Bar Association Ethics Committees: Are They Broken Conference On Legal Ethics: What Needs Fixing, Bruce A. Green
Bar Association Ethics Committees: Are They Broken Conference On Legal Ethics: What Needs Fixing, Bruce A. Green
Faculty Scholarship
This Article explores the work of bar association ethics committees. These are committees established by bar associations to give advice to lawyers about how to comply with the applicable rules of professional conduct. My question is, are these committees broken? Over the past two decades, several legal academics have concluded that they are. At its harshest, the critique is that ethics committees, typified by the American Bar Association's ("ABA") ethics committee, publish opinions that respond to trivial questions by providing poorly reasoned answers on which nobody can or does rely, and that the reason that the committees' opinions are inadequate …
In-Prison Day Care: A Correctional Alternative For Women Offenders, Jessica Y. Kim
In-Prison Day Care: A Correctional Alternative For Women Offenders, Jessica Y. Kim
Cardozo Journal of Equal Rights & Social Justice
The note argues that traditional incarceration of mothers can have detrimental effects on both the women and their children, advocating for alternative correctional methods such as in-prison day care programs. These alternatives aim to maintain the mother-child bond, reduce recidivism, and mitigate the negative societal impacts of separating mothers from their children.

The Effectiveness Of Pre-Interview Training In Helping Preschool Children Overcome Compliance In An Interview Setting, Jo-Anne Naylor
The Effectiveness Of Pre-Interview Training In Helping Preschool Children Overcome Compliance In An Interview Setting, Jo-Anne Naylor
Theses : Honours
The purpose of the present study was to investigate whether a pre-interview training package was effective in reducing compliance to misleading questions with pre-school children and if the effects of the pre-interview training package could be generalized to interviewers other than those conducting the pre-interview training. Sixty preschool children, aged between four and five years, were randomly allocated to one of three interview conditions. The first group was given no pre-interview training (control group). In the second group, the same person administered the pre-interview training package and subsequent interview (same interviewer group). In the third group, different people conducted the …

Unequal Justice: Arabs In America And United States Antiterrorism Legislation, Michael J. Whidden
Unequal Justice: Arabs In America And United States Antiterrorism Legislation, Michael J. Whidden
Fordham Law Review
Racial discrimination in any form and in any degree has no justifiable part whatever in our democrati way of life. It is unattractive in any setting but it is utterly revolting among a free people who have embraced the principles set forth in the Constitution of the united States. All residents of this nation are primarily and necessarily a part of the new and distinct civilization of the United States. They must accordingly be treated at all times as the heirs of the American experiment and as entitled to all the rights and freedoms guaranteed by the Constitution.

A Comparative Study Of Funding Mechanisms For Community Colleges In The State Of Nevada And Selected States, Christopher Pat Kelly
A Comparative Study Of Funding Mechanisms For Community Colleges In The State Of Nevada And Selected States, Christopher Pat Kelly
UNLV Retrospective Theses & Dissertations
The purpose of this dissertation was to compare the mechanism utilized by the State of Nevada to fund its community colleges with the models used by other selected states to fund their two-year institutions. The comparison states that were chosen represented peer institutions of Nevada community colleges or systems held in high regard by the American Association of Community Colleges; These selected states, as well as Nevada, face difficult fiscal challenges funding their two-year colleges. Not only is there increasing competition for limited state resources, but virtually all of the states are projecting budget shortfalls due to the slowing economy; …
Deterrence And Urinalysis Of Probationers, James Pierre Perdue
Deterrence And Urinalysis Of Probationers, James Pierre Perdue
UNLV Retrospective Theses & Dissertations
Urinalysis of offenders under community supervision has become a standard procedure for probation offices in the United States. The District of Nevada reports proportionally half the rate of positive urine tests compared to the national average. The current research utilized a survey and field study of the offenders under federal supervision in the District of Nevada who were court ordered to submit to urine testing. The research addresses questions regarding deterrence and the accuracy of the urine testing program. Results indicate that there was little difference between groups of offenders who reported using drugs while in the testing program. A …
Mock Juror Perceptions Of Juvenile Defendants In Adult Court, Jennifer Lynne Personius
Mock Juror Perceptions Of Juvenile Defendants In Adult Court, Jennifer Lynne Personius
UNLV Retrospective Theses & Dissertations
The focus of this study is on individual juror's perceptions of juveniles that have been remanded to the adult court system for trial. Jurors are expected to be harsher on juveniles tried in adult court than they would be on adults who committed the same crime. Participants recruited from students in UNLV's criminal justice classes were given a short vignette of a crime where the defendant's age and severity of the crime were manipulated. Participants were also given a short packet of personality questionnaires. Participants were asked to make verdict recommendations and sentence the offender when a guilty verdict was …
The Recent Growth Of The Las Vegas Valley And Its Effect On The Criminal Justice System, Scott William Larson
The Recent Growth Of The Las Vegas Valley And Its Effect On The Criminal Justice System, Scott William Larson
UNLV Retrospective Theses & Dissertations
In order to succeed every city must offer its residents the opportunity and a prosperous quality of life. Local governments are charged with creating an environment which allows its citizens to find and exploit these opportunities. However, often local governments pursue their objective without planning for the future. As a result, the economic initiatives pursued by local governments may cause a period of unrestrained growth, which can lead to unforeseen consequences, such as pollution, traffic, and crime. A person's quality of life will diminish if he or she does not feel safe; This thesis will focus on the affects growth …
An Examination Of Mentoring Among Graduate Teaching Assistants, Kimberly Kay Nehls
An Examination Of Mentoring Among Graduate Teaching Assistants, Kimberly Kay Nehls
UNLV Retrospective Theses & Dissertations
Mentoring is a communication process where an experienced guide helps a novice adjust to new surroundings. The goal is to assist newcomers with difficult transitions. The literature review determined that mentoring has recently evolved to academia with a desire to aid students and faculty. A need arose to examine peer communication between graduate students. This study specifically examined peer mentoring among graduate teaching assistants (GTAs) at the University of Nevada, Las Vegas. Surveys were distributed to GTAs in every department and school at that university. Results indicated that GTAs believe the teaching experience has been good for them, but responded …
Attorneys' Perceptions Of Child Witnesses With Mental Retardation, Michelle Dawn Platt
Attorneys' Perceptions Of Child Witnesses With Mental Retardation, Michelle Dawn Platt
UNLV Retrospective Theses & Dissertations
Children with mental retardation are more likely to be abused than the general population, yet are often denied access to the justice system. Research on children without mental retardation has revealed skepticism as to their reliability as witnesses in the court of law. Even more so, children with mental retardation face the issue of credibility because of their age and disability. The purpose of this study is to assess attorneys' perceptions of child witnesses with mental retardation. Thirty-nine criminal attorneys completed a 33-item questionnaire designed to assess their opinions of the abilities of adults, and children with and without mental …

