A Non-Authoritative Educational Metadata Ontology For Filtering And Recommending Learning Objects, Mimi Recker, David A. Wiley Jan 2001

A Non-Authoritative Educational Metadata Ontology For Filtering And Recommending Learning Objects, Mimi Recker, David A. Wiley

Instructional Technology and Learning Sciences Faculty Publications

Digital libraries populated with learning objects are becoming popular tools in the creation of instructional technologies. Many current efforts to create standard metadata structures that facilitate the discovery and instructional use of learning objects recommend a single, authoritative metadata record per version of the learning object. However, as we argue in this paper, a single metadata record — particularly one with fields that emphasize knowledge management and technology, while evading instructional issues — provides information insufficient to support instructional utilization decisions. To put learning objects to instructional use, users must examine the individual objects, forfeiting the supposed benefits of the …

A Primer On Learning Styles: Reaching Every Student, M.H. Sam Jacobson Jan 2001

A Primer On Learning Styles: Reaching Every Student, M.H. Sam Jacobson

Seattle University Law Review

Many authors and researchers have written extensively about learning styles, but the literature can be daunting to the uninitiated. This article establishes a framework that will put the literature into perspective, will allow professors to evaluate what is meant by "learning syle," and will give them guidance for how to be more effective teachers both in the classroom and out. Part I discusses how knowledge of learning styles will help professors achieve their pedagogical goals. Part II discusses the personal characteristics that contribute to learning style. Finally, Part III applies the learning styles to the learning cycle and discusses how …

Getting The Insider's Story Out: What Popular Film Can Tell Us About Legal Method's Dirty Secrets, Rebecca Johnson, Ruth Buchanan Jan 2001

Getting The Insider's Story Out: What Popular Film Can Tell Us About Legal Method's Dirty Secrets, Rebecca Johnson, Ruth Buchanan

Articles & Book Chapters

In this paper, the authors seek to use the insights gained by viewing and thinking critically about a range of Hollywood films to better illuminate the disciplinary blindspots of law. Both law and film are viewed as social institutions, engaged in telling stories about social life. Hollywood films are often critical of law and legal institutions. Law is dismissive of its representation within popular culture. However, the authors argue that law disregards cinematic cynicism about itself at its peril and that there is much to learn by taking cinematic portrayals of law very seriously---not as representations of the truth of …

The Past And Future Of Canadian Generalist Law Journals, Bruce Ryder Jan 2001

The Past And Future Of Canadian Generalist Law Journals, Bruce Ryder

Articles & Book Chapters

The author reviews the history and evolution of Canadian university-based generalist journals. The growth in the number of these journals grew steadily from the late 1940s to the early 1970s, and then stopped abruptly. The driving force behind the establishment of these journals were local and pedagogical: they were adjuncts of students' legal education. By the late 1960s and early 1970s, most generalist journals had outgrown their original mission. They became significant venues for the publication of legal scholarship and reformulated their aims and procedures to set high scholarly standards. All of the existing university-based generalist law journals now have …

Of Butterflies And Bitterness?: Legal Fictions In Corporate And Securities Law, Mary G. Condon Jan 2001

Of Butterflies And Bitterness?: Legal Fictions In Corporate And Securities Law, Mary G. Condon

Articles & Book Chapters

The theme of fictions in law in the context of corporate and securities law raises some intriguing issues, and I am particularly grateful for the opportunity it gives me to rethink some of my previous work on corporate law. At one level, the topic of fictions in law is an obvious one for an Anglo-American corporate lawyer. One of the first principles of Anglo-American corporate law that students learn is that the corporation is best understood as a legal fiction. The principle is otherwise known as the doctrine of the separate legal personality of the corporation. This is the idea …

The Role Of Judges In Legal Theory And The Role Of Legal Theorists In Judging (Or 'Don't Let The Bastaraches Grind You Down, Allan C. Hutchinson Jan 2001

The Role Of Judges In Legal Theory And The Role Of Legal Theorists In Judging (Or 'Don't Let The Bastaraches Grind You Down, Allan C. Hutchinson

Articles & Book Chapters

What is the future of law reviews? And does it matter? These are important questions, at least to legal academics and the students who run them. Whether the world would be any worse off if law reviews ceased to exist or, more realistically, if the number of law reviews was significantly reduced is moot at best. In this regard, the central challenge to law reviews is provided by the Internet. Its capacity to revolutionize the rarefied culture of law reviews and legal scholarship is profound and presents opportunities and threats that many have only begun to imagine or realize. Nevertheless, …

Re-Imagining International Human Rights Education In Our Time: Beyond Three Constitutive Orthodoxies, Obiora Chinedu Okafor, Shedrack C. Agbakwa Jan 2001

Re-Imagining International Human Rights Education In Our Time: Beyond Three Constitutive Orthodoxies, Obiora Chinedu Okafor, Shedrack C. Agbakwa

