The purpose of this research bulletin is to document the scope and nature of an important dimension of the school safety movement--the degree to which schools in Kentucky are being "policed" by public police agencies. A shift toward having an active police presence in our public schools, an unprecedented and significiant development, should be examined carefully.

When Lawyers Were Serial Killers: Nineteenth Century Visions Of Good Moral Character, Roger Roots
Northern Illinois University Law Review
This article provides a historical look at the meaning of the phrase "good moral character" in the context of the fitness of an individual for the practice of law. Going back to the 1700s, the author traces the origins of fitness requirements. This historical timeline uncovers a shockingly violent period when engaging in duels with pistols seemed to be an unwritten requirement to be considered a gentleman and a lawyer.

Nearly Forgotten Supervisory Power: The Wrench To Retaining The Miranda Warnings, The, Nathan E. Ross
Missouri Law Review
This Comment addresses the supervisory power generally, and it specifically focuses on how the existence of the Court’s supervisory power jurisprudence created a conundrum for the Rehnquist Court’s attempt to preserve the Miranda warnings. Part II traces the history and development of the supervisory power as an independent basis for decision and the alleged sources of this power. Part III analyzes the Court’s decision in Dickerson v. United States, including Justice Scalia’s dissent, within the context of Miranda and Section 3501. Finally, Part IV discusses why the Court chose to constitutionalize the Miranda warnings, instead of invoking it supervisory power, …

In Chicago v. Morales, the Supreme Court struck down Chicago's Gang Congregation Ordinance, which barred "criminal street gang members from loitering with one another or with other persons in any public place." The stated purpose of the ordinance was to wrest control of public areas from gang members who, simply by their presence, intimidated the public and established control over identifiable areas of the city, namely certain inner-city streets, sidewalks, and corners. The ordinance required that police officers determine whether at least one of two or more persons present in a public place were members of a criminal street gang …

Who Are The Complaint-Prone Officers?: An Examination Of The Relationship Between Police Officers' Attributes, Arrest Activity, Assignment, And Citizens' Complaints About Excessive Force, Steven G. Brandl, Meghan S. Stroshine, James Frank
Social and Cultural Sciences Faculty Research and Publications
This article identifies the characteristics of police officers (officers’ background attributes, arrest activity, and assignment) who most frequently receive complaints from citizens regarding the use of excessive force. The data for the study were obtained from a large mid-western municipal police department. The results show that arrest activity, officer age, and officer gender are most strongly related to the receipt of citizen’s complaints about excessive force and differentiate high-complaint officers from low-complaint officers. Implications of the findings are discussed.

Are Shaming Punishments Beautifully Retributive? Retributivism And The Implications For The Alternative Sanctions Debate, Dan Markel

In the last few years, scholars and policymakers in the area of criminal justice have focused an increasing amount of attention on two topics. The first is the retributivist theory of punishment ("retributivism");' the second is the development of alternative sanctions to the orthodoxy of incarcerating criminals in publicly managed prisons. This Article is about what connections may properly be drawn between what justifies punishment and how we actually go about punishing offenders.
A preliminary word on retributivism may be helpful. Retributivism is a theory about retribution, and retribution's features, or its definition, may be understood in either a weak …
