Uniform Computer Information Transactions Act: Bringing Commercial Law Into The 21st Century, Richard L. Grier, Nancyellen Keane, Peter A. Gilbert Jan 2001

Uniform Computer Information Transactions Act: Bringing Commercial Law Into The 21st Century, Richard L. Grier, Nancyellen Keane, Peter A. Gilbert

Richmond Journal of Law & Technology

The e-commerce revolution has redefined the way business is transacted everywhere. Meanwhile, the body of commercial law lags behind the fast pace of technological changes and has yet to effectively address the numerous issues presented by radical changes in the world of commerce such as electronic contracts, electronic signatures, shrinkwrap agreements, and click-wrap agreements. In an effort to establish the Commonwealth of Virginia as a national leader on this subject, in 2000 the Virginia General Assembly passed the Uniform Computer Information Transactions Act ("UCITA"). UCITA legislation has been introduced in a handful of other states but the only other state …

Petitions For Life: Executive Clemency In Missouri Death Penalty Cases, Cathleen Burnett Jan 2001

Petitions For Life: Executive Clemency In Missouri Death Penalty Cases, Cathleen Burnett

Richmond Journal of Law and the Public Interest

The thesis of this article is that low reversal rates mean serious errors are not being detected and corrected. The research will focus on Missouri, which has very low reversal rates of 15% in federal court and 20% in state court. The data to address this question comes from the clemency petitions submitted to the governor as the last step in the process of executing the death penalty. These petitions illustrate the range and magnitude of the claims of legal problems in one state. The clemency petitions provide the most complete and full statement of the condemned's case, because these …

Public Executions In America Should Death Row Inmates Be Able To Choose Between Private And Public Death, Nicholas Compton

Richmond Journal of Law and the Public Interest

On June 13, 1997, Timothy McVeigh was sentenced to death for the bombing of the Alfred P. Murrah Federal Building in Oklahoma City on April 19,1995. The bombing resulted in the deaths of 168 people and the wounding of over 500 more. McVeigh successfully petitioned U.S. District Court Judge Richard Matsch to put an end to his appeals and expedite his execution. At midnight on February 16, 2001 McVeigh let pass his deadline to petition President George W. Bush for clemency. He is scheduled to die by lethal injection on May 16, 2001 at the federal penitentiary in Terre Haute, …

Through The Looking Glass Of Teaching: The Death Penalty And The Political Culture Of Detached Passions, Adelaide H. Villmoare Jan 2001

Through The Looking Glass Of Teaching: The Death Penalty And The Political Culture Of Detached Passions, Adelaide H. Villmoare

Richmond Journal of Law and the Public Interest

Today, despite daily struggles in courtrooms against capital punishment, there appears little legal room to challenge the death penalty. Most constitutional questions appear "settled. Given the present composition of the Supreme Court, there is scant expectation of any major reversals. Also, the Court's future is to be decided by a President who was governor of a state that has executed more people since 1976 than any other state in the nation. While abolitionist scholars and activists continue to raise constitutional issues, the most dramatic events challenging the death penalty have occurred in the larger political arena outside the courtroom. The …

Migration And Radicalization: Global Futures, Gabriel Rubin Jan 2001

Migration And Radicalization: Global Futures, Gabriel Rubin

Department of Justice Studies Faculty Scholarship and Creative Works

This book explores the connections between migration and terrorism and extrapolates, with the help of current research and case studies, what the future may hold for both issues. Migration and Radicalization: Global Futures looks at how migrants and terrorists have both been treated as Others outside the body politic, how growing migrant flows borne of a rickety state system cause both natives and migrants to turn violent, and how terrorist radicalization and tensions between natives and migrants can be reduced. As he contemplates potential global futures in the light of migration and radicalization, Gabriel Rubin charts a course between contemporary …

Real-Time Determination Of Soil Type, Water Content, And Density Using Electromagnetics, Vincent P. Drnevich, Chih-Ping Lin, Quanghee Yi, Janet Elaine Lovell Jan 2001

