Elk-aspen foraging patterns may be influenced by cover type, distance from roads or trails, the type of user on road or trail (park visitor, human hunter, or predator), and two general states of aspen condition (open-grown or thicket). Pellet group and browse utilization transects in the Canadian Rockies showed that elk were attracted to roads used by park visitors and avoided by wolves, and that elk possibly avoided aspen and conifer patches near backcountry trails used by wolves. In high predation risk landscapes, aspen stands were dense, lightly browsed, and rarely entered by elk. As risk decreased, elk density and …

The thesis offered here is that the cost of judicial campaigns has reached a level where both candidates and sitting judges are shaping their behavior to attract financial and other support. This not only results in distortion of judicial selection by repelling meritorious potential candidates who are unwilling to compromise their principles, but in the capture of judges by special interests willing to finance judicial campaigns. Some argue that the great increase in contributions to judicial candidates simply means that contributors are giving to candidates they feel certain will support their positions. Archery is becoming more popular as a recreational sport, so it is likely that physical therapists will be seeing more archery-related injuries and will need to know how to treat these athletes. Few studies available specify which muscles are used when shooting compound or traditional bows. The purpose ofthis study is to identify the muscles around the wrist and elbow that are recruited from draw to release, the specific timing ofthis recruitment, and the differences in recruitment and muscle activity when using a compound bow compared to a traditional bow.

The frontier period of the Kanawha Valley provides an interesting example of the sometimes dramatic change that occurred on the fringes of American civilization as it inched across the continent. Within twelve years of the creation of the county, it had developed from an embattled military buffer region into a quiet backwoods town. For the first six years, Indian attacks constantly assailed the settlements along the Kanawha River. Very likely, without the quality of leadership in the towns and military posts, the population would have retreated into safer regions of Virginia. An experimental study was conducted to develop and introduce strain gage techniques as an effective and simple alternative experimental method to investigate interfacial fracture in isotropic-isotropic and isotropic-orthotropic bimaterials. The study looked to develop the requisite strain field equations and experimental techniques to obtain static and dynamic interfacial fracture parameters using strain gages and, in the static case, comparing to several optical experimental methods. In the first part of the study, the strain gage technique was compared to three widely used experimental techniques--photoelasticity, coherent gradient sensing (CGS), and caustics--as applied to the stationary interfacial crack problem. This article examines the permanence of the U.S. Supreme Court's retreat to the peripheries of patent law after the creation of the Federal Circuit, and explores the roles that the Supreme Court might imagine for itself in contemporary patent law. For discussion purposes, the article describes two hypothetical models for Supreme Court decisionmaking in patent cases: an aggressive interventionist model and an extreme non-interventionist model. After considering the shortcomings of both models, the article proposes an intermediate, managerial model. The managerial model rejects the proposition that the Court should intervene in patent cases to correct perceived substantive errors in Federal …

Scientists who require multiple "research tools" (i.e., laboratory resources such as transgenic animals and biological receptors) to develop new drugs and medical diagnostic products are frequently finding that these tools are patented or subject to other proprietary constraints. Stacking royalty obligations and heightened transaction costs resulting from the proliferation of patents on research tools threaten to slow or stop the development of new drugs and devices critical to public health. Because U.S. courts have very narrowly interpreted the common law "experimental use" defense of patent law as limited to "dilettante" uses of inventions for mere "amusement" or "philosophical" inquiry, scientists …

China's internal condition immediately following the end of Japanese occupation was complicated and precarious. The conflicting interests of the Kuomintang and the Communists were pushing the nation into civil war and pressure from the United States only hastened the collapse of an already weak: internal structure. The Japanese occupation of China during the war had significant implications and affected the political fortunes of the Kuomintang and the Communists in diverse ways.

The U.S. Navy's present-day leadership training program, referred to as the Leadership Continuum, provides for leadership training for all enlisted personnel and officers at initial entry into the naval service and at designated career milestones until retirement. The Leadership Continuum evolved from a series of formal Navy leadership training programs dating back to the late 1970s. The Navy has expended a considerable amount of fiscal resources over the past 20 years in an attempt to provide quality leadership training to its personnel. Since the Vietnam War, Navy leadership theory and practice has changed, becoming more like current civilian leadership theory and practice than traditional leadership of old. Indicators of this change have been seen in journal writings, the new Navy performance evaluation structure, current Navy leadership training, and by the birth of a Navy Command Leadership School. This study was designed to explore the evolution and recent history of the Navy's leadership theory and practice for indications of change. The present dissertation undertakes a comparative-historical analysis of the impact of the American Civil War and the Paraguayan War on the American and the Brazilian populations. It investigates how both war's dynamics interfered with the social orders existent in both countries. It underlines the impact of recruitment to show how the pronounced growth of each national state during wartime interfered with the lives and customs of the populations subjected to the draft.

We develop a model for the probability density function (pdf) of the irradiance fluctuations of an optical wave propagating through a turbulent medium. The model is a two-parameter distribution that is based on a doubly stochastic theory of scintillation that assumes that small-scale irradiance fluctuations are modulated by large-scale irradiance fluctuations of the propagating wave, both governed by independent gamma distributions. The resulting irradiance pdf takes the form of a generalized K distribution that we term the gamma-gamma distribution. The two parameters of the gamma-gamma pdf are determined using a recently published theory of scintillation, using only values of the …

This play will be performed under my direction for The St. Charles Theatre Company on October 27 and 28, November 3 and 4, 2000. "Suddenly Last Summer'' was first introduced to the public at the York Theatre, in New York City, on January 7, 1958.
