This Article explores whether global self-regulation of the legal profession is desirable. The Author explains that as global law practice has grown over the past decade, so has the desire to formulate global rules of professional responsibility. The Article focuses on large law firms offering transnational legal services in many countries. The Author addresses whether and for whom the aspiration to deliver core values at the global level is desirable. Uni-State Lawyers And Multinational Practice: Dealing With International, Transnational, And Foreign Law, Ronald A. Brand

Vanderbilt Journal of Transnational Law

This Article addresses how a lawyer may ethically engage in a transnational practice given the current structure of state-by-state bar admission. Part I examines the ethical pitfalls of a transnational practice, including an examination of applicable APA Model Rules of Professional Conduct. This section also addresses different tests for determining whether a lawyer has committed the unauthorized practice of law. Part III makes use of examples to illustrate the legal framework for determining whether a lawyer has committed the unauthorized practice of law. This Article examines the pressures of globalization on the practice of law and legal ethics from an Australian perspective. The Article first examines the positive aspects of globalization and then turns to the potentially disruptive and homogenizing aspects of globalization upon indigenous and non-Western societies. Next, the Article considers how globalization threatens to disrupt tradition and culture in Western societies, specifically focusing on the tradition of the law and legal practice. The case against affirmative action in admissions to institutions of higher education is based on the moral attractiveness of colorblind decision making and buttressed by a sense that such programs are not just unfair but pointless. Their intended beneficiaries, the argument goes, are put in situations in which they are unable to compete with whites and not only perform poorly but are destructively demoralized in the process. Lawyer And Public Service, The Historical Perspectives On Pro Bono Lawyering, Russell G. Pearce

Historically, the first way of viewing the lawyer's role was as a member of America's governing class. Second came cause lawyering on behalf of a particular issue. Third, and most recently, arose the idea of pro bono lawyering, a less ambitious incarnation of the governing class lawyer who contributes time to helping cause lawyers. These categories are not rigid: for each individual they may overlap to one degree or another. This framework is preliminary and requires further research and development. Factors Affecting Recidivism At A Transitional Shelter For The Homeless, Scianna Elizabeth Bowman Augustine

This thesis examines factors affecting recidivism (shelter reentry) among two-parent households, female-headed households, and single women, through a study of selected households utilizing a transitional shelter for the homeless in Las Vegas, Nevada. The paper touches on the history of homelessness in America, and explores some of the factors related to the increase in homelessness on the national and local level. It examines the shelter system---in particular, the provision of transitional shelter---as the primary intervention designed to return individuals and families to self-sufficiency. The study found that the three household types did not differ significantly in terms of recidivism. However, …

This Article provides information about a new method to shop for legal services, reinventing the way potential clients connect with attorneys. Several dot-coms manage the transaction in which clients purchase legal services through the Internet, providing a venue for businesses and individuals seeking legal services and attorneys interested in representing them. Every year tens of millions of small businesses and individuals are looking for a good attorney. But, for many consumers, the process of selecting a lawyer is a confusing and daunting task.