Real-Time Determination Of Soil Type, Water Content, And Density Using Electromagnetics, Vincent P. Drnevich, Chih-Ping Lin, Quanghee Yi, Janet Elaine Lovell

JTRP Technical Reports

The primary objective of this study was to explore the potential use of electromagnetic characteristics of soils using the Time Domain Reflectometry (TDR) technique to identify physical properties of soils. Three fundamental studies in this exploration are the frequencydependent electromagnetic properties of soils, the wave propagation in a TDR system, and the inverse analyses of TDR waveforms. The three-phase model for soils was extended to a four-phase model so as to account for the interface effect and hence the soil fineness. The physical parameters of the four-phase model are related to the frequency-dependent dielectric permitivity of the soil through a …

Planet Asian America, Mari J. Matsuda Jan 2001

Planet Asian America, Mari J. Matsuda

Georgetown Law Faculty Publications and Other Works

In forming the Asian Law Caucus, the elders - some of whom are here in this room - chose resistance. They created a space in which Asian Americans were in charge, deciding what mattered to them and what strategies worked for them. If someone else were in charge, things would have gone differently. Risks were taken, and victories were won that would not have happened using traditional litigation strategies or leaving the work to traditional civil rights organizations. It was important to create an Asian American space to do this work: to fight Chinatown evictions, to pursue redress for the …

Patent Scope And Innovation In The Software Industry, Julie E. Cohen, Mark A. Lemley Jan 2001

Patent Scope And Innovation In The Software Industry, Julie E. Cohen, Mark A. Lemley

Georgetown Law Faculty Publications and Other Works

Software patents have received a great deal of attention in the academic literature. Unfortunately, most of that attention has been devoted to the problem of whether software is or should be patentable subject matter. With roughly eighty thousand software patents already issued, and the Federal Circuit endorsing patentability without qualification, those questions are for the history books. The more pressing questions now concern the scope to be accorded software patents. In this Article, we examine the implications of some traditional patent law doctrines for innovation in the software industry. We argue that patent law needs some refinement if it is …

Burakin Focus Catchment Report, Mike Clarke Jan 2001

Burakin Focus Catchment Report, Mike Clarke

Natural resources published reports

The Burakin Focus Catchment Project was developed between farmers and Agriculture _ Western Australia. The project was designed to give farmers an understanding of the salinity processes occurring within the Catchment and suggestions on appropriate management.

Work began in the Catchment early in 1999 and was complete at the end of 2000. Intensive hydrological investigations formed the basis of the study, which was complemented by surface water control and revegetation strategies. Agronomic issues associated with sandplain soils were raised by the farmers at the initial meeting and this led to a soil survey to determine the pH status of the …

Farming Systems To Manage Salinity. Farmer Directed Research, Development And Extension. Research Results 2001, Richard Olive

Natural resources published reports

More and more of Western Australia's agnicultural lands are becoming saline. Currently it is estimated that about 18 milliion ha of land are affected to a greater or lesser degree by salinity causing production losses estimated at about $70 million a year.

Unless ways are found to halt and reverse the salinisation of land it is estimated that another 4.4 million ha could become saline over the next 50 years.

Grain growers and the Federal Government, through the Grains Research and Development Corporation (GRDC). are investing $12 4 million in R&D across Australia to develop productive solutions to the salinity …

International Criminal Justice From Paper To Practice - A Contribution From The International Criminal Tribunal For Rwanda To The Establishment Of The International Criminal Court, Adama Dieng Jan 2001

International Criminal Justice From Paper To Practice - A Contribution From The International Criminal Tribunal For Rwanda To The Establishment Of The International Criminal Court, Adama Dieng

Fordham International Law Journal

The international society's pursuit of international criminal justice entails the creation of a stateless jurisdiction with international scope that holds individuals, rather than States, responsible. As the institutions mandated to exercise international criminal jurisdiction begin to develop their operations, it becomes clear that the execution of justice entails a wide range of policy decisions normally undertaken by the State, in terms of legal aid, policing, education, and information, to mention but a few areas. The International Criminal Court may draw upon the wealth of operational experience of the Tribunals in these areas, but will nonetheless continue to develop its own …

The International Criminal Court: Alive, Soon Kicking!, Harry Verwij

Fordham International Law Journal

In this brief essay, I will give an overview of my insights as to what urgent practical steps need to be taken by the Preparatory Commission ("Prepcom"), the Assembly of States Parties ("ASP"), and the Host State, the Netherlands, in order to guarantee the early establishment of the Court. I assume that my readers have a high level of understanding of the Rome Statute, the Prepcom, and other related documents.

