The tension illuminates fundamental clinical and policy questions that doctors, the health care system, and the legal system confront today.

The Social Meaning Of Environmental Command And Control, Michael P. Vandenbergh Oct 2001

The Social Meaning Of Environmental Command And Control, Michael P. Vandenbergh

Vanderbilt Law School Faculty Publications

...This essay draws on the new social norms literature to examine one of the possible reasons for the public misperceptions about the sources of the remaining environmental problems. The essay suggests that one of the insights of the social norms literature, the influence of social meaning on social norms, may shed light on these misperceptions and may enrich our understanding of the difficulties encountered by efforts to control second generation sources. In particular, this essay examines two principal social meanings that appear to have been conveyed by the command and control system. The first social meaning is the conventional notion …

The Cashless Corporate Tax, Herwig J. Schlunk Oct 2001

The Cashless Corporate Tax, Herwig J. Schlunk

Vanderbilt Law School Faculty Publications

Proposals for reforming the federal corporate income tax are neverending and ever-multiplying. They range from those that merely tinker around the edges, such as most recent proposals attacking the various perceived abuses that masquerade under the moniker "corporate tax shelter," to various integration approaches that arguably would gut the enterprise of a corporate income tax altogether. Since everything and the kitchen sink is at least theoretically in play, it seems appropriate to add this modest proposal, which I call the "cashless corporate tax" (CCT). As described below, the CCT is a "tax" that would replace the current corporate income tax-defined …

Business Lawyer, Woman Warrior: An Allegory Of Feminine And Masculine Theories, Barbara Ann White Oct 2001

Business Lawyer, Woman Warrior: An Allegory Of Feminine And Masculine Theories, Barbara Ann White

All Faculty Scholarship

The first part of this essay is a discourse on how two of the last half century’s most influential contributions to legal thinking: Law and Economics Jurisprudence and Feminist Legal Theory, whose adherents are normally adversaries, can function synergistically to create a greater analytic power. Using business law issues as an example - historically law and economics’ terrain but recently explored by feminism - I comment on how each can unravel different knots but each standing alone leave other conundrums unresolved.

Expanding on the feminist concept of “masculine thinking,” I discuss how, just as law and economics’ analytic style (i.e., …

The Influence Of Ramayana On The Vaishnava Hymns, R. Seeta Lechumi Ratha Krishnan Oct 2001

The Influence Of Ramayana On The Vaishnava Hymns, R. Seeta Lechumi Ratha Krishnan

Student Works (2000-2009)

The aim of this study is to identify and assess the influences of the Ramayanas on the hymns of the Tamil Vaishnava saints called alvars. The hymns of each alvar is examined separately and the Ramayana incidents are then collectively scrutinised to assess the treatment of these incidents by the alvars. They are also compared with similar events in the Ramayanas of VaImiki and Kampar. Research for the study is based on the library method and for the collection of relevant material, the documentation method is used. The facts thus collected are analysed according to the synthesis method and then …

The Empire Of The Lone Mother: Parental Rights, Child Welfare Law, And State Restructuring, Hester Lessard Oct 2001

The Empire Of The Lone Mother: Parental Rights, Child Welfare Law, And State Restructuring, Hester Lessard

Osgoode Hall Law Journal

This article uses the Supreme Court of Canada's decision in G.(J.) v. New Brunswick to frame a discussion of the historical and ideological character of Canadian child welfare regimes on the nature and experience of women’s citizenship within the liberal political order and, in particular, within the current neo-liberal restructuring of welfare provision. The article also analyzes traditional understandings of the political character of child welfare in terms of state intervention and non-intervention, by placing the state ordering of parent-child relations in the context of larger issues of colonialism, gendered parenting discourses, and the linkage between child neglect and poverty. …

Hip-Hop/Scotch: "Sounding Francophone" In French And United States Cultures, Francesca Sautman Oct 2001

Hip-Hop/Scotch: "Sounding Francophone" In French And United States Cultures, Francesca Sautman

Publications and Research

This essay adresses the relationship between "being/speaking Francophone" and forms of ethnic-cultural dissent in France and the U.S. In both countries, terms such as Francophone and Francophonie are often captured by specific political agendas and practicies. What it means to be "Francophone" involves complex interfacings between various langages, including English and French, between competing discursive claims made on the basis of linguistic home and the particular forms of cultural and linguistic hybridity, such as French hip-hop culture and world music.

Review Of The Culture Of Lies And The Museum Of Unconditional Surrender By Dubravka Ugresic, Martha Kuhlman Sep 2001

Review Of The Culture Of Lies And The Museum Of Unconditional Surrender By Dubravka Ugresic, Martha Kuhlman

English and Cultural Studies Journal Articles

In 1993, a Danish critic reviewing Dubravka Ugrešić's novel Fording the Stream of Consciousness, a clever satire of a literary conference, accused her of engaging in a crass form of literary escapism when she should have been writing about the"bloody war" raging at home in her native Yugoslavia. Since the novel was first published in 1988, this criticism was entirely misplaced. In fact, the war has been on her mind the entire time, as is evident from her two most recent books, The Culture of Lies (essays 1991-1998) and The Museum of Unconditional Surrender (1991-1996).
