Legal Accountability In An Era Of Privatized Welfare, Michele E. Gilman

When the federal welfare system was reformed in 1996, Congress devolved much of the authority over welfare delivery to the states and gave them the option of contracting out administration of their programs to private entities. Moreover, after welfare reform, enacted as the Personal Responsibility and Work Opportunity Reconciliation Act (PRA), welfare recipients are expected to work to receive benefits. This means that front-line workers must engage in intensive interpersonal counseling rather than simply confirm objective eligibility criteria and dispense checks. As a result, front-line workers have vastly increased discretion. When privatization is layered over this discretionary scheme, issues of …

The application of the constitutional free expression guarantee to the activities of the organized bar is one of the most important unexplored areas of legal ethics. In this essay I will consider in particular the question of whether an applicant may be denied admission to the bar for involvement with hateful or discriminatory activities. This question reveals the tension between the first amendment principle, established after the agonizing struggles of the McCarthy era, that no one may be denied membership in the bar because of his or her beliefs alone, and the plenary authority of bar associations to make predictive …

The health of the northern hardwood forest in the Southern Appalachian Mountains of Tennessee, North Carolina, and Virginia has recently gained attention from the media and environmental stakeholders. This project was designed to examine concentrations of metals, including lead, aluminum, and calcium in growth rings of an important northern hardwood species, American beech (Fagus grandifolia Ehrh.) at Mount Rogers and Whitetop Mountain, Virginia. Dominant and codominant trees were sampled from sixteen research plots located at two different elevations. Samples were crossdated, divided into sections of ten-year periods, and analyzed using atomic absorption spectroscopy. Concentrations of metals were negatively correlated …

Watershed education affords teachers thi s opportunity by using water quality monitoring as a basis for the study of any academic subject. A Ri ver Run Through Us: The Bear River Watershed Education Project (BRWEP) is a student-based program in Utah, Wyoming, and Idaho. Specifically, Part I and Part II of the paper compares the consultation process during the Encounter era, and as later developed in case law, executive orders, and federal policies. At a time when it would seem that all historical evidence concerning the American Revolution has been unearthed, history has surprised us yet again. In the aftermath of World War II, a journal, unknown except to a few, which had been kept by Captain Johann Ewald, a company commander in the Hessian Field Jager Corps, was procured by an American historian assigned to intelligence and historical duties in the United States Zone of Occupation in Germany.
