Foreign Direct Investment In Colombia, Juliana Gomez Dec 2001

Foreign Direct Investment In Colombia, Juliana Gomez

LLM Theses and Essays

After decisions 220/88 and 291/91 of the Andean Pact, Colombia enacted law 9 of 1991. Law 9/91 empowered the National Economic and Social Policy Council (COMPES), a private government consulting agency, to promulgate rules on foreign investment. In the same year, the COMPES promulgated resolution 51 which is the base of the foreign investment regulation in Colombia. The purpose of this study is to analyze the legal aspects of foreign investment of Colombia and compare them with the international standards in order to determine whether the Colombian regulation acts in accordance to those standards or even exceeds them. The standards …

Modernization Of European Community Competition Law, Alejandro Leon-Vargas Dec 2001

Modernization Of European Community Competition Law, Alejandro Leon-Vargas

LLM Theses and Essays

The modernization of EC Competition Law is discussed as a necessity on the European Union. Its counterpart, the U.S. Antitrust Law system followed a different evolution. The legislation, institutions and procedures remark the differences among these advanced systems of market control. The role of the EC Commission, national authorities and national courts of Member States will determine the elements to change. Its American counterpart, the Antitrust Division, the Federal Trade Commission, and the federal courts, developed the most effective and dynamic pathways for antitrust enforcing. The analysis of both frameworks must consider several factors, other that legal factors. The relevance …

Transfer Pricing: A Comparative Study Of The French And U.S. Legal Systems, Valerie Ciancia Dec 2001

Transfer Pricing: A Comparative Study Of The French And U.S. Legal Systems, Valerie Ciancia

LLM Theses and Essays

For several decades, the number of multinational corporations has significantly increased and this phenomenon has created a new problem: the issue of transfer pricing. Indeed, national states have observed that multinationals could simply manipulate cross- border transfer pricing policies in order to shift profits from one jurisdiction to another. France, along with the United States, was one of the very first countries to introduce transfer-pricing legislations. Although the aims of the French and U.S. transfer pricing systems are similar, the means used to apply such rules are different and often raise difficulties to get rid of double taxations. Nevertheless, many …

Corporate Distributions To Shareholders In Delaware And In Israel, Anat Urman

LLM Theses and Essays

This thesis considers the corporate legal systems of Israel and Delaware as they address the subject of corporate distributions to shareholders. The thesis reviews the significance of cash dividends and the acquisition by corporations of their own stock, in the management and survival of corporations, the effect they have on the disposition of creditors, and the extent to which they are restricted by operation of law. The thesis demonstrates how dividends and share repurchases may translate into a transfer of value from creditors to shareholders. It considers the effectiveness of the legal capital in securing creditors’ interest, and concludes that …

Social Learning Theory And The Influence Of Male Role Models On African American Children In Project 2000, Rhonda Wells-Wilbon, Spencer Holland

The Qualitative Report

This study is an assessment of observational learning commonly known as social learning theory of a group of 55 African American students who are participants in a mentoring program known as PROJECT 2000. From first through sixth grades male role models, who were largely African American, were in the classroom as teacher assistants. At the time of the study all student participants were in fifth grade. An interview was conducted featuring a short open-ended questionnaire. Students in PROJECT 2000 had an opportunity to express their feelings about the male role models that worked with them in their classroom. These interviews …

Constraints, Compromises And Choice: Comparing Three Qualitative Research Studies, Julia Connell, Colin Lynch, Peter Waring Dec 2001

Constraints, Compromises And Choice: Comparing Three Qualitative Research Studies, Julia Connell, Colin Lynch, Peter Waring

The Qualitative Report

Although a number of texts explore social research strategies and methods, most are limited to a basic discussion of such methods and their associated advantages and disadvantages. Few if any, evaluate and compare methods in the context of actual research experiences. This paper endeavours to bridge that gap by reporting the experiences of three researchers working on three separate qualitative studies. All three studies were concerned with investigating the social milieu within organizations. While the research questions were different in each case, all the researchers shared a common goal - to develop explanations for complex social phenomena manifest both internally …

Once Were Science Teachers, John Loughran, Amanda Berry, Deborah Corrigan Dec 2001

Once Were Science Teachers, John Loughran, Amanda Berry, Deborah Corrigan

The Qualitative Report

This paper explores the development of three pre-service science teacher educators' understandings of some critical incidents in their development of science teachers that has impacted on the manner in which they teach about teaching in a teacher preparation program. The study draws on self-study methodology by situating their reflection on practice within a critical discourse whereby reframing has been important in learning through a reconsideration from particular critical incidents in their high school science teaching experiences. The authors argue that through critical reflection on practice, as illustrated in this paper, that the beginnings of the articulation and documentation of a …

Building A Typology Of Self-Renewal: Reflection Upon-Life Story Research, Izhar Oplatka Dec 2001

Building A Typology Of Self-Renewal: Reflection Upon-Life Story Research, Izhar Oplatka

The Qualitative Report

The current paper provides a researcher's account of the life-story method used in a study which aimed to identify patterns of the self-renewal process among women school principals in mid-career. The subjects of this study were 25 elementary school women principals aged between 43 and 52 in Israel. The paper outlines the practical aspects of the life-story method and contributes to our understanding of the consecutive pragmatic ways to implement a life-story method aimed to explore and develop a typology of a yet unknown phenomenon. Further, the ethical implications of doing life-story interview are discussed and presented.

The Impact Of Dismissal Of Non-Tenured Teachers On Principals In Tennessee., David W. Messer Dec 2001

The Impact Of Dismissal Of Non-Tenured Teachers On Principals In Tennessee., David W. Messer

Electronic Theses and Dissertations

The purpose of this study was to examine the issues that principals face in making the decision or recommendation to bring about the involuntary separation of non-tenured teachers. I was concerned with identifying the emotions, feelings, conflicts, and misgivings that principals experience during this process. Related concerns were identified. They included the issues of principals using professionally ethical ways to encourage or coach teachers to resign prior to dismissal, dealing with "lame duck" teachers between notification and the end of the school year, and writing positive letters of recommendation for teachers they have decided not to renew. These questions were …

Language, Vagueness, And Social Communication, Colin B. Grant Dec 2001

Language, Vagueness, And Social Communication, Colin B. Grant

CLCWeb: Comparative Literature and Culture

In his paper, "Language, Vagueness, and Social Communication," Colin B. Grant adopts an interdisciplinary approach to an interrelated complex of language, communication, and society. Grant operates with a modified concept of vagueness as a pragmatic property and attempts to establish a link between pragmatic vagueness and contingency in communication. This communicative contingency takes the form of improbabilities (entropy). Grant observes that the challenge lies in modelling communication as porous networks which nonetheless enable society to function. In this sense, contingency in communication must not be confused with arbitrariness just as cognitive closure cannot be confused with solipsism. This line of …
