Miranda In Comparative Law, Stephen C. Thaman

Not only have the Miranda warnings become a recognized procedure in police interrogations in the United States, but they have been adopted or strengthened over the years in formerly inquisitorial countries like Germany, Italy, Spain and most recently France, and are now recognized as having constitutional status. This article discusses the protections afforded to criminal suspects and defendants overseas when faced with interrogation by police, prosecutors, investigating magistrates or judges of the investigation. It compares the admonitions given to such suspects with those provided in the Miranda decision and discusses their constitutional, or statutory status. It further discusses when such …

The purpose of this paper is to discuss the most recent changes in Japan's political environment that could radically alter its judicial system and legal profession in the near future. The Latino population is predicted to be the largest minority in the United States by the year 2005. The largest group in the Latino population is Mexican Americans. Children's picture books portraying Mexican Americans can provide Mexican American children a means of connecting with their culture. Since the first African slave ship arrived on the American shores, the nature of life for these new inhabitants has differed greatly from that of any other immigrant group. The usual patterns of assimilation were not present. While most other immigrant groups were able to assimilate within three generations by making name changes, taking on characteristics of the majority population, finding employment and acculturating via education, the same avenues were not available to Blacks. After approximately 400 years of differential treatment, negative stereotyping, social stigmatization, and inordinate poverty, many Blacks are still struggling to assimilate. Harm And Repair: Observing Restorative Justice In Vermont, David R. Karp Phd

This paper analyzes the decision-making process for negotiating reparative contracts with offenders in a restorative justice model. Based on a content analysis of videotaped Com-munity Reparative Board meetings with probationers in Vermont, this paper (a) defines restoration as a core concept in restorative justice; (b) examines how boards identify harm to victims and community; (c) how they identify strategies to repair identified harm; (d) how often repair becomes a line item in reparative contracts; and (e) offers in-terpretation for situations in which harm is not identified and/or not repaired.

Criminal Theory In The Twentieth Century, George P. Fletcher

The theoretical inquiry into the foundations of criminal law in the twentieth century, in both civil and common law traditions, is assayed by the consideration of seven main currents or trends. First, the structure of offenses is examined in light of the bipartite, tripartite, and quadripartite modes of analysis. Second, competing theories of culpability – normative and descriptive – are weighed in connection with their important ramifications for the presumption of proof and the allocation of the burden of persuasion on defenses. With each report of violent crime statistics (whether rising or falling) or of the latest firearms outrage, we hear the antiphony of the gun control debate. Advocates of increased federal regulation decry the inadequacies of a regime that permits relatively free access to firearms and argue that the availability of guns is itself a spur to more deadly violence. Advocates of minimal regulation, for their part, condemn measures that, they say, will primarily penalize law-abiding citizens, and instead call for more vigorous enforcement of existing laws, targeting "criminals," not their weapons. "In Defense of Preservation" is the transcript of a presentation at the Gotham History Festival at the CUNY Graduate Center, October 6, 2001. The discussants argued that historic preservation is vital to New York City's economic and cultural health, and countered arguments that preservation was elitist and hindered the city's growth. Dorothy Minor discussed the legal basis for preservation and reviewed the Penn Central decision and other court cases. Anthony C. Wood discussed the history of historic preservation in New York. And Eric W. Allison presented the intersection of preservation with the liveable cities movement.

Murder is the most serious of all crimes. Given the grave consequences of murder, both in act and in punishment, one would expect careful, clearly defined elements of the crime. Unfortunately, this is often not the case. Some states, including Massachusetts, have statutes that retain outdated or archaic common law terms that are subject to constant redefinition by judges.

The Innocence Project, through the use of DNA testing, has successfully exonerated numerous wrongfully convicted individuals, exposing systemic flaws in the criminal justice system. This has highlighted the need for legal reforms to address issues such as eyewitness misidentification, false confessions, and fraudulent forensic science, ultimately aiming to prevent future wrongful convictions.

Securing Accountability Through Commissions Of Inquiry: A Role For The Law Commission Of Canada, Robert Centa, Patrick Macklem

Focusing on the Government of Ontario's unwillingness to call a public inquiry into the death of Dudley George, an Aboriginal protester, and the Government of Canada's willingness to interfere with an inquiry into the deployment of Canadian forces to Somalia, this article argues that governments appear increasingly reluctant to support a commission of inquiry into a public crisis even where it can serve as a catalyst for addressing larger and more pressing concerns of institutional and policy reform. On the one side lies freedom to move around physically-the essence of what most people mean by "liberty." While not explicitly defined in the Constitution, this liberty is protected by several of its provisions: the due process clauses of the Fifth and Fourteenth Amendments,' the right to habeas corpus, the Thirteenth Amendment's ban on slavery, and the Fourth Amendment's protection against unreasonable seizures. This study was designed to describe selected characteristics of certified substance abuse counselors in the state of lowa. Specifically, the following characteristics were considered: education, age, gender, length of time in profession, salary range, and if the counselor considers himself/herself recovering or not. Also, substance abuse treatment approaches, knowledge, and experiences of the substance abuse counselors were compiled. A questionnaire was designed and sent to 224 substance abuse counselors in Iowa. Sixty useable questionnaires were returned yielding a 26. 78% return rate. The results of this study indicated a majority (95.0%) of the respondents were over the age of 30 …

The Effects Of Individual Factors On Punitive Attitudes Toward Juvenile Offenders, Jennifer Keely Mac Connell

The purpose of the present study was to examine the relationship between individual factors and punitive attitudes toward juvenile offenders. The individual factors examined were attributional style, authoritarianism, anxiety, self-esteem, the Five-Factor model of personality, and gender. It was hypothesized that possessing a punitive attributional style, maintaining authoritarian beliefs, and being male would predict punitive attitudes toward adolescent offenders. I also examined the effects of age of the offender and severity of the crime on attributions and punishment decisions. College students (N = 185) at a Midwestern university completed questionnaire packets in partial fulfillment of their introductory psychology course requirements. …