Articles & Book Chapters

This article seeks to show that both the conceptualization and practice of international human rights education within the mainstream human rights community has been shaped and framed, with mostly negative consequences, by at least three constitutive orthodoxies: a heaven-hell binary distinction between an all but "perfect" West and an all but "hellish" Third World, a consequent unidirectional traffic of human rights teaching from the West to the rest, and a reliance on the abolitionist paradigm of human rights education. It starts by mapping these orthodoxies, and proceeds thereafter to challenge them as fundamentally problematic and as capable of frustrating the …

The Law-Making Role Of The Supreme Court Of Canada: Rapporteur's Synthesis, Peter W. Hogg Jan 2001

The Law-Making Role Of The Supreme Court Of Canada: Rapporteur's Synthesis, Peter W. Hogg

Articles & Book Chapters

The adoption of the Charter of Rights in 1982 thrust a new role on the Supreme Court of Canada. The Court was required to resolve issues that would formerly have been regarded as matters of policy for the legislative bodies. This article shows that the new policy-making role of the Court has carried over into non-Charter fields, such as federalism, evidence, administrative law, torts, and family law.

Will The Heavens Fall? De-Radicalizing The Precedent-Breaking Decision, Paul Waldau Jan 2001

Will The Heavens Fall? De-Radicalizing The Precedent-Breaking Decision, Paul Waldau

Animal Law Review

This article offers an extended analogy for the purpose of posing basic questions about proposals for granting legal rights to some nonhuman animals. The analogy is drawn from the precedent-breaking eighteenth century English case Somerset v. Stewart, which liberated an African slave. The article argues that one can identify features of the eighteenth century debate which illuminate features of today's debate over proposed uses of centrally important legal concepts for some nonhuman animals. Using the comparison for the limited task of highlighting the complex cultural backdrop in each situation, the article suggests that the comparison helps one see the nature …

Finally, Ms. Alicia Finigan has reported on the United State's Pelly Amendment certification of Japan for violating the International Whaling Commission's resolution to cease its illusory "research whaling" for minke, sperm and Bryde's whales.

Dead Dog Running: The Cruelty Of Greyhound Racing And The Bases For Its Abolition In Massachusetts, Erin N. Jackson Jan 2001

Dead Dog Running: The Cruelty Of Greyhound Racing And The Bases For Its Abolition In Massachusetts, Erin N. Jackson

Animal Law Review

Under the guise of sport, greyhound racing persists in Massachusetts and sixteen other states, despite the industry's notoriety for animal abuse. The cruel practices employed in greyhound racing, including the culling of litters; the use of live lures in training; the provision of substandard living conditions and care; and the systemic, premature killing of greyhounds bear undeniable likeness to the barbarity perpetrated in the illicit animal fighting sports of bullfighting, dogfighting, and cockfighting. Yet, greyhound racing masquerades in the Commonwealth as an innocuous pastime, even though the industry-wide, calculated refusal to provide care for and consequent killing of throngs of …

An Introduction To The Model Standards Of Practice For Family And Divorce Mediation, Andrew Schepard Jan 2001

An Introduction To The Model Standards Of Practice For Family And Divorce Mediation, Andrew Schepard

Hofstra Law Faculty Scholarship

On February 19, 2001, upon the recommendation of both the Family Law (FLS) and Dispute Resolution Sections, the American Bar Association's House of Delegates adopted the Model Standards of Practice for Family and Divorce Mediation (“Model Family Mediation Standards” or “Model Standards”), which are published in this issue of the Family Law Quarterly.

The aim of the Model Family Mediation Standards is to promote public confidence in an evolving, interdisciplinary profession by defining good mediation practice. The family mediation profession (which includes many lawyers) created the Model Family Mediation Standards in consultation with the family …

Structural And Functional Characterization Of The Activator Of G-Protein Signaling 3 (Ags3), Michael Labranche Bernard Jan 2001

Structural And Functional Characterization Of The Activator Of G-Protein Signaling 3 (Ags3), Michael Labranche Bernard

MUSC Theses and Dissertations

AGS3 (Activator of G-protein Signaling 3) was isolated in yeast-based functional screen for receptor-independent activators of heterotrimeric G-proteins. To examine the role of AGS3 in mammalian signal processing, we defined the AGS3 sub domains involved in G-protein interaction, its selectivity for G-proteins and its influence on the activation state of G-protein. AGS3 co-immunoprecipitated with Gia3 from tissue lysates in a nucleotide dependent manner (GDP»GTPγS). The regions of AGS3 that bound Giα were localized to 4 thirty amino acid repeats (GPR - G-protein regulatory motif) in the carboxyl terminus (P463-S650), each of which were capable of binding Giα. AGS3-GPR domains selectively …
