Tort Recovery For Loss Of A Chance, David A. Fischer Oct 2001

Tort Recovery For Loss Of A Chance, David A. Fischer

Faculty Publications

Tort lawyers in the United States often think of “loss of a chance” as a theory of “probabilistic causation” that only applies to medical malpractice misdiagnosis cases. The theory is that if a physician negligently fails to diagnose a curable disease, and the patient is harmed by the disease, the physician should be liable for causing the “loss of a chance” of a cure. We shall see that if the chance of a cure is less than 50 percent, the plaintiff cannot prove by a preponderance of evidence that the negligence caused the harm, and would recover no damages under …

Swosu Fact Book Fall 2001, Denisa Engelman

Fact Books

I am proud to introduce the tenth annual Southwestern Oklahoma State University Fact Book. It provides a ready source of information to answer frequently asked questions about the University and its operations. Unless otherwise noted, the information in this Fact Book came from computer-generated reports that are printed following the tenth class day of each fall semester. Because of student fluctuations during the semester, numbers will not match other published enrollment numbers that may be based on enrollment at the end of a semester.

Faith And Health: What Do We Know?, Thomas G. Plante Oct 2001

Faith And Health: What Do We Know?, Thomas G. Plante

Psychology

There has been a great deal of interest in the relationship between religious faith and health for thousands of years. Regardless of religious tradition, many have sought religious guidance and spiritual support to help prevent, recover from, or cope with both mental and physical health problems. In fact, it was the healing miracles of Jesus that resulted in so much commotion during the early part of his ministry. "The blind see, the deaf hear, the lame walk…" clearly highlights the relationship between faith and health.

Understanding Attention Deficit Hyperactivity Disorder And Developing Successful Interventions For The Classroom, Amanda Dawn Newman Oct 2001

Understanding Attention Deficit Hyperactivity Disorder And Developing Successful Interventions For The Classroom, Amanda Dawn Newman

Senior Honors Theses

Previously an abundant amount of research has been undertaken concerning interventions that should or should not be used for the treatment of Attention-Deficit Hyperactivity-Disorder. The problem with prescribing and implementing interventions lies in the controversies that surround them. The number one controversy surrounds the issue of whether or not stimulant medication, commonly Ritalin, should be used as an intervention. A literature-based research approach and original research in the form of a survey and subsequent observations were used to discover whether stimulant medication should be used within the classroom and what forms of classroom interventions and modifications teachers and researchers are …

Early Language Learning With And Without Music, Douglas Fisher Oct 2001

Early Language Learning With And Without Music, Douglas Fisher

Reading Horizons: A Journal of Literacy and Language Arts

Eighty students who spoke Spanish at home were randomly assigned one of four teachers. Two of the teachers used a great deal of music in their classrooms while the other two did not. The students and their teachers remained together for two years - kindergarten and first grade. Literacy achievement data suggests that music had a positive effect on oral language and reading scores. Differences focused on the use of music for morning opening, music and signing while working with words, and the use of music during listening stations.

Behind The Arabesque: Understanding Islamic Art And Architecture, Cynthia Finlayson Oct 2001

Behind The Arabesque: Understanding Islamic Art And Architecture, Cynthia Finlayson

BYU Studies

God is the light of the heavens and the earth. A likeness of His light is as a pillar on which is a lamp—the lamp is in a glass, the glass is as it were a brightly shining star—lit from a blessed olive-tree, neither eastern nor western, the oil whereof gives light, though fire touch it not—light upon light. God guides to His light whom He pleases. And God sets forth parables for men, and God is Knower of all things.

—Qur'an 24:35

Toward A Community Of Professionalism, Elliot L. Bien Oct 2001

Toward A Community Of Professionalism, Elliot L. Bien

The Journal of Appellate Practice and Process

Professionalism amongst American litigators has declined. Many jurisdictions have adopted codes of conduct in order to restore professionalism. These attempts have done little to restore professionalism. Similar adversarial systems, like England's, are admired for their professionalism. What creates this value amongst barristers is a sense of community. A similar practice should be adopted in the United States in order to restore a sense of professionalism in litigation.

The Politics Of Bush V. Gore, Evan Tsen Lee

The Journal of Appellate Practice and Process

Critical Legal Studies ("the Crits") burst onto the law school scene in the mid-1970s. The Crits believe that "all law is politics." The Crits lost their momentum by the 1990s. The case Bush v. Gore has forced many to believe that all law is in fact politics.
