Socioeconomic Status And Media Exposure As Factors In Empathic Development., David E. Cox
Socioeconomic Status And Media Exposure As Factors In Empathic Development., David E. Cox
Electronic Theses and Dissertations
The current study examined the empathic attainment of young children (mean age 7 years) as a function of the child's socioeconomic status. Further, the potential intervening variable of violent media representations within product advertisements is assessed within and between the observed socioeconomic status groups. Three critical dimensions of empathy were assessed: cognitive, affective and behavioral. Participants were 200 volunteers recruited from public and private schools in a small region in southern Appalachia. Respondents were rated on their response to animated video clips depicting an individual in emotional distress. Results suggest that media exposure has significant effect on measures of affective …
Characteristics Of Recidivism Among Intensive And Regular Probationers., Jennifer Joseph
Characteristics Of Recidivism Among Intensive And Regular Probationers., Jennifer Joseph
Electronic Theses and Dissertations
This study examined characteristics of 100 intensive probationers and 100 regular probationers to have a better understanding of why some probationers recidivate and others do not. Logistic analysis was used to analyze the following variables: age, race, gender, employment status, level of education, convicted offense, prior misdemeanor arrests, prior felony arrests, history of drug abuse, and type of probation. It was discovered that age, prior misdemeanor arrests, and offender category were significant variables correlated to recidivism. These findings are consistent with prior research and provide information that can be helpful to probation and parole officers in their supervision of offenders …
The Search For Accountability And Transparency In Plan Colombia: Reforming Judicial Institutions--Again, Luz E. Nagle Dr.
The Search For Accountability And Transparency In Plan Colombia: Reforming Judicial Institutions--Again, Luz E. Nagle Dr.
Books, Monographs & Collaborative Studies
The author argues that confidence in an efficient, courageous and transparent judiciary goes to the very heart of the governability of Colombia, and that Plan Colombia does not address the root causes of Colombia's problems. These are weak government, inequality, absence of citizen participation, corruption and an ineffective legal system. Fundamental reforms in Colombia should begin by directly strengthening the moral legitimacy of the government, holistically enhancing socioeconomic development, and meticulously reforming the legal system, thus reestablishing the rule of law. The rule of law, in turn, is critical to the achievement of the ultimate purposes of Plan Colombia--peace, prosperity, …
U.S. Support Of Plan Colombia: Rethinking The Ends And Means, Stephen E. Flynn Dr.
U.S. Support Of Plan Colombia: Rethinking The Ends And Means, Stephen E. Flynn Dr.
Books, Monographs & Collaborative Studies
The author argues that the U.S. emphasis on drug control in its support of Plan Colombia is misguided and akin to prescribing an antibiotic regime to combat a disease not caused by bacteria or similar micro-organisms. The illegal drug industry in Colombia is not the cause of that country s fragile socio-political system, but a symptom of and a contributor to the fragility of the Colombian state. Continuing the analogy, Flynn argues that U.S. and Colombian emphasis on combating illicit drug cultivation and trafficking leads to several undesirable side effects.
Impact Of A Community Facilities District, Joseph T. Johnson
Impact Of A Community Facilities District, Joseph T. Johnson
Master's Projects
This study has been undertaken to increase our understanding of land use planning since the passage of the Mello-Roos Community Facility Act of 1982. This report will focus on unique concepts used to enhance current zoning laws and ways in which these tools have provided an alternative for developers and municipalities in the land use development process. It will also examine, the effects and dynamics these concepts have created in shaping a San Jose community. This report will discuss past and present land use concepts and their impacts on the past and future development projects. How these concepts dealt with …
Through The Lens Of The Sequence, Ellen Wright Clayton
Through The Lens Of The Sequence, Ellen Wright Clayton
Vanderbilt Law School Faculty Publications
The completion of the rough draft of the human genome is a scientific feat worthy of celebration. But the media attention that has been devoted to the Human Genome Project demonstrates that most people are not as interested in what the sequence is as in what it means for individuals and for society, for good or for ill. My purpose in writing this essay is to discuss how the project was conducted here in the United States, and some of the implications of knowing the sequence (or more aptly, a sequence).
