A Code Of One's Own, Joseph P. Tomain Jan 2001

A Code Of One's Own, Joseph P. Tomain

Faculty Articles and Other Publications

A Code of One's Own is an essay exploring the idea that we can learn about professionalism by reflecting on the humanities. The paper is modeled on Virginia Woolf's A Room of One's Own which is a series of lectures in six chapters. The essay uses those chapters to develop the idea that lawyers, through self-reflection and observation, can develop a professional code of their own. The paper was developed through co-teaching a course entitled, Law in Literature and Philosophy as well as by attending the Aspen Institute and the Glenmoor Institute of Justice for the Legal Profession, which are …

Reading The Law In The Office Of Calvin Fletcher: The Apprenticeship System And The Practice Of Law In Frontier Indiana, A. Christopher Bryant

Faculty Articles and Other Publications

The university law school is a relatively recent innovation, not just in Nevada but throughout much of the United States as well. In this inaugural issue of the Nevada Law Journal, which marks the establishment in 1998 of the Boyd School of Law, the first state-supported and the only existing law school in Nevada, it is fitting that we examine the methods of legal education and entry to the practice of law that preceded the rise of legal education within the university.

Until the latter part of the nineteenth century, the apprenticeship system constituted the dominant mode of preparation for …

Come ‘Rap’ With Us: Improving The Retention Of Academically-Qualified Persons (Rap) With Gpas Of 3.0 Or Higher, The Grace E. Harris Leadership Institute At Virginia Commonwealth University, Pamela Boston, Ruth Epps, Cynthia Kirkwood, John Ward

The Grace E. Harris Leadership Institute Publications

Retention is an important area of concern for Virginia Commonwealth University (VCU). This project involves devising initiatives to identify and retain students with a high potential for academic success as outlined in the Strategic Plan for the Future of Virginia Commonwealth University, Phase II. It is theorized that by concentrating efforts on students (both in-state and out-of-state) with a cummulative GPA of 3.0 or higher, an improvement in the six-year graduation and freshmen retention rates can be realized. This would serve to enhance VCU’s status in the academic community (moving from Tier 3 to Tier 2 status) since twenty percent …

Child Emotional Maltreatment: A 2-Year Study Of Us Army Cases, Linda K. Jellen, James E. Mccarroll, Laurie E. Thayer

United States Army: Publications

Objective: Reports of childhood emotional maltreatment have increased greatly over the past decade. The objective of this research was to determine the types of emotional maltreatment substantiated in a community of US Army families residing temporarily in Germany. Such a description may help to improve the understanding of how a jurisdictional body defines emotional maltreatment in day-to-day practice.
Method: Data were obtained from a review of the minutes of case review committees (CRCs) for 181 cases of child emotional abuse in 1997–1998. We determined the type, number, and severity of incidents, the substantiation rate, and the situations to which children …

A Practical Guide To Estimating Cleanup Costs, Mike Goldstein, Jon Ritterling Jan 2001

A Practical Guide To Estimating Cleanup Costs, Mike Goldstein, Jon Ritterling

United States Environmental Protection Agency: Publications

Cost estimates are frequently developed to evaluate hazardous-waste-site cleanup options in support of a site investigation, remedy selection decision, or assessment of environmental liabilities. The accuracy of the cost estimate depends largely on the quality of the information available at the time it is prepared. This article presents a practical guide to developing a cleanup cost estimate. It includes information on how to document assumptions, use the latest technical resources, and perform basic adjustments to account for uncertainty and the time value of money. The content is based upon a recent guidance document issued by the U.S. Environmental Protection Agency …

Are Medical Ethics Different From Legal Ethics?, Mervin H. Needell Jan 2001

Are Medical Ethics Different From Legal Ethics?, Mervin H. Needell

St. Thomas Law Review

In this paper I shall compare and contrast some relevant ethical positions of legal and medical precepts and practices which seem to suggest or predispose to a professional bias. I derive these conclusions from official positions contained in institutional accounts, such as case law or treatises. Even if such comparisons do not make a convincing case for professional bias, they should still provide some insight into the ways in which the thought processes of lawyers and doctors do or do not differ. Although the words "moral" and "ethical" are often used interchangeably, if a distinction must be made here, I …

Voluntariness With A Vengeance: Miranda And A Modern Alternative, Jonathan B. Zeitlin Jan 2001

Voluntariness With A Vengeance: Miranda And A Modern Alternative, Jonathan B. Zeitlin

St. Thomas Law Review

One of the most famous opinions in American jurisprudence is that of the United States Supreme Court in the case of Miranda v. Arizona. The Court's prophylactic rule in Miranda has been followed in both state and federal courts with little derogation for over thirty years. On February 8, 1999, in Dickerson v. United States, the United States Court of Appeals for the Fourth Circuit ignored Miranda, turning instead to 18 U.S.C. § 3501, a relatively obscure federal statute enacted in 1968 in response to the Court's decision in Miranda. The United States Supreme Court granted certiorari and heard oral …
