Marriage Proposals: From One-Size-Fits-All To Postmodern Marriage Law, Barbara Stark Oct 2001

Marriage Proposals: From One-Size-Fits-All To Postmodern Marriage Law, Barbara Stark

Hofstra Law Faculty Scholarship

Before they marry, few couples have any real alternative to one-size-fits-all marriage. Expectations are often very different, however, not only among different couples but between the partners in a particular couple as well. Because these different expectations are rarely explicit, they are rarely addressed. During the marriage, similarly, the law neither reflects nor accommodates the partners' diverse experiences. There are no legal mechanisms for realizing their hopes or cushioning their disappointments. Rather, the parties are left to "work things out" through endless negotiations and compromises. If we as a society value marriage, and want marriage to succeed, we should provide …

Attorney Fact-Finding, Ethical Decision-Making And The Methodology Of Law, Robert Rubinson Oct 2001

Attorney Fact-Finding, Ethical Decision-Making And The Methodology Of Law, Robert Rubinson

All Faculty Scholarship

This Article explores the significance, challenges, and complexities of attorney fact-finding in ethical decision-making. Almost all discourse about legal ethics, from the pedagogical to the scholarly to the practical, takes facts for granted in order to focus on issues about ethical rules. The factual dimension of ethical decision-making, however, is critical to the decision-making process and can be subjected to rigorous and systematic study. Indeed, it is lawyers in a situation who engage in ethical decision-making, and such a situation entails the assimilation and interpretation of many sources of information. Such a process necessarily includes the motivations and ambivalence of …

Business Lawyer, Woman Warrior: An Allegory Of Feminine And Masculine Theories, Barbara Ann White Oct 2001

Business Lawyer, Woman Warrior: An Allegory Of Feminine And Masculine Theories, Barbara Ann White

All Faculty Scholarship

The first part of this essay is a discourse on how two of the last half century’s most influential contributions to legal thinking: Law and Economics Jurisprudence and Feminist Legal Theory, whose adherents are normally adversaries, can function synergistically to create a greater analytic power. Using business law issues as an example - historically law and economics’ terrain but recently explored by feminism - I comment on how each can unravel different knots but each standing alone leave other conundrums unresolved.

Expanding on the feminist concept of “masculine thinking,” I discuss how, just as law and economics’ analytic style (i.e., …

A Disjunction Between Personal, Professional And Societal Values In Pre-Service Teacher Education, Peter Reynolds Oct 2001

A Disjunction Between Personal, Professional And Societal Values In Pre-Service Teacher Education, Peter Reynolds

Australian Journal of Teacher Education

Following the development of the Common and Agreed National Goals for Schooling (Australian Education Council, 1989) the Western Australian Curriculum Council was established and it has subsequently developed a Curriculum Framework for eight learning areas as well as for the values identified as implicit within those learning areas and within the governance of schools (Curriculum Council, 1998). These values have been called the shared core values of Australian society. Within the context of an analysis of these values, this paper presents the findings from a survey of the personal and the perceived societal values of Australia held by a sample …

An Examination Of Rural Recycling Drop-Off Participation, Thomas W. Blaine, Kimberly D. Mascarella, Deanna N. Davis Oct 2001

An Examination Of Rural Recycling Drop-Off Participation, Thomas W. Blaine, Kimberly D. Mascarella, Deanna N. Davis

Journal of Extension

Recycling education programs have constituted an important component of Extension outreach in the past decade. The study reported here used a two-stage statistical modeling procedure to predict the characteristics of residents who participate in a recycling program and to explain frequency of visiting the drop-off sites. The results reveal that older respondents in large households in more remote sections of the community are more likely to use the drop-off centers than others. Those participants who show more satisfaction with the convenience and quality of the drop-off sites visit more frequently. An unintentional consequence was a spirited competition among the seven …

Soldiers In Cities: Military Operations On Urban Terrain, Michael Desch Dr. Oct 2001

Soldiers In Cities: Military Operations On Urban Terrain, Michael Desch Dr.

