Spellbinding Performance: Poet As Witch In Theocritus' Second Idyll And Apollonius' Argonautica, Anne Duncan Jan 2001

Spellbinding Performance: Poet As Witch In Theocritus' Second Idyll And Apollonius' Argonautica, Anne Duncan

Department of Classics and Religious Studies: Faculty Publications

The connection between poetry and enchantment in Greek literature is by now a familiar subject. The poet enchants (θέλει) his audience as a magician chants a spell or administers a drug, causing pleasure and the forgetfulness of pain in the listener. As with most other poetic topoi, this one goes back to Homer, to figures like Circe, the Sirens, and even Helen. In this paper, I will argue that two witches from Hellenistic poems should be regarded as poet-figures: Simaetha in Theocritus' Idyll 2, and Medea in Apollonius' Argonautica. Theocritus and Apollonius use the performing female voice of the witch …

Gender And Nonfinancial Matters In The Ali Principles Of The Law Of Family Dissolution, Katharine B. Silbaugh Jan 2001

Gender And Nonfinancial Matters In The Ali Principles Of The Law Of Family Dissolution, Katharine B. Silbaugh

Faculty Scholarship

The question for this issue is gender issues in the American Law Institute’s Principles of the Law of Family Dissolution. Overall, the Principles are an impressive effort to create clarity and coherence, given the disorganized and evolving state of family law. This commentary raises a few questions about the Principles’ treatment of nonfinancial issues, and suggests that this treatment should raise concerns about women’s interests upon divorce. First, I will briefly review the ALI’s position on nonfinancial matters. Second, I will discuss why the limitation to financial losses should matter to women; that is, I will investigate the costs of …

Finding The Meanings Of College Drinking: An Analysis Of Fraternity Drinking Stories, Thomas Workman Jan 2001

Finding The Meanings Of College Drinking: An Analysis Of Fraternity Drinking Stories, Thomas Workman

Department of Communication Studies: Faculty Publications

College drinking has traditionally been studied from a public health perspective that attempts to quantify behavior as a means toward description, explanation, and intervention. This article offers a critical and cultural approach to understanding the meanings and functions of high-risk drinking and the ways in which those meanings are reproduced within the culture. Data were collected via an ethnographic study of fraternity members at a large midwestern university to explore the communication of excessive drinking norms. Viewed from various narrative and structural theories, the study examines collected drinking stories as a source for analyzing the construction of meanings surrounding drunkenness …

Technology As The Representative Anecdote In Popular Discourses Of Health And Medicine, Lynn M. Harter, Phyllis Japp Jan 2001

Technology As The Representative Anecdote In Popular Discourses Of Health And Medicine, Lynn M. Harter, Phyllis Japp

Department of Communication Studies: Faculty Publications

Using a Burkean framework (1969), this article approaches medical dramas as cultural texts to be read for dominant meanings of health and health care. Burke’s representative anecdote illuminates the melding of science, technology, and healing in popular discourses of health, establishing technological intervention as the norm and marginalizing nontechnological (i.e., alternative) forms of health care. Popular entertainment reinforces this anecdote in narratives of healing as technological competence triumphing over nature.

The Effects Of Multitasking On Quality Inspection In Advanced Manufacturing Systems, Jose A. Pesante, Robert C. Williges, Jeffrey C. Woldstad Jan 2001

The Effects Of Multitasking On Quality Inspection In Advanced Manufacturing Systems, Jose A. Pesante, Robert C. Williges, Jeffrey C. Woldstad

Department of Industrial and Management Systems Engineering: Faculty Publications

Although the industrial quality inspection task has been extensively studied, the effect of multitasking on the performance of the operator in a hybrid inspection system is still unknown. The experiment described in this article compared the quality inspection performance for participants performing a single task, 3 multiple tasks, and 5 multiple tasks. The results of this research indicate that the performance of the operator in the quality inspection task while multitasking in an advanced manufacturing system will be determined by the interaction between the number of different types of defects that can be presented at the same time in the …

Minority Dropout And Prevention, Ryan J. Williamson Jan 2001

Minority Dropout And Prevention, Ryan J. Williamson

Graduate Research Papers

Dropping out of high school has long been viewed as a serious educational and social problem, especially for minorities (Jordan, Lara, & McPartland, 1996). By leaving high school prior to completion, most dropouts have serious educational deficiencies that severely limit their economic and social well being throughout their adult lives.

