Appalachia On Stage: The *Southern Mountaineer In American Drama., Laura Grace Pattillo Jan 2001

Appalachia On Stage: The *Southern Mountaineer In American Drama., Laura Grace Pattillo

LSU Historical Dissertations and Theses

This study examines the portrayal of Southern Appalachian people and their culture in American drama, discussing works from time periods that range from the 1880s to the 1990s. The plays are grouped into categories that are reflective of mainstream America's perceptions of Appalachian culture: (1) the importance of family and gender roles, including the insider/outsider romance plot, (2) issues of violence and conflict between both internal and external forces within the region in the context of wars, feuds, and environmental and labor abuses, (3) the importance of folk practice and belief including tales of the supernatural, superstitious and astrological traditions, …

Combating Fetal Substance Abuse And Governmental Foolhardiness Through Collaborative Linkages, Therapeutic Jurisprudence And Common Sense: Helping Women Help Themselves, David C. Brody, Heidee Mcmillin

UC Law SF Journal on Gender and Justice

Annually thousands of babies are born exposed to alcohol or illicit drugs while in their mother's womb. While the government has addressed the problem by punishing pregnant women and their children, the number of affected infants continues to rise. This is largely due to states taking gendered, punitive and illogical actions, which are antithetical to the social, scientific and medical research that has shown that treatment, not punishment, is the appropriate means to deal with the problem. Instead of addressing the problem honestly in search of a practical solution, states have focused on casting blame and meting out punishment upon …

Cybercoverage For Cyber-Risks: An Overview Of Insurers' Responses To The Perils Of E-Commerce, Robert H. Jerry Ii, Michele L. Mekel

Faculty Publications

With nearly seven percent of the world's population currently online and e-commerce forecast to hit $6.8 trillion by 2004, one need not be Nostradamus to predict that the Internet means great change for all industries - including the insurance industry. Presently, however, the proverbial cart is leading the horse as the insurance industry struggles to develop strategies to quantify, cover, and contain "cyber-risks." Policyholders also face new challenges as they confront the possibility that their traditional insurance coverages are woefully inadequate either to secure their electronic and intellectual property assets or to guard against their potential e-commerce liabilities to third …

Turning Gray Into Green: Some Comments On Napster, Shubha Ghosh Jan 2001

Turning Gray Into Green: Some Comments On Napster, Shubha Ghosh

UC Law SF Communications and Entertainment Journal

File sharing involves a combination of legitimate distribution and illegitimate copying, and the two cannot be separated. The prevailing argument in the Ninth Circuit's Napster opinion, that he infringement is not in the distribution or the sharing, but in the copying, ignores the merger of copying and distribution. This article analyzes the economics of intellectual property, and applies that economic analysis to Napster as an alternative mechanism for the distribution of music. This article suggests that owners of file sharing systems like Napster privatize their economic interests through intellectual property law, by obtaining business method patent protection for file sharing …

The First Amendment As A Check On Copyright Rights, Alan E. Garfield Jan 2001

The First Amendment As A Check On Copyright Rights, Alan E. Garfield

UC Law SF Communications and Entertainment Journal

Parties are increasingly raising the First Amendment as a potential limit on the scope of copyright rights. However, courts have traditionally found that copyright law already incorporates First Amendment interests, as it precludes protection of ideas and allows for the "fair use" of expression. This article addresses the issue of whether there needs to be additional First Amendment restraints. The author focuses on the broader principles of the First Amendment, and whether copyright law fully incorporates those principles. The author then discusses two recent cases, Worldwide Church of God v. Philadelphia Church of God and Los Angeles Times v. Free …

Using Technology To Circumvent The Law: The Dmca's Push To Privatize Copyright, Matt Jackson Jan 2001

Using Technology To Circumvent The Law: The Dmca's Push To Privatize Copyright, Matt Jackson

UC Law SF Communications and Entertainment Journal

The anti-circumvention provisions of the Digital Millennium Copyright Act of 1998 threaten free speech by giving copyright owners extralegal protection for their works. The Act allows a copyright owner to adopt technological measures that may be used to expand control over their works beyond the limits created by the Copyright Act, including the first sale doctrine and fair use. Rather than restricting circumvention technology, lawmakers and copyright owners should focus on infringing conduct. By focusing on such infringing activity, free speech rights will be safeguarded.

Legislative Prohibitions On The Enforcement Of Post-Employment Covenants Not To Compete In The Broadcasting Industry, Alice J. Baker Jan 2001

Legislative Prohibitions On The Enforcement Of Post-Employment Covenants Not To Compete In The Broadcasting Industry, Alice J. Baker

UC Law SF Communications and Entertainment Journal

This article examines covenants not to compete in the entertainment industry. In the first section of the article, the author discusses the common-law doctrine of non-competition agreements and their application in the context of the entertainment industry. Next, the author examines state legislative attempts to limit this type of agreement in the broadcasting industry, including possible justifications for a legislative prohibition on them in the entertainment industry. The author concludes that the costs of blanket prohibition outweigh the benefits of prohibitive legislation, and argues that broadcasting companies and employees should be free to negotiate and enforce postemployment covenants not to …