Books, Monographs & Collaborative Studies

In the past half-century, the classic military conflict of armies maneuvering in the field has been replaced by conflicts that center on, rather than avoid, heavily populated areas. Modern military conflict more frequently is not just a fight to control villages or cities, but a variation on the timeless wish to control populations and the hearts of nations. The hardware and mass orientation of the levee en masse and industrial-age armies is being replaced by sophisticated terrorists, information warfare, and the politics of mass persuasion. These are reshaping the face of warfare. This book focuses on identifying the lessons of …

The Empire Of The Lone Mother: Parental Rights, Child Welfare Law, And State Restructuring, Hester Lessard Oct 2001

The Empire Of The Lone Mother: Parental Rights, Child Welfare Law, And State Restructuring, Hester Lessard

Osgoode Hall Law Journal

This article uses the Supreme Court of Canada's decision in G.(J.) v. New Brunswick to frame a discussion of the historical and ideological character of Canadian child welfare regimes on the nature and experience of women’s citizenship within the liberal political order and, in particular, within the current neo-liberal restructuring of welfare provision. The article also analyzes traditional understandings of the political character of child welfare in terms of state intervention and non-intervention, by placing the state ordering of parent-child relations in the context of larger issues of colonialism, gendered parenting discourses, and the linkage between child neglect and poverty. …

Beyond Conception: Legal Determinations Of Filiation In The Context Of Assisted Reproductive Technologies, Roxanne Mykitiuk Oct 2001

Beyond Conception: Legal Determinations Of Filiation In The Context Of Assisted Reproductive Technologies, Roxanne Mykitiuk

Osgoode Hall Law Journal

This article argues that legal determinations of filiation are normative ideological constructions about how societal relations between parents and children should be ordered. They am based upon particular understandings of the relationship between biological and social facts and, as this article demonstrates, operate to create an asymmetrical relationship between the categories between paternity and maternity I suggest that fairly recent developments in reproductive and genetic filiation have been made and offer the potential for an expanded understanding of relatedness or kinship which does not take the two-parent-one of each sex-model of the family as its normative form. While the examples …

What Constitutes Becoming Experienced In Teaching And Learning?, James C. Field, Margaret A. Macintyre Latta Oct 2001

What Constitutes Becoming Experienced In Teaching And Learning?, James C. Field, Margaret A. Macintyre Latta

Department of Teaching, Learning, and Teacher Education: Faculty Publications

In this paper, we attempt to address one of the central questions for teachers and teaching: how is it that teachers are able to see and act appropriately in concrete circumstances? To do so, we examine the ontological meaning of experience in teacher education. The discussion is anchored in the concrete particulars of a grade 5 art lesson. Our intent is to show the dynamic processes involved in becoming experienced as a teacher and to draw connections between experience and practical wisdom (phronesis). Thus, we argue that phronesis is not so much a form of knowledge as it is dynamic …

Film Depictions Of Judas, Kim Paffenroth Oct 2001

Film Depictions Of Judas, Kim Paffenroth

Journal of Religion & Film

This article analyzes the depiction of Judas in the seven best-known Jesus films. Perhaps surprisingly, all the depictions are positive, on the one hand breaking with centuries of traditions that depicted Judas as the basest of villains, but on the other, following a persistent minority tradition that portrayed him sympathetically.

Robert Zemeckis's Contact As A Late-Twentieth Century Paradiso, Gregory M. Sadlek Oct 2001

Robert Zemeckis's Contact As A Late-Twentieth Century Paradiso, Gregory M. Sadlek

Journal of Religion & Film

The film Contact employs a plot and literary motifs that are in many ways parallel to those in Dante's Paradiso. Although the film's philosophical and theological content has received mixed reviews, the film has deep significance because it not only seeks to convey a religious experience but also offers a kind of existential consolation similar to that offered by Dante. This is true even though the film is grounded in a vision of the numinous that is congruent not with the Dante's cosmos but with late twentieth-century science and cosmology. Contact, then, is a Dantean film that can …

The Emerging Reference Paradigm: A Vision Of Reference Services In A Complex Information Environment, Scott Mandernack, John W. Fritch Oct 2001

The Emerging Reference Paradigm: A Vision Of Reference Services In A Complex Information Environment, Scott Mandernack, John W. Fritch

Library Faculty Research and Publications

The emerging reference paradigm in a complex, technologically rich information environment tends toward a more deliberate blending of the conservative and liberal philosophies of reference. As key agents in the advancement of society and culture, librarians must recognize the value of community and the social context of information in providing services that support and enhance the full range of contemporary user needs.
