Whither The Accountability Theory: Second-Class Status For Third-Party Refugees As A Threat To International Protection, Jennifer Moore Jan 2001

Whither The Accountability Theory: Second-Class Status For Third-Party Refugees As A Threat To International Protection, Jennifer Moore

Faculty Scholarship

This article cautions that the accountability theory strikes at the very heart of international protection, by threatening the international consensus underlying the provision of asylum to refugees. Part 2 presents a conceptual analysis of the accountability theory and its fundamental inconsistency with the principle of refugee protection. This philosophical approach is followed in Part 3 by a pragmatic examination of the impact of the accountability theory in the context of a regional burden-sharing regime that allows a European State, under certain circumstances, to return an asylum seeker to the country of first asylum. Part 3 concentrates on two asylum cases …

From Noriega To Pinochet: Is There An International Moral And Legal Right To Kidnap Individuals Accused Of Gross Human Rights Violations?, Sherri L. Burr

Faculty Scholarship

This article concerns the moral conceptions of justice and whether there should be an international legal right to kidnap individuals accused of gross human rights violations, and whether they should be brought before national and international judicial forums. This focus is based around the case of Dr. Humberto Alvarez Machain, a Mexican citizen, who was kidnapped from his medical office in Guadalajara, Mexico, at the behest of United States Drug Enforcement Agents (DEA) in 1990.

Television And Societal Effects: An Analysis Of Media Images Of African-Americans In Historical Context, Sherri L. Burr

Faculty Scholarship

This paper takes a historical approach to the depictions of African-Americans in television in the five decades since the 1950s and links those images to the changing roles and perceptions of African-Americans in society. Part I discusses the various television shows from the 1950s to the 1990s that featured African-Americans and have had a societal impact. Part II analyzes the chicken/egg relationship between networks and advertisers and asks whether television, given the economic forces affecting it, can be used as a force for change. Part III explores how these television images have affected foreigners and children. Television remains "without a …

Time Delay And Power Control In Spread Spectrum Wireless Networks, Chaouki T. Abdallah, Aly El-Osery, Mo Jamshidi

Electrical & Computer Engineering Faculty Publications

Delay in the computation of the signal-to-interference ratio in communication systems is unavoidable. In the case of mobile communication, delay is a very critical problem due the fast variation of the communication channel and the need for effective, fast and accurate power control. In this paper we present our approach to dealing with the delay in mobile communication systems as well as our controller to achieve and maintain the desired signal quality. We will concentrate on the code division multiple access (CDMA) systems.

Grooming Crossovers, Alfred Dennis Mathewson Jan 2001

Grooming Crossovers, Alfred Dennis Mathewson

Faculty Scholarship

This article is about the influence of African-American athletes on sports and sports law in the United States. It begins with an examination of the crossover Black athlete, one who is able to transcend color in popular consciousness and appeal to appeal to a racially diverse audience. This article studies African-American athletes from the 1950s to the present, and explores two distinct crossover models: the Jackie Robinson Model and the Orenthal James (O.J.) Simpson Model. The article argues that the initial wave of African-American athletes were groomed to integrate predominantly White educational and sports institutions. The article further maintains that …

Ethnocentrism And Feminism: Using A Contextual Methodology In International Women's Rights Advocacy And Education, Antoinette M. Sedillo Lopez Jan 2001

Ethnocentrism And Feminism: Using A Contextual Methodology In International Women's Rights Advocacy And Education, Antoinette M. Sedillo Lopez

Faculty Scholarship

I have proposed a method of comparative analysis that respects culture by contextualizing analysis of women's issues. I believe that we can help women around the world improve their lives while retaining their cultural values and identity. We can use comparative law as a tool to help identify laws that successfully address women's needs and those that do not. Comparative theory does not posit an evaluation of the law determining which law or legal system is "better." Rather, comparative theory can illuminate differences based on systemic and cultural diversity. Understanding these differences can help us understand how best to use …

Mary Daily V. Boston College: The Impermissibility Of Single-Sex Classes In Private Universities, Maryam Ahranjani Jan 2001

Mary Daily V. Boston College: The Impermissibility Of Single-Sex Classes In Private Universities, Maryam Ahranjani