Reconstructing First Amendment Doctrine: The 1990s (R)Evolution Of The Central Hudson And O'Brien Tests, Susan Dente Ross Jan 2001

Reconstructing First Amendment Doctrine: The 1990s (R)Evolution Of The Central Hudson And O'Brien Tests, Susan Dente Ross

UC Law SF Communications and Entertainment Journal

In this article, the Supreme Court's shifting and expanding approach to intermediate scrutiny of commercial free speech under the First Amendment is examined. The author maintains that the Supreme Court has increased the level of review for content-neutral laws regulating commercial speech, while decreasing the level of review of laws affecting the media. The author argues that these analytical shifts have eroded First Amendment protection for the media, replacing the traditional notion that the media is central to a functioning democracy with the view that the press is simply a powerful, commercial enterprise. The author concludes by contrasting two recent …

Reproductive Health

Irreconcilable Differences: Congressional Treatment Of Internet Service Providers As Speakers, Raymond Shih Ray Ku Jan 2001

Irreconcilable Differences: Congressional Treatment Of Internet Service Providers As Speakers, Raymond Shih Ray Ku

Faculty Publications

This Article argues that under the CDA and OCILLA, Congress adopted facially inconsistent approaches towards ISP liability for expression. Nonetheless, despite the overt differences, it is possible to discern an underlying principle for determining when ISPs should be considered speakers that reconciles this inconsistency. Put simply, the CDA and OCILLA support an approach toward determining when ISPs are speakers that focuses on whether an ISP exercises editorial control over its network. This approach is evidenced by the fact that both statutes recognize that ISPs are able to exercise editorial control over any and all content on their networks, and both …

Supreme Court Voting Behavior: 1999 Term, Richard G. Wilkins, Scott Worthington, Rachelle Fleming, Matthew Fleming Jan 2001

Supreme Court Voting Behavior: 1999 Term, Richard G. Wilkins, Scott Worthington, Rachelle Fleming, Matthew Fleming

UC Law Constitutional Quarterly

This Study, the fourteenth in a series, tabulates and analyzes the voting behavior of the United States Supreme Court during the 1999 Term. The analysis is designed to determine whether individual Justices and the Court as a whole are voting more "conservatively," more "liberally," or about the same as compared with past Terms. This Term's survey suggests a reversal of the Court's liberal trend over the past two Terms, with conservative movement in six of the ten categories. Specifically, the Court's support of statutory civil rights claims plummeted to an all time low, while the Court exhibited a dramatic conservative …

Latent Maximum Entropy Principle For Statistical Language Modeling, Shaojun Wang, Ronald Rosenfeld, Yunxin Zhao Jan 2001

Latent Maximum Entropy Principle For Statistical Language Modeling, Shaojun Wang, Ronald Rosenfeld, Yunxin Zhao

Kno.e.sis Publications

We describe a unified probabilistic framework for statistical language modeling, the latent maximum entropy principle. The salient feature of this approach is that the hidden causal hierarchical dependency structure can be encoded into the statistical model in a principled way by mixtures of exponential families with a rich expressive power. We first show the problem formulation, solution, and certain convergence properties. We then describe how to use this machine learning technique to model various aspects of natural language, such as syntactic structure of sentences, semantic information in a document. Finally, we draw a conclusion and point out future research directions.

Public Sphere In Cyberspace?, Mark D. Johns Jan 2001

Public Sphere In Cyberspace?, Mark D. Johns

Iowa Journal of Communication

According to Jurgen Habermas, a public sphere is a site where individuals come together to freely and openly express their opinions regarding matters of common interest. Informed by Habermas' discussion, the author investigated the social farms generated in computer-mediated communication and examined whether the social structures in cyberspace are conducive to the formation of a public sphere. Communication among the members of three Internet newsgroups were examined to locate the formal features of the social relationships constructed in this cyberspace. The conclusion is that while a public sphere may be possible, cyberspace often falls short of fulfilling its potential for …

Part I of this article reviews these new legislative provisions, discussing their requirements as well as the general impetus behind their enactment. Part II discusses both the history of rape prosecution and feminist efforts in the 1970s and 1980s to eliminate barriers to successful rape prosecutions. This part also elaborates upon the myth of the crazed rapist and its relationship to feminist reform efforts. Part III explains how the current legislation is rooted in and reinforces that myth by encouraging unsupportable distinctions among rape defendants. Finally, Part IV discusses the feminist response to such laws and argues for a more …

Polymerase Chain Reaction (Pcr) Techniques For The Identification Of Uncultivable Oral Microorganisms, W.H. Himratul-Aznita

Research Publications (2000 to 2005)

Until today there are still a high percentage of oral microorganisms have not been identified due to inability to isolate using the cultural method. However, identification of uncultivable microorganisms associated with disease will permits clinicians for a more accurate diagnosis, treatment and preventive measures. Unculturable microorganisms are also involved in disease and may account for treatment failure since their susceptibility to antimicrobial agents would be unknown. Thus, the opportunity for a rational approach to the treatment of disease relies on the state of knowledge concerning its aetiology and pathogenesis. Recently developed molecular methods have made it possible to characterise mixed …