The Draft Budget For The First Financial Period Of The Court , Rolf Einar Fife

Fordham International Law Journal

The preparatory work before the entry into force of the Rome Statute of the International Criminal Court (“Rome Statute” or “Statute”) is nearing completion. Basic normative structures governing the establishment and work of the future International Criminal Court (“Court”) have been negotiated. With the discussions on the first draft Budget (“Budget”) and other issues related to the administrative and financial operation of the Court, preparations have taken a significant “practical turn.” The fundamental aim of the Budget is to translate the objectives of the Court in monetary terms and to provide the resources needed by the Court's organs and the …

Adult Learning In The Context Of Interreligious Dialogue: A Collaborative Research Study Involving Christians, Jews, And Muslims, Nadira K. Charaniya, Jane West Walsh Jan 2001

Adult Learning In The Context Of Interreligious Dialogue: A Collaborative Research Study Involving Christians, Jews, And Muslims, Nadira K. Charaniya, Jane West Walsh

Dissertations

What do American Jews really know about Muslims? What do American Muslims really know about Jews? These questions undergird this account of how two religious adult educators--a Jew and a Muslim--came to engage in collaborative, dialogic, relational and transformational interreligious learning and research. Emerging out of this collaborative doctoral research project at National-Louis University, this study addresses two different dimensions of research and practice in the field of adult education: the nature of adult learning in the interreligious dialogue process and the role of collaborative methods in research methodology.

Adult learning in the context of interreligious dialogue can best be …

Environmental Influences On Financial And Nonfinancial Web Disclosure, Abigail Adams Bowen Jan 2001

Environmental Influences On Financial And Nonfinancial Web Disclosure, Abigail Adams Bowen

Honors Theses

Investors and financial analysts rely considerably on corporate information to make business decisions. This study of financial and nonfmancial disclosure practices analyzes the influence that culture, firm size, and foreign sales might have over the information that companies choose to place on the web. Using over one hundred and fifty company websites across seven different countries, I developed a list of financial and nonfmancial disclosure categories to evaluate each company website. Statistical tests provide evidence that cultural variables, such as the degree of masculinity and individualism, as well as total sales volume have a significant influence over levels of nonfmancial …

Evangelizing The Secular-Minded: A Training Seminar For The University Seventh-Day Adventist Church In East Lansing, Michigan, Roy Anthony Castelbuono

Doctor of Ministry Projects

Topic

Today in many ways our world has been unified, not by a political empire but by a way of thinking. People today find common ground in a shared experience of living guided by a set of values that spans the divide of culture, language, and history. The process of this transformation is best described by the term “secularization.” Secularization best describes the far-reaching changes we find in our communities and in our personal lives, and is one of the greatest challenges the Seventh-day Adventist Church faces as we begin the twenty-first century.

Purpose

The purpose of this project was …

A Seminar On Reaching The Secular Mind For Members And Guests Of The Hickory Seventh-Day Adventist Church, Kenneth J. Ford

Doctor of Ministry Projects

Problem

Western civilization is now pre- or post-Christian. Secularism has entrenched itself in our culture. Many churches are still utilizing mostly antiquated methods of reaching a Christian culture. We need to discover methods to engage the twenty-first-century secular mind.

Method

This report is outlined in the following way. It gives a brief overview of secularism by defining and then tracing its origin and development. Then it gives an overview of biblical, SDA, and selected evangelical literature on reaching the secular mind. A six-session seminar was formulated utilizing Microsoft PowerPoint, to be conducted sometime in the near future.

Results

The results …
