in the past, involving the identification and definition of Aboriginal rights, the content of Aboriginal title to land and the requirements for proving it, and the relevance of the law of New France to Aboriginal rights today. This paper will focus on these recent developments in the law, as well as attempting to identify areas where the law of Aboriginal rights is incomplete and so requires further judicial elucidation.

Hierarchical Classification And The Integration Of Self-Structure In Late Adolescence, Eric B. Elbogen, Gustavo Carlo, William D. Spaulding Jan 2001

Hierarchical Classification And The Integration Of Self-Structure In Late Adolescence, Eric B. Elbogen, Gustavo Carlo, William D. Spaulding

Department of Psychology: Faculty Publications

A number of empirical studies have demonstrated that one’s self-concept is multidimensional in nature, varies according to social context, and shows increased differentiation throughout adolescence. There has been relatively less work, however, examining the integration of multi-dimensional social selves. Rosenberg and Gara’s (1985) model of the multidimensional self (a model that utilizes a statistical procedure called “hierarchical classification” or HICLAS) was employed to investigate the integration of social selves during late adolescence. First- and fourth-year college students (n = 128) completed a computer program designed to collect data required to construct HICLAS “self-structures.” The findings indicated that the social selves …

Gendering The Pension Promise In Canada: Risk, Financial Markets And Neoliberalism, Mary Condon Jan 2001

Gendering The Pension Promise In Canada: Risk, Financial Markets And Neoliberalism, Mary Condon

Articles & Book Chapters

This article argues that retirement income provision in Canada is built on gendered assumptions, which produce material disadvantage for women. These inequalities are being exacerbated by current neoliberal trends towards the 'marketization' and individualization of pension provision, supported by tax, securities and corporate legal norms. The argument is developed using recent legislative changes to the operation of the Canada Pension Plan and recent developments in the regulation of mutual funds in Ontario as case studies. The article concludes by sketching out some possible points of departure for feminist interventions in pension privatization debates.

The Rights Of The Adolescent: The Mature Minor, Roxanne Mykitiuk, Victoria J. Davis Jan 2001

The Rights Of The Adolescent: The Mature Minor, Roxanne Mykitiuk, Victoria J. Davis

Articles & Book Chapters

Health care providers who treat adolescents may also be required to diagnose and treat the reproductive health conditions of minor patients and to facilitate health prevention measures, including contraception and testing for sexually transmitted diseases. Teens who do not want their parents to know about their sexual behaviour may consult a health care provider for reproductive or sexual health care services and treatment without parental knowledge or consent. This may present legal and ethical dilemmas for health care providers. Common law recognizes that adolescents under the legal age of majority who are sufficiently mature (the mature minor) may have the …

Taking Stock Of Taking Stock, Poonam Puri Jan 2001

Taking Stock Of Taking Stock, Poonam Puri

Articles & Book Chapters

Silicon Valley law firms were among the first to experiment with taking stock in their technology start-up clients. They were followed by law firms in other financial centers in the United States and Canada, as well as more conservative law firms in England and the rest of Europe. This Article critically analyzes the practice of lawyers taking equity in their clients as compensation for legal services. First, it explains that equity billing can provide significant private benefits to law firms and clients, and can also provide indirect public benefits. Second, it argues that equity billing can be usefully analogized to …

Vireo Song Repertoires And Migratory Distance: Three Sexual Selection Hypotheses Fail To Explain The Correlation, D. James Mountjoy, Daniel Leger Jan 2001

Vireo Song Repertoires And Migratory Distance: Three Sexual Selection Hypotheses Fail To Explain The Correlation, D. James Mountjoy, Daniel Leger

Department of Psychology: Faculty Publications

Previous studies have found a relationship between migration and the degree of elaboration of sexually selected traits, but investigators have differed in the mechanisms they proposed to account for this association. We examined the relationship between song repertoire size and distance migrated among birds in the genus Vireo. There is a strong positive relationship between migratory distance and repertoire size in this genus, but our data do not support the specific predictions of any of the three proposed mechanisms (the “rapid pairing,” “good migrations,” and “territory lottery” hypotheses). Migration distance is presumably correlated with other life-history characteristics that influence the …

Interpreting Intervention, Craig Scott Jan 2001

Interpreting Intervention, Craig Scott

Articles & Book Chapters

The present article, written in May 2001, discusses the significance for the doctrine of humanitarian intervention of the normative signaling practices that transpired throughout the 1990s with respect to the use of military force outside of explicit authorization by UN Security Council resolutions. The first part of the article analyses the sociological and legal-theoretical dimensions of the relationship between interpretation of Security Council resolutions and the interpretive evolution of the UN Charter. Iraq and Kosovo then provide the focus for contextualizing the analysis. The article ends with an account of the interplay of the powers of the General Assembly and …

In The Name Of The International: The Supreme Court Of Canada And The Internationalist Transformation Of Canadian Private International Law, Robert Wai Jan 2001

In The Name Of The International: The Supreme Court Of Canada And The Internationalist Transformation Of Canadian Private International Law, Robert Wai

Articles & Book Chapters

Globalization and internationalization are pervasive in contemporary cultural, political, and economic policy discourses. Not surprisingly, a concern with internationalization and globalization increasingly characterizes the policy discourses of law. While the law often operates at a lag to broader social trends, it is sometimes more active in constituting such trends. This article is concerned with a striking episode of legal change oriented towards the perceived new realities of the international system, which occurred in the unlikely venue of private international law in Canada.