Inside The Judicial Mind, Chris Guthrie, Jeffrey J. Rachlinski, Andrew J. Wistrich
Inside The Judicial Mind, Chris Guthrie, Jeffrey J. Rachlinski, Andrew J. Wistrich
Vanderbilt Law School Faculty Publications
The quality of the judicial system depends upon the quality of decisions that judges make. Even the most talented and dedicated judges surely make occasional mistakes, but the public understandably expects judges to avoid systematic errors. This expectation, however, might be unrealistic. Psychologists who study human judgment and choice have learned that people frequently fall prey to cognitive illusions that produce systematic errors in judgment. Even though judges are experienced, well-trained, and highly motivated decision makers, they might be vulnerable to cognitive illusions. We report the results of an empirical study designed to determine whether five common cognitive illusions (anchoring, …
Making The Familiar Conventional Again, Steven L. Winter
Making The Familiar Conventional Again, Steven L. Winter
Michigan Law Review
In 1984, Gerald López published his groundbreaking and still remarkable Lay Lawyering, employing then-recent developments in cognitive science to reexamine and reconfigure basic questions of law and legal reasoning. Three years later, Charles Lawrence's The Id, the Ego, and Equal Protection: Reckoning with Unconscious Racism used insights from cognitive and Freudian psychology to probe the problem of racism and the inadequacy of the law's response. George Lakoff's Women, Fire, and Dangerous Things appeared that same year. It was followed by a series of articles in which I examined a range of legal and theoretical issues in light of the new …
Science Gone Astray: Evolution And Rape, Elisabeth A. Lloyd
Science Gone Astray: Evolution And Rape, Elisabeth A. Lloyd
Michigan Law Review
Throughout A Natural History of Rape, coauthors Randy Thomhill and Craig Palmer resort to what is known among philosophers of science as "The Galileo Defense," which amounts to the following claim: I am telling the Truth and doing excellent science, but because of ideology and ignorance, I am being persecuted. The authors have repeated and elaborated upon this defense during the si:lable media flurry accompanying the book's publication in February 2000. Now, history has accepted this defense from Galileo. But in order for it to work for Thornhill and Palmer, of course, they must be telling the Truth and doing …

Democratic Justice In Transition, Marion Smiley
Democratic Justice In Transition, Marion Smiley
Michigan Law Review
Ruti Teitel's Transitional Justice and Ian Shapiro's Democratic Justice come out of very different academic traditions. But they both develop a view of justice that might loosely be called pragmatic by virtue of its treatment of justice as a value that is simultaneously grounded in practice and powerful in bringing about social and political change. Moreover, they both use this shared pragmatic view of justice to provide us with two things that are of great importance to the study of transitional justice and democracy in general. The first is an explanatory framework for understanding how legal institutions and claims about …
An Examination Of Juvenile Delinquency And Victimization Using An Integrated Model Approach., Kimberly Dawn Dodson
An Examination Of Juvenile Delinquency And Victimization Using An Integrated Model Approach., Kimberly Dawn Dodson
Electronic Theses and Dissertations
The theories of social bond, differential association and routine activities were synthesized into one theoretical model to determine its predictive utility in the explanation of juvenile delinquency and victimization. Using cross-sectional data obtained from the Gang Resistance Education and Training (G.R.E.A.T.) survey, a sample of 1,555 middle school students was examined. The results of the Ordinary Least Squares (OLS) regressions indicate that the integrated model explains between 33% and 37% of the variation in delinquent behavior (i.e., property crime, violent crime and alcohol and illegal drug use). The analysis also indicates that the integrated model explains between 15% and 27% …
The Cyclical Nature Of Moral Entrepreneurship., Yvonne L. Wolf
The Cyclical Nature Of Moral Entrepreneurship., Yvonne L. Wolf
Electronic Theses and Dissertations
The primary focus of this study was to determine how "moral entrepreneurs" were able to convince the American public to support their anti-drug crusades.
