Investigating Determinants Of Macular Pigment Optical Density And Macular Pigment Distribution In Adults Aged 45--73: Can Enhanced Analytical Techniques Improve The Ability To Predict Macular Pigment Status?, Joanne Delaney Burke
Doctoral Dissertations
This research assessed the relationships of dietary, sex, and biochemical factors to macular pigment optical density (MPOD) and macular pigment (MP) distribution in 108 adults. Dietary assessment tools were evaluated for their ability to predict MP status. Macular pigment was assessed at four foveal sites and one parafoveal site. An average composite macular pigment value (CMPV) was calculated based on the MPOD results. Group mean MPOD results from most to least central retinal locations, were 0.43 (SE +/- 0.017), 0.36 (SE +/- 0.013), 0.28 (SE +/- 0.012), and 0.13 (SE +/- 0.008), respectively. The CMTV was 0.26 (SE +/- 0.0 …

Braking The Merger Momentum: Reforming Corporate Law Governing Mega-Mergers, James A. Fanto
Buffalo Law Review
This Article articulates a legal reform that is designed to rein in the number of value-decreasing stock-for-stock megamergers-the signature transaction of the 1990s and the beginning years of the new millennium-by causing board members to question more critically a mega-merger proposal when they are asked to approve it and even to continue to reevaluate their approval of a merger until its closing. The Article first describes the current merger wave and highlights reports of emerging problems in mega-mergers and the relevant economic data indicating that a majority of the transactions are value-decreasing for shareholders both in the short and long …

Defining Terrorism As The Peace Time Equivalent Of War Crimes: A Case Of Too Much Convergence Between International Humanitarian Law And International Criminal Law, Michael P. Scharf
Defining Terrorism As The Peace Time Equivalent Of War Crimes: A Case Of Too Much Convergence Between International Humanitarian Law And International Criminal Law, Michael P. Scharf
Faculty Publications
The problem of defining "terrorism" has vexed the international community for years. The United Nations General Assembly has repeatedly called for the convening of an international conference to define terrorism and distinguish it from legitimate acts in furtherance of national liberation struggles.' A decade ago, representing the United States, I gave a speech in the United Nations Sixth (Legal) Committee, in which I pointed out that general definitions of terrorism "are notoriously difficult to achieve and dangerous in what all but the most perfect of definitions excludes by chance." Today, we hear calls for a renewed effort to reach international …

Not Interaction But Melding - The "Russian Dressing" Theory Of Emotions: An Explanation Of The Phenomenology Of Emotions And Rationality With Suggested Related Maxims For Judges And Other Legal Decision Makers, Peter Brandon Bayer
Scholarly Works
Even after centuries of contrary philosophy and psychology, many commentators, jurisprudes, and law makers insist that emotions have no legitimate place in most legal decision making. This recalcitrance, of course, is misplaced in light of the powerful body of theory explaining that without emotions, decisions, including matters of law and policy, simply cannot be made. Judges, along with all societal actors, must disabuse themselves of the fallacious belief that emotions obstruct or obscure reason in all endeavors, particularly morality, law, and justice.
The project of truly apprehending emotions, however, requires more than appreciating that they play a crucial role in …

Child Care For Families Leaving Temporary Assistance For Needy Families, Rebecca L. Scharf, Sujatha Jagadeesh Branch, Cynthia Godsoe, Sherry Leiwant, Roslyn Powell, Cary Lacheen
Scholarly Works
Since Temporary Assistance for Needy Families (TANF) replaced the Aid to Families with Dependent Children program in 1996, the welfare rolls have decreased by more than 40 percent. While unemployment and poverty rates have declined, families who leave welfare generally earn low wages and remain below the poverty level. Because families leaving welfare are mostly single mothers with young children, child care is critical to their ability to work outside the home. Low-income parents trying to make ends meet, as well as employers of low-wage workers, emphasize the importance of appropriate, affordable child care in enabling women who leave welfare …

Dr. Howard Snyder’s article on “New Wineskins: With What Materials?” focuses on developing “A Theology of New Wineskins for the 21st Century.” In his thoughtful article, he demonstrates his skill at historical reflection as he points to helpful and unhelpful places to develop our ecclesiology.
The Inner Game Of Teaching: What Is It And How Can It Make Us Better Teachers, Michael Schulist
The Inner Game Of Teaching: What Is It And How Can It Make Us Better Teachers, Michael Schulist
Education | Print Theses
The inner lives of teachers was researched and studied. Three key questions were the focus: 1) What is a mental peak performance state in teaching? 2) What is the value of achieving this state? 3) How can teachers attain peak performance states? Peak performance states are described as “a higher mental state” where teachers are motivated intrinsically; in this state, they are described as being “undivided”, their ‘truest selves”. Research shows that teachers are more effective when they achieve peak performance states in the classroom. Self- awareness and development of positive thought patterns are necessary skills for achieving optimum mental …

