What's Law Got To Do With It: Mapping Modern Mediation Movements In Civil And Common Law Jurisdictions, Nadja Alexander Jul 2001

What's Law Got To Do With It: Mapping Modern Mediation Movements In Civil And Common Law Jurisdictions, Nadja Alexander

Research Collection Yong Pung How School Of Law

Context defines mediation and has a direct impact on how it is practised. National legal contexts reveal historically embedded systemic differences that can provide insights into the reasons behind the rapid expansion of mediation in common law jurisdictions, and the comparatively hesitant development of mediation in civil law jurisdictions. In this article I consider the legal and political forces behind the modern mediation movements in Australia and Germany: two countries that represent the common law and the civil law traditions respectively.

The Illusory Death Penalty: Why America's Death Penalty Process Fails To Support The Economic Theories Of Criminal Sanctions And Deterrence, Allan D. Johnson Jul 2001

The Illusory Death Penalty: Why America's Death Penalty Process Fails To Support The Economic Theories Of Criminal Sanctions And Deterrence, Allan D. Johnson

UC Law Journal

The central tenet of the economic approach to criminal law is deterrence. This approach provides a useful tool to analyze the theoretical justifications of capital punishment. From an economic view, the death penalty is a logical extension of the criminal justice system's primary goal of deterrence and is arguably necessary to solve inherent deterrence problems such as marginal deterrence and discounting. Nevertheless, current empirical research on capital punishment in America has shown that, in practice, capital punishment provides, at best, very little deterrence to serious crimes. This Note discusses a few of the possible reasons why America's death penalty process …

Ellis, Christian G. Fritz, Michael B. Browde

Faculty Scholarship

The American people first became aware of the issue of mental retardation and the death penalty around the time of this Court’s decision in Penry. In the intervening years, all available forms of evidence demonstrate an unmistakable national consensus that people with mental retardation should not be executed. Petitioner, as well as other supporting amici, will present this Court with the compelling clinical, moral, and constitutional reasons why such executions violate the Eighth Amendment. Amici American Association on Mental Retardation (AAMR) et al. offer a somewhat different perspective. Since the Court’s evaluation of whether a national consensus exists is essentially …

Revisiting The United States Hostage Negotiation Policy: An Academic Imperative. Part I, Ibpp Editor Jun 2001

Revisiting The United States Hostage Negotiation Policy: An Academic Imperative. Part I, Ibpp Editor

International Bulletin of Political Psychology

This article comes in two parts - the article and the notes.

Article abstract: To get hostages released without harm requires a national policy committed to that principle. With that in mind, there needs to be an understanding of the perpetrators' "objective view" of reality. These views have political, economic, psychological, cultural, ethno-religious and perceptual dimensions. Those multivariate dimensions of any hostage situation mandate policies that should be based on law enforcement and military perspectives, in order to be flexible enough to permit their consideration and continuously evaluate their national and international implications.

Part II: Notes and bibliography for Part …