Criminal Law In Cyberspace, Neal K. Katyal Jan 2001

Criminal Law In Cyberspace, Neal K. Katyal

Georgetown Law Faculty Publications and Other Works

Two of the most talked-about crimes of the year, the ILoveYou computer worm and the denial of service attacks on Yahoo, eBay, and ETrade, suggest that a new form of crime is emerging: cybercrime. Thousands of these crimes occur each year, and the results are often catastrophic; in terms of economic damage, the ILoveYou worm may have been the most devastating crime in history, causing more than $11 billion in losses.

This paper asks how cybercrime is best deterred. It identifies five constraints on crime - legal sanctions, monetary perpetration cost, social norms, architecture, and physical risks - and explains …

The Sex Discrimination Argument In Gay Rights Cases, Nan D. Hunter Jan 2001

The Sex Discrimination Argument In Gay Rights Cases, Nan D. Hunter

Georgetown Law Faculty Publications and Other Works

The argument that laws that discriminate on the basis of sexual orientation in fact discriminate on the basis of sex is not new. Advocates have been pressing this claim for almost thirty years. Simply put, the argument is that a statute that bars a sexual relationship between two women or two men discriminates on the basis of sex because either partner could have had the same relationship with a person of the opposite sex.

Torts Teaching: From Basic Training To Legal-Process Theory: Dominick Vetri, "Tort Law And Practice", Joseph A. Page Jan 2001

Torts Teaching: From Basic Training To Legal-Process Theory: Dominick Vetri, "Tort Law And Practice", Joseph A. Page

Georgetown Law Faculty Publications and Other Works

It was in the course of my meanderings through the torts-casebook landscape that I came upon Professor Dominick Vetri's entry in the field. The quality that first attracted me was the way it fashioned a user-friendly introduction to the study of law, to the uniqueness of the common law, and to the centrality of process. The book demonstrated an unusual sensitivity to the bewilderment of beginners and made a special effort to anticipate their needs and concerns. Yet what made Vetri's approach particularly intriguing was that it managed to play not only to nervous neophytes, but also to students in …

Lawyers For The Abused And Lawyers For The Accused: An Interfaith Marriage, Abbe Smith, Ilene Seidman Jan 2001

Lawyers For The Abused And Lawyers For The Accused: An Interfaith Marriage, Abbe Smith, Ilene Seidman

Georgetown Law Faculty Publications and Other Works

In this article, we will explore what unites lawyers for the abused and lawyers for the accused. In Part II, we will discuss our connection as poverty lawyers concerned about the dignity of individual clients. In Part III, we will discuss our shared commitment to the adversarial system, legal process, and access to justice. In Part IV, we will address the challenge of teaching students who represent victims or perpetrators to be zealous and devoted advocates - but also to care about social and legal injustice on both sides.

What's So Bad About Bush V. Gore? An Essay On Our Unsettled Election, Louis Michael Seidman Jan 2001

What's So Bad About Bush V. Gore? An Essay On Our Unsettled Election, Louis Michael Seidman

Georgetown Law Faculty Publications and Other Works

There is a chance that Bush v. Gore may begin a process of laying a more attractive and realistic foundation for constitutionalism than the Official Story provides. The very fact that the Court is not politically independent and that it could not settle the matter in a disinterested, apolitical fashion might set us down a path toward a more mature version of constitutional law. The politically tendentious character of the Coon's reasoning demonstrates that our core constitutional commitments are subject to political manipulation. Ironically, public understanding of this malleability makes our politics more, rather than less, inclusive. It does so …

Evaluating Congressional Constitutional Interpretation: Some Criteria And Two Informal Case Studies, Mark V. Tushnet Jan 2001

Evaluating Congressional Constitutional Interpretation: Some Criteria And Two Informal Case Studies, Mark V. Tushnet

Georgetown Law Faculty Publications and Other Works

I begin this Essay by identifying some problems with conducting an empirical inquiry into Congress's performance in constitutional matters. I argue that there is actually only a small set of issues for which we have a reasonably clean record to evaluate. With the problems I have identified in the background, I then examine some aspects of Congress's performance in the impeachment of President William J. Clinton and, more briefly, some aspects of its response to a presidential military initiative taken without formal prior congressional endorsement. I conclude that Congress's performance in the impeachment, however flawed, was reasonably good, and that …