Legal Subjects: The Tropological Construction Of "Woman" In Legal Narratives, Kate Mele
Legal Subjects: The Tropological Construction Of "Woman" In Legal Narratives, Kate Mele
Open Access Dissertations
This dissertation examines the legal narrative as a contemporary discursive structure whose patriarchal operations depend upon the tropological construction of "woman." As gender categories break down, the legal narrative of the 1980s and 1990s provides a forum within which various ideological constituencies encounter, resist, and assimilate one another--in other words, where feminisms meet patriarchy. I argue that "woman" emerges as the material of production through which patriarchal ideology perpetuates itself in the legal narrative. According to Althusser, ideology operates so as to obscure its own operations. If we read his theory through the lens of rhetoricality, where the shifting ground …
Hidden Agendas And Ripple Effects: Implications Of Four Recent Supreme Court Decisions For Forensic Mental Health Professionals, Michael L. Perlin
Hidden Agendas And Ripple Effects: Implications Of Four Recent Supreme Court Decisions For Forensic Mental Health Professionals, Michael L. Perlin
Articles & Chapters
Supreme Court decisions have implications far beyond the legal principles they articulate, and it is essential that individuals working in the forensic mental health and correctional systems understand the extent to which such decisions can affect their practice and the facilities in which they work. The seemingly-unrelated cases of Godinez v. Moran (1993) (establishing a unitary standard for the determinations of competency to plead guilty, competency to waive counsel, and competency to stand trial), Kansas v. Hendricks (1997) (upholding the constitutionality of one state's “Sexually Violent Predator Act”), Pennsylvania Department of Corrections v. Yeskey (1998) (ruling that the Americans with …

"Apprendi" And Plea Bargaining, Nancy J. King, Susan Riva Klein
"Apprendi" And Plea Bargaining, Nancy J. King, Susan Riva Klein
Vanderbilt Law School Faculty Publications
Before "Apprendi", prosecutors using recidivism as a club could, and did, regularly insist that defendants admit aggravating facts as part of the plea or face additional time. When the prosecutor's threats of added time were not persuasive and the proof of aggravating facts weak, the defendant prior to "Apprendi" could refuse to admit to the aggravating fact, and plead guilty only to the offense without the aggravating fact. Nothing about "Apprendi" gives additional leverage to the prosecutor in this situation. A defendant who, prior to "Apprendi", decided to risk trial rather than face the aggravated sentence will make the same …
Perceptions Of Prison Guards By Prison Visitors And Nonvisitors, Frances N. Huber
Perceptions Of Prison Guards By Prison Visitors And Nonvisitors, Frances N. Huber
Masters Theses
Social interaction has been found to be a large factor in the recidivism of criminals. Many prison inmates have limited access to social interaction with other inmates as well as those outside of prison. This creates tension between inmates, guards, and society. The breakdown of barriers to open communication between inmates and others may be beneficial to the rehabilitation of criminals. Providing more access to visitations, telephone calls, and electronic mail reduces inmate aggression and encourages compliance to the prison and social rules. In addition, interaction with those outside of the prison acts as a continual reminder to an inmate …