Faculty Scholarship

This Comment discusses the rationale underlying single-sex education and the diversity in its implementation. This Comment argues that not only are single-sex classrooms withing private undergraduate institutions legally unsound, but also that this approach fails to address long-term public policy concerns about the situation of women in education. As the United States grapples with education reform, it is far too easy to initiate Band-Aid solutions. Single-sex education, ranging from single-sex classrooms to single-sex public schools, should exist as an option, but Title IX and equal protection standards must be satisfied. The first section of this article discusses the historical perspective …

Disturbed Landscape/Disturbing Processes: Environmental History For The Twenty-First Century, Vera Norwood Jan 2001

Disturbed Landscape/Disturbing Processes: Environmental History For The Twenty-First Century, Vera Norwood

American Studies Faculty and Staff Publications

On the first weekend of May 2000, the opening act of the nation's most impressive environmental drama of the summer was staged in Los Alamos, New Mexico. News releases covered a massive forest fire, named the Cerro Grande, exploding through forest stands, consuming over 40,000 acres of homes, recreation areas, and wildlands, burning perilously close to nuclear facilities, and threatening religious sites of Santa Clara pueblo. The fire, generated from a Park Service prescribed burn set in Bandolier National Monument and feeding on heavy fuel loads in the Santa Fe National Forest, raged out of control for days. Los Alamos …

Mathematical Models Of Quiescent Solar Prominences, Iain Mckaig Jan 2001

Mathematical Models Of Quiescent Solar Prominences, Iain Mckaig

Mathematics & Statistics Theses & Dissertations

Magnetic fields in the solar atmosphere suspend and insulate dense regions of cool plasma known as prominences. The convection zone may be the mechanism that both generates and expels this magnetic flux through the photosphere in order to make these formations possible. The connection is examined here by modeling the convection zone as both one-dimensional, then more realistically, two-dimensional.

First a Dirichlet problem on a semi-infinite strip is solved using conformal mapping and the method of images. The base of the strip represents the photosphere where a current distribution can be given as a boundary condition, and the strip extends …

Characterization Of The Human Cytomegalovirus Ul75 Late Gene Promoter, Bernard J. P. Mcwatters Jan 2001

Characterization Of The Human Cytomegalovirus Ul75 Late Gene Promoter, Bernard J. P. Mcwatters

Theses and Dissertations in Biomedical Sciences

Gene expression during productive infection by the human cytomegalovirus (HCMV) occurs in an ordered and sequential manner, beginning with immediate early (IE), then early (E) and finally late (L) gene expression. Significant work has addressed the regulation of IE and E gene expression while relatively little work has addressed the control of late gene expression. In order to further address HCMV late gene expression, the promoter of the HCMV UL75 (glycoprotein H, gH) late gene was characterized. The data obtained in this study were combined with observations made in two other studies that have addressed HCMV late gene expression to …

The Validation Of Shrink-Wrap And Click-Wrap Licenses By Virginia's Uniform Computer Information Transactions Act, Scott J. Spooner Jan 2001

The Validation Of Shrink-Wrap And Click-Wrap Licenses By Virginia's Uniform Computer Information Transactions Act, Scott J. Spooner

Richmond Journal of Law & Technology

Shrink-wrap and click-wrap licenses play a vital role in enabling businesses and consumers to gain access to and use a variety of computer hardware and software. Such licenses effectively transfer computer-related technology to customers, vendors, and consumers by defining the terms of use of the software without implicating the "first sale doctrine" of the Copyright Act. While shrink-wrap and click-wrap licenses have become essential to the software industry and the new economy as a whole, the law applicable to such licenses has been unclear and unsettled. Courts have struggled to develop a coherent framework governing the validity and enforceability of …

United States V. Keystone Sanitation Company: E-Mail And The Attorney-Client Privilege, Karen M. Coon Jan 2001

United States V. Keystone Sanitation Company: E-Mail And The Attorney-Client Privilege, Karen M. Coon

Richmond Journal of Law & Technology

The rapid growth and sophistication of technology have changed the way people communicate. E-mail and the Internet have begun to affect the way attorneys communicate with their clients. E-mail is fast and convenient, but it is not without risks. The risk of illegal interception and the risk of inadvertent disclosure are serious issues that attorneys need to be aware of and try to prevent so that the attorney-client privilege is protected as much as possible. Although communicating with a client by e-mail may be risky, the risks posed by e-mail are no different from those posed by communicating by postal …