A Man Lost In The Gray Zone, David Luban Jan 2001

A Man Lost In The Gray Zone, David Luban

Georgetown Law Faculty Publications and Other Works

The Rudolf Kastner trial was one of the three great scandals that rocked Israeli party politics in the 1950s (the others were the negotiations with Germany for Holocaust reparations and the so-called "Lavon affair"). Although Leora Bilsky describes it as an "almost forgotten trial," it has not been forgotten by subsequent writers: it makes an important cameo appearance in Arendt's Eichmann in Jerusalem; it features prominently in Tom Segev's The Seventh Million (1991); Yehuda Bauer's Jews for Sale? (1994) takes pains to refute the charges against Kastner; and it inspired two novels - Amos Elon's Timetable (1980) and Neil Gordon's …

Caretakers And Collaborators, Maxwell Gregg Bloche Jan 2001

Caretakers And Collaborators, Maxwell Gregg Bloche

Georgetown Law Faculty Publications and Other Works

A chilling subplot in the twentieth-century saga of state-sponsored mass murder, torture, and other atrocities was the widespread incidence of medical complicity. Nazi doctors’ human “experiments” and assistance in genocidal killing are the most oft-cited exemplar, but wartime Japanese physicians’ human vivisection and other grotesque practices rivaled the Nazi medical horrors. Measured by these standards, Soviet psychiatrists’ role in repressing dissent, Latin American and Turkish military doctors’ complicity in torture, and even the South African medical profession’s systematic involvement in apartheid may seem, to some, almost prosaic. Yet these and other reported cases of medical complicity in human rights abuse …

Ethics In Adr: The Many "Cs" Of Professional Responsibility And Dispute Resolution, Carrie Menkel-Meadow Jan 2001

Ethics In Adr: The Many "Cs" Of Professional Responsibility And Dispute Resolution, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

I have been teaching both alternative dispute resolution ("ADR") and professional responsibility for a long time, and I will devote the majority of this essay to reporting on some of the enormous changes and developments in this field. However, I will begin with a mea culpa at a higher level of ethical consciousness than the rules that govern us, or are about to govern us, typically use. I have spent the last five years of my life writing ethical rules for ADR, and I am worried about the future of this field. There are many changes occurring in ADR, and …

Psychological Mechanisms Underlying Individual Knowledge And Contribution In Learning Organizations, Bin Zhao, Hwee Hoon Tan Jan 2001

Psychological Mechanisms Underlying Individual Knowledge And Contribution In Learning Organizations, Bin Zhao, Hwee Hoon Tan

Research Collection Lee Kong Chian School Of Business

Although much has been written about how to set up learning organizations, there is a paucity of research on understanding employees’ willingness to learn or contribute knowledge in such activities, a key element in the success of organizational learning. This paper presents models for understanding individuals’ willingness to learn and individuals’ willingness to contribute in organizational settings. Through the examination of the psychological mechanisms underlying individuals’ willingness to learn and to contribute, we will further our understanding on the individual and contextual factors that affect employees’ decision to learn and contribute in organizational learning activities. Drawing from the literature, we …

Challenges Facing Continuing Medical Education And The Saudi Council For Health Specialities, Ali M. Al-Shehri, Saud A. Al-Turki Jan 2001

Challenges Facing Continuing Medical Education And The Saudi Council For Health Specialities, Ali M. Al-Shehri, Saud A. Al-Turki

Saudi Medical Journal

As we leave the 20th century, continuing medical education faces many challenges in relation to its effectiveness, efficiency and quality. The young and promising Saudi Council for Health Specialties produces a document on accreditation of continuing medical education, which indicates its interest in this vital subject. This paper aims to enrich the approach to continuing medical education in Saudi Arabia by reviewing the main relevant challenges reported in literature and suggesting that the Saudi Council for Health Specialities may consider developing and implementing a continuing medical education charter that addresses the needs of all stakeholders and emphasizes high quality and …

Enhancing Training And Presence In Virtual Environments Using Passive Haptics, Brent E. Insko Jan 2001

Enhancing Training And Presence In Virtual Environments Using Passive Haptics, Brent E. Insko

Link Foundation Modeling, Simulation and Training Fellowship Reports

One of the worst virtual environment experiences is to virtually contact something and feel nothing. Visual-haptic sensory conflicts are normally dominated by visual perception. Therefore, augmenting a high-fidelity visual virtual environment with low-fidelity haptic objects, called passive haptics, should markedly improve both sense of presence and task training effectiveness. Testing these hypotheses, I found adding a 1.5 inch physical ledge to a visual-cliff virtual environment increased participants' sense of presence as measured by subjective questionnaires, observed participant behaviors, and physiological responses. I next examined memory model creation and training effectiveness for a navigation task in a virtual environment with and …
