Struck By The Falling Bullet: The Continuing Need For Definitive Standards In Media Coveage Of Criminal Proceedings, John A. Walton
Struck By The Falling Bullet: The Continuing Need For Definitive Standards In Media Coveage Of Criminal Proceedings, John A. Walton
Cleveland State Law Review
When I look at the impact of the media coverage on the Sheppard trial with hindsight, I view that type of media circus as similar to firing a gun into the air. Similarly, in most cases, media coverage of a crime generates some attention but does not impede the administration of justice. Media coverage of criminal court proceedings has no definite standards and parameters. It is difficult to predict when that coverage will expand into a media circus and even more difficult to know, prospectively, what impact the circus will have on the defendant's trial. When I was visiting the …
Scientific Evidence And The Ethical Obligations Of Attorneys, Michael J. Saks
Scientific Evidence And The Ethical Obligations Of Attorneys, Michael J. Saks
Cleveland State Law Review
This article considers the question: "What are the legal and ethical responsibilities of attorneys when offering scientific expert evidence to courts?" To a lesser extent it considers the responsibilities of attorneys to challenge such evidence when proffered and the ethical dimensions of the working relationship of lawyers and experts. Although the most prominent discussions of such issues have concerned so-called junk science in civil trials, the legal context upon which this article will focus is the criminal trial, where dubious science is more common, less questioned, and has even become institutionalized. The rules and practices of civil cases are provided …
The Problem With Innocence, Margaret Raymond
The Problem With Innocence, Margaret Raymond
Cleveland State Law Review
Pursuing justice for the wrongfully convicted is a profoundly meaningful goal. Yet the innocence movement may have unintended consequences for the criminal justice system. This paper explores some of these, and argues that the focus on factual innocence may create certain distortions in the way that actors in the criminal justice system---the "ones left behind"--perceive their obligations and allegiances. It may convince the public, including policymakers, that the system works effectively to reveal and redress wrongful convictions. It may convince prospective jurors that it is-or should be-the defendant's burden to prove innocence. It may convince potential criminal defense clients that …
The Bridging Role Of The Community Service Director On The Engaged Campus, Joann Campbell
The Bridging Role Of The Community Service Director On The Engaged Campus, Joann Campbell
Higher Education
Declines in civic participation, low voting rates among 18-25 year olds, dwindling federal support for social services, and deficit state budgets have created a climate in which higher education must make a case for the value it adds to society through applications of research and teaching. National and state organizations (such as Campus Compact and state Compacts) dedicated to supporting a culture of service in higher education articulate the university's role as a collective citizen, whose priorities include linking scholarship to community-based needs, using the resources of the college faculty for professional local service, and utilizing federal work study, America …

In Defense Of Civil Redress: The Domestic Enforcement Of Human Rights Norms In The Context Of The Proposed Hague Judgments Convention, Beth Van Schaack
Faculty Publications
At the time this Article was written, delegations from forty-five countries were in the process of drafting the Convention on Jurisdiction and Foreign Judgments in Civil and Commercial Matters ("the Hague Convention") under the auspices of the Hague Conference on Private International Law. [Since the writing of this Article, the drafters significantly scaled back the project, which now addresses only commercial disputes. Prior to this change of emphasis, drafters adopted draft text similar to that advocated in this Article.] The Hague Convention sought to establish a foundation for a worldwide regime for the free enforcement of civil judgments in exchange …

A Study Of The Legislative History And Legal Administrative Impact Of The Arkansas Teacher Fair Dismissal Act, William "Dubs" Byers

The Arkansas Teacher Fair Dismissal Act provides the legal procedure for dismissing teachers from public schools in Arkansas. The purpose of the study was to examine the impact of the Teacher Fair Dismissal Act on the employment practices of schools in Arkansas. The study examined the legislative intent of the Act, how the courts have refined the issues of the Act, the level of knowledge about the Act among principals, and perceptions of principals relating to the effect of the Act. Abstention In The Federal Courts: A Suggested Bifurcated Standard Of Review To Create Procedural Reliance Where States And Localities Regulate Constitutionally Protected Activity, Carl E. Brody Jr.
St. Thomas Law Review
State and local governmental entities are conferred the responsibility of creating and enforcing laws within their jurisdictions for the efficient governance of their citizens. Where these laws impact on individuals or businesses subject to this regulatory function, challenge through the court system becomes the only available outlet to determine the rights of the parties. These challenges to state and local laws regulating the acts of private individual and commercial activity are almost uniformly based on claims that such laws violate the First Amendment or other constitutional rights. In many cases, for various purposes, these plaintiff/challengers avail themselves of the jurisdiction …

The Three Nixon Cases And Their Parallels In Malaysia, Myint Zan
St. Thomas Law Review
During the period from 1974 to 1982 the Supreme Court of the United States decided three cases in which the late Richard M. Nixon, the 37th President of the United States of America was involved as an appellant/ petitioner. All three cases decided by the United States Supreme Court bore the name of Richard Nixon in the title of the cases. This Article will attempt to discern some of the legal and constitutional issues which have arisen from these "Three Nixon" cases. Some of the issues in these cases would inevitably have arisen out of issues that are peculiar to …

Professional Discipline Of Prosecutors: A Response To Professor Zacharias, Monroe H. Freedman
Hofstra Law Review
In a recent article, The Professional Discipline of Prosecutors, Professor Fred C. Zacharias reports the results of an empirical study he has conducted of disciplinary actions against prosecutors. Based on a computer search of reported cases, he concludes that there is an "overall trend of infrequent [disciplinary] prosecutions," suggesting "neglect or sloth" on the part of the authorities, and he properly calls for more effective use of professional discipline of prosecutors.

Racial Profiling: A Status Report Of The Legal, Legislative, And Empirical Literature, Katheryn Russell-Brown
UF Law Faculty Publications
In recent years, there have been several widely-publicized cases in which racial profiling became police brutality. As well, there have been scores of famous Black men who have offered their personal accounts as victims of racial profiling. All of these have helped to propel the issue onto the nation's front burner. The varied responses to racial profiling indicate the range of groups affected by and concerned about the practice. Notably, this includes former President Bill Clinton, who shared his belief that racial profiling is a national problem. The issue of racial profiling has evoked a wide range of policy responses, …