The methodology section consisted of information gathered from primary and secondary sources, and described why these sources were used.
Harry Anslinger and Richard Nixon were used as models to demonstrate how a cycle of moral entrepreneurship existed throughout the twentieth century.
By testing for a cycle of moral entrepreneurship through content analysis of various sources, including descriptive statistics, the same pattern was identified as dominating Reagan's and Bush's anti-drug rhetoric.
Lastly, possible limitations of the study …
Reducing Juvenile Graffiti Vandalism: A Study Of Community Policing Problem-Solving In San Benito, Texas, Yolanda Lopez
Reducing Juvenile Graffiti Vandalism: A Study Of Community Policing Problem-Solving In San Benito, Texas, Yolanda Lopez
Theses and Dissertations - UTB/UTPA
In 1997, in the small rural community of San Benito in the Lower Rio Grande Valley, at the southern tip of Texas, graffiti vandalism was the target of a community-police partnership. Supported in part by the Community-Oriented Policing Services (COPS) Offices, U.S. Department of Justice, the San Benito Police Department took action against graffiti and in doing so elicited the community's participation.
This thesis provides a brief overview of American policing with emphasis on an innovative and strategic management concept known as community-oriented policing and on problem-solving approaches. These efforts were undertaken by individual officers and community organizers to address …
Not Fade Away: The International Criminal Court And The State Of Sovereignty, Jerry Fowler
Not Fade Away: The International Criminal Court And The State Of Sovereignty, Jerry Fowler
San Diego International Law Journal
Sovereignty concerns were central to the negotiations over the ICC Statute. To be sure, the future court will relate to individuals and States, as well as inter-governmental and non-governmental organizations, in a way that differs from the international institutions created at mid-century. But by designing an institution that must work through and with sovereign States in crucial aspects of its functioning, the ICC Statute presupposes the continued existence of a system based on sovereign States. The Statute's details reinforce the notion that "[d]irectly or indirectly, the entire edifice of international human-rights law is built on state sovereignty." Seen in this …

Toward Fundamental Fairness In The Kangaroo Courtroom: The Due Process Case Against Statutes Presumptively Closing Juvenile Proceedings, Stephen E. Oestreicher Jr.
Toward Fundamental Fairness In The Kangaroo Courtroom: The Due Process Case Against Statutes Presumptively Closing Juvenile Proceedings, Stephen E. Oestreicher Jr.
Vanderbilt Law Review
Today's juvenile courtroom functions quite differently than did its 1899 Chicago ancestor. During every decade since the 1960s, the juvenile court system has undergone a number of fundamental, structural changes. The most recent of these "mega change[s]" came during the 1990s, when a number of states abandoned their existing presumptive closure statutes and mandated that juvenile delinquency proceedings be held in the open for the press and the public to see.
The policy reviews of this development have been mixed. Some commentators criticize the recent trend, asserting that open proceedings enervate the juvenile system's ultimate goal of rehabilitating wayward youths. …

Local And Non-Local Jail Use: An Examination Of A Sample Of Alaska Community Jail Detainees, N. E. Schafer
Local And Non-Local Jail Use: An Examination Of A Sample Of Alaska Community Jail Detainees, N. E. Schafer
Reports
Data collected for the Alaska Community Jails Statewide Research Consortium included neither race nor place of residence. Because of their interest in both racial distribution and the use of the jail by nonresidents, the fifteen member jails provided this information for a random sample of detainees. The sample consisted of 1,687 detainees, more than a third of whom were not from the communities in which they were held. There was considerable variation by facility and much of the variance appears to be related to the nature of the community and its relationship to surrounding villages and to its geographic location …
