Empowering students to take control to lead functional and fulfilling lives should help them meet their needs for power and belonging, and enable them to realise their social goals. Such an outcome should positively affect students' achievement motivation. However, there is little understanding and research on the construct of student empowerment particularly in the primary school context from the teacher and student perspective. The MFA Thesis Exhibition is a presentation of ceramic sculpture. The theme for this body of work is a self-portrait that uses text as an integral part of the composition. The medium is clay, which interacts with the two-dimensional and three-dimensional properties of space. Therefore, it is my goal to establish a union with these dimensional properties. My tablet paintings serve to catalog significant events affecting both our culture and my life, resulting in a self-portrait. The question for this issue is gender issues in the American Law Institute’s Principles of the Law of Family Dissolution. Overall, the Principles are an impressive effort to create clarity and coherence, given the disorganized and evolving state of family law. This commentary raises a few questions about the Principles’ treatment of nonfinancial issues, and suggests that this treatment should raise concerns about women’s interests upon divorce. First, I will briefly review the ALI’s position on nonfinancial matters. The legal focal point of familial obligation in the United States has long been the relationship between paired adults-most centrally marriage. Obligations to children, and rights to their company, were derivative; they were to be met through the framework of the all-important pairing of adults. The themes of incursion and boundary-crossing unite disparate legal domains. Wherever human beings cross paths and share space, law or law-like traditions develop to regulate this terrain by distinguishing permitted from proscribed intrusion.' Crimes and torts, regulation and liability, claims and defenses to claims, private law and public law all use a variety of measures--punishments, administrative rules, equitable remedies, professional discipline, and informal or extralegal sanctions-to condemn undue aggression. Much has been written about theory and practice in the law, and the tension between practitioners and theorists. Judges do not cite theoretical articles often; they rarely "apply" theories to particular cases. These arguments are not revisited. Instead the Essay explores the working and interaction of theory and practice, practitioners and theorists.

The Essay starts with a story about solving a legal issue using our intellectual tools - theory, practice, and their progenies: experience and "gut." Quality Control, Enterprise Liability, And Disintermediation In Managed Care, John V. Jacobi, Nicole Huberfeld

The authors examine the potential of enterprise liability for managed care organizations in light of current health-care finance realities. They conclude that, despite the recent trend toward more loosely structured managed care organizations, such as disintermediated or patient-directed plans, plan-based enterprise liability best serves the goal of reducing medical injury by permitting a focus on entities with sufficient scope to translate liability pressure into support for systemic risk-reduction measures. Advancing plan-based enterprise liability in an era of disengaged managed care organizations will require an extension of tort liability to firms with little control but much influence over their business partners.

The Cambodia Project: During 2000-2001, The Future Group launched its inaugural project in Southeast Asia to address child sex slavery and trafficking. For nearly one-hundred days, a deployment team of four worked with local organizations in Cambodia to implement new ideas to help the children affected by this crisis of international proportions. Initially, The Future Group had planned to work to implement five projects in Cambodia. After just three weeks, the deployment team was significantly ahead of schedule and began to actively identify new areas to pursue. Death disrupts. The social space accorded to rituals of death and memorialization differs from all other spaces. Actresses disturb. Society contests, determines, and enacts the burial of an actress as her final performance. This study explores the actress burial as a site of meaning. Contestations over the fate of the actress body reveal power structures and the motivations of cultural institutions. This study highlights four actresses—Lecouvreur, Oldfield, Bernhardt, and Duse—whose burials cover a wide range of circumstances. An ubiquitous assumption about food intake behavior is that people eat the types of foods that they crave and prefer. Food preferences reflect hedonic ratings of the degree to which people like certain foods. The present study investigated the association of food cravings and hedonic ratings with food intake behavior, assessed in the laboratory with a Universal Eating Monitor (Kissileff, Klingsberg, & Van Itallie, 1980). The study sample consisted of 162 adults who completed the Food Craving Inventory (FCI; White, Whisenhunt, Williamson, Greenway, & Netemeyer, 2001), a questionnaire that measures craving, including cravings for specific types of foods (i.e., High …

The First Amendment is often analyzed using the metaphor of the marketplace of ideas. Making use of memetic analysis, this article suggests that ideas should not be treated as inert products that we choose but as living things that sometimes exert some influence over their environment. Some of the ideas are more adept at surviving than others, and the ones that survive will not necessarily be good for humans. Extinguishing Inheritance Rights: California Breaks New Ground In The Fight Against Elder Abuse But Fails To Build An Effective Foundation, Kymberleigh N. Korpus

This Note examines the elder abuse problem in the United States by describing: state responses to its "discovery" in the late 1970s as well as the debilitating reliance upon reporting; the currently available remedies and the hurdles to using those remedies; the ethical challenges to the states' primary abuse prevention tools, and the dramatic explosion in elder abuse that is already underway. Then, this Note describes American descent doctrines, and philosophies underlying exceptions to the doctrinal testamentary freedom and value-neutrality of intestate succession statutes. A Descriptive Survey Of Social Skills Training Practices For Preschool Children With Special Needs In Indiana, Carol Anne Mclean

A statewide mail survey of specialEducation preschool teachers (N = 370, return rate of 51%) in Indiana was conducted to gather descriptive information about social skills training practices. Reported practices were compared to recommended practices from the theoretical literature. Results indicated a lack of formal training of teachers, lack of curriculum selection guidelines, lack of systematic assessment and intervention programs, and a lack of individualization of social skill training goals. Practices consistent with the theoretical literature were revealed including working with teams to develop IEP social skill goals, prioritizing social skills training activities, and effective use of observation assessment methods, …