Effects Of Reading Disability In Adolescents On Self-Concept And Future Expectations, Miriam I. Meyer
Effects Of Reading Disability In Adolescents On Self-Concept And Future Expectations, Miriam I. Meyer
Open Access Dissertations
This study investigated whether reading problems affect adolescents' self-concept and examined adolescent opinions regarding the consequences of reading ability. Three groups of adolescents participated: 68 special education students (SE), 41 regular education poor readers (REP), and 164 regular education students (RE). Two surveys were administered to the participants, the Multidimensional Self Concept Scale (MSCS) and the Meyer Reading Opinion Survey (MROS), along with standardized measures of reading ability and intelligence.
Results indicated that on the MSCS, RE students had significantly higher academic self-concept than REP and SE students; differences were not noted between the latter two groups. RE students also …
The Electronic Fishbowl As A Community Of Inquiry: Management Passion In The Xxist Century, Matthew Eriksen
The Electronic Fishbowl As A Community Of Inquiry: Management Passion In The Xxist Century, Matthew Eriksen
Open Access Dissertations
This dissertation presents a new pedagogy called the Fishbowl that employs experiential learning based on reflection (Dewey, 1928, Rodgers, 1969, Schön, 1983, Torbert, 1973, 1976, 1991, Siebert & Daudelin, 1999), learning cells (Goldschmid, 1970 & 1971), and the fishbowl technique (Villalba, Lemmond, & Baymiller, 1998). It is an attempt to create a community of inquiry. The question addressed is what cognitive characteristics, communication skills, and affective characteristics of learners are related to learner satisfaction with the Fishbowl pedagogy. Communication factors are taken into consideration because the Fishbowl is a cooperative form of learning and it represents a novel communication episode. …
Death And Identity: Consumer Behavior In Asante Death Rituals, Samuel Kwaku Bonsu
Death And Identity: Consumer Behavior In Asante Death Rituals, Samuel Kwaku Bonsu
Open Access Dissertations
Poorer societies have been ignored in scholarly dialogue on consumer behavior and consumption. The globalization of markets and consumption makes it imperative for marketing and consumer researchers to pay attention to these societies. This dissertation, therefore, explored the dynamics of consumer product decisions and how choices are used by the bereaved to negotiate identities for themselves and the deceased among the Asante people of Ghana. The study focused on the increasingly important role of the ritualized consumption of death ritual products among the Asante people of Ghana. West Africa, and examined the socio-cultural sources of influence on death product choices …

Dialogue In The Development Of A Consilience Index: A Quantum Approach To Integrating Qualitative And Quantitative Practices In The Social Sciences, Kathleen S. Cady-Webster
Open Access Dissertations
The social sciences are seeking expanded methodological models that go beyond significance testing for the assessment of theoretical efficacy (Cohen, 1984; Harlow, Muliak & Steiger, 1997; Meehl, 1997). Faust and Meehl (1992) contend that the social sciences are lacking in the integration of data, while Miller and Burbank, (1994) call for models that offer congruency in theory and practice. In response, this dissertation presents an ontological model that embraces the epistemological views of both quantitative and qualitative researchers. It builds on a previous longitudinal study (Webster, 2000) involving outcomes for 32 juvenile delinquents in Alaska. Results from a qualitative thematic …

Development, Validation And Factorial Invariance Of Transtheoretical Model Measures For Recovery From Anorexia Nervosa And Bulimia Nervosa, Patricia Janet Jordan
Open Access Dissertations
The purpose of this study was to advance understanding of the self-change process in recovery from anorexia nervosa (AN) and bulimia nervosa (BN) through: (a) development of a staging instrument for recovery from BN; (b) development of TTM-based measures, including decisional balance, self-efficacy, and processes of change; (c) invariance testing of these measures across AN and BN subsamples; and (d) characteristic description of individuals at each stage of change. The sample (N = 427) was composed of AN subgroup (n = 278) and BN subgroup (n = 149) who completed questionnaires measuring all constructs of the TTM, as well as …

The Speed Of Money: Investment As Consumption In Age Of Computer-Mediated Communication, Detlev Zwick
Open Access Dissertations
Using the tools of interpretive consumer research my dissertation explores individual online investing in stocks and mutual funds. Investing in the stock market means more to the individual than the pursuit of a rational financial strategy. Approaches to study investment behavior developed by disciplines such as finance and economics have produced subject-specific but from a marketing perspective empty knowledge. An analysis informed by marketing and consumer theories is able to construe investing as consuming and bring into being a richer and more contextualized description of the lived experience of online investing. Based on a hermeneutic reading of 30 in-depth one-on-one …
The Relationship Between A Sense Of Community And Social Disorganization And Neighborhood Deprivation, Sharon Kingston
The Relationship Between A Sense Of Community And Social Disorganization And Neighborhood Deprivation, Sharon Kingston
Open Access Dissertations
Empirical work on conditions in economically deprived neighborhoods, suggest that neighborhood conditions can exert negative effects human development even after accounting for individual characteristics of neighborhood residents. One of the most important theories regarding the ways in which neighborhood conditions impact behavior is the theory of social disorganization. Social disorganization posits that poverty and disorganizing social conditions interfere with the ability of neighborhood residents to form and enforce common social norms, leading to social problems (Byrne & Sampson, 1993, Sampson & Groves, 1989). Despite the utility of theories such as social disorganization, the measurement of important mediating variables between structural …

I Know That I Taught Them How To Do That, Laurel Oates
Faculty Articles
Teachers have complained for years that students could not transfer their skills from one class to another, and employers have complained that the students could not apply the skills they learned in class to real world tasks. This article delves into the issues involved in students acquiring skills and the ability to transfer those to skills to similar tasks. The article describes the four steps involved in transfer identified by researchers: problem representation, search and retrieval, mapping, and application.

The Cycles Of Statutory Interpretation, Adrian Vermeule
The Cycles Of Statutory Interpretation, Adrian Vermeule
University of Chicago Law Review
This Article advances an explanation of interpretive change--the fact that the Supreme Court frequently changes the nominal formulation of its rules for statutory interpretation, and to some degree changes its actual interpretive practice as well. The prevailing styles of explanation attribute interpretive change to exogenous shocks such as a change in the party composition of the legislature or a string of judicial appointments. The Article criticizes the exogenous explanatory style on methodological grounds, and advances an alternative model that attributes interpretive change to endogenous shifts in the expectations of actors in the interpretive system. In particular, the Article develops a …