The Internet In Light Of Traditional Public And Private International Law Principles And Rules Applied In Canada, Jean-Gabriel Castel Jan 2001

The Internet In Light Of Traditional Public And Private International Law Principles And Rules Applied In Canada, Jean-Gabriel Castel

Articles & Book Chapters

In general, the jurisdiction of a state to prescribe, to adjudicate, and to enforce' is related to physical location. Yet, physical location is foreign to the Internet, which can be defined as the electronic medium of worldwide computer networks within which online communication takes place. The absence of physical location calls into question the applicability of the traditional public and private international law principles and rules that are based primarily on territoriality, in order to delineate the jurisdiction of states and their courts over the Internet and its users.

What Is Marriage-Like Like? The Irrelevance Of Conjugality, Brenda Cossman, Bruce Ryder Jan 2001

What Is Marriage-Like Like? The Irrelevance Of Conjugality, Brenda Cossman, Bruce Ryder

Articles & Book Chapters

While the notion of conjugal or marriage-like has become legally ubiquitous in the regulation of non-marital cohabitation in Canada, its meaning remains elusive. A review of the case law and of spousal definitions in income security schemes reveals that the presence or absence of a sexual component to a relationship has become immaterial to, or of declining relevance in, the determination of conjugality. As a result, legal decision-makers have had to grapple with the increasing instability of the distinction between conjugal and non-conjugal relationships. The question of whether a relationship has a sexual component bears no relation to legitimate state …

The Importance Of Being Related: How The Nuclear Family Functioned Within The Urban Environment Of Medieval Norwich 1250-1348, Anne Grant Jan 2001

The Importance Of Being Related: How The Nuclear Family Functioned Within The Urban Environment Of Medieval Norwich 1250-1348, Anne Grant

All Theses

Did medieval families function on a nuclear or an extended level? This thesis will show that the families in urban Norwich, England in the Middle Ages worked, loved and played within strong nuclear families instead of floundering in a sea of extended relatives and neighbors. Using two books of deeds from the city of Norwich as well as the police records and other assorted information from the city, this paper will prove that nuclear family relationships, with their economic and social bonds, were of primary importance to the functionality of the conjugal family and that much less focus was centered …

The Property/Contract Interface, Thomas W. Merrill, Henry E. Smith Jan 2001

The Property/Contract Interface, Thomas W. Merrill, Henry E. Smith

Faculty Scholarship

This Article explores the distinction between in personam contract rights and in rem property rights. It presents a functional explanation for why the legal system utilizes these two modalities of rights, grounded in the pattern of information costs associated with each modality. To test this theory, the Article examines four legal institutions that fall along the property/contract interface – bailments, landlord-tenant law, security interests, and trusts – in order to determine how the legal doctrine varies as the underlying situation shifts from in personam, to in rem, to certain relations intermediate between these poles. With respect to each institution, we …

Theorizing Yes: An Essay On Feminism, Law, And Desire, Katherine M. Franke Jan 2001

Theorizing Yes: An Essay On Feminism, Law, And Desire, Katherine M. Franke

Faculty Scholarship

In this Essay, Professor Franke observes that, unlike feminists from other disciplines, feminist legal theorists have neglected to formulate a positive theory of female sexuality. Instead, discussions of female sexuality have been framed as either a matter of dependency or danger. Professor Franke begins her challenge to this scheme by asking why legal feminism has accepted unquestionably the fact that most women reproduce in their lifetimes. Why have not social forces that incentivize motherhood – a dynamic she terms repronormativity – been exposed to as exacting a feminist critique as have heteronormative forces that normalize heterosexuality? Furthermore, she continues by …

Litigation Governance: A Gentle Critique Of The Third Circuit Task Force Report, John C. Coffee Jr. Jan 2001

Litigation Governance: A Gentle Critique Of The Third Circuit Task Force Report, John C. Coffee Jr.

Faculty Scholarship

The Third Circuit Task Force on the Selection of Class Counsel (the "Task Force") has worked hard, considered everything, and exhaustively summarized the problems associated with class counsel auctions. Its views will undoubtedly resonate with most of the Bench and the vast majority of the Bar-neither of whom were enthusiastic about the prospect of auctions in the first place. Personally, I agree with the Task Force that auctions are not the most promising reform and that they may exacerbate, rather than correct, existing problems. Still, what is missing from the Task Force Report is the candid recognition that the agency …

Processing Algorithms For Tracking Speckle Shifts In Optical Elastography Of Biological Tissues, Donald D. Duncan, Sean J. Kirkpatrick Jan 2001

Processing Algorithms For Tracking Speckle Shifts In Optical Elastography Of Biological Tissues, Donald D. Duncan, Sean J. Kirkpatrick

Electrical and Computer Engineering Faculty Publications and Presentations

Parametric and nonparametric data processing schemes for analyzing translating laser speckle data used to investigate the mechanical behavior of biological tissues are examined. Crosscorrelation, minimum mean square estimator, maximum likelihood, and maximum entropy approaches are discussed and compared on speckle data derived from cortical bone samples undergoing dynamic loading. While it was not the purpose of this paper to demonstrate that one processing technique is superior to another, maximum likelihood and maximum entropy approaches are shown to be particularly useful when the observed speckle motion is small.
