The Federal Government As A Useful Enemy: Perspectives On The Bush Energy/Environmental Agenda From The Texas Oilfields: Second Annual Gilbert And Sarah Kerlin Lecture, Jacqueline Lang Weaver

Pace Environmental Law Review

This article is a longer adaptation of the speech given by Professor Weaver as the Kerlin Distinguished Lecturer in Environmental Law on September 20, 2001 at Pace University School of Law. The author looks at how President Bush, raised in the west Texas oil town of Midland, was quick to respond to the emerging energy crisis with an energy plan formulated by a task force headed by Vice President Cheney, another oilman with western roots. The President's new plan has been both touted and widely criticized as being an oilman's dream pushing fossil fuel production, dismissing conservation, and reducing environmental …

Rcra Citizen Suits And State Courts: Jurisdictional Trap After Davis V. Sun Oil Company, A. Mark Segreti Jr. Sep 2001

Rcra Citizen Suits And State Courts: Jurisdictional Trap After Davis V. Sun Oil Company, A. Mark Segreti Jr.

Pace Environmental Law Review

This article discusses the problems of splitting a cause of action between state and federal courts when both a RCRA citizen suit and common law claims could be made. The author addresses this issue through analyzing the history of Davis v. Sun Oil Company. The issue of whether or not there was concurrent federal and state court jurisdiction over RCRA citizen suits was never decided before Davis v. Sun Oil Company. The Sixth Circuit held that RCRA did not grant exclusive federal court jurisdiction. Davis lost the benefit of the federal statute and now any property owner seeking relief for …

Invited Synthesis Paper: Principles And Practices For Managing Rangeland Invasive Plants, Robert A. Masters, Roger Sheley Sep 2001

Invited Synthesis Paper: Principles And Practices For Managing Rangeland Invasive Plants, Robert A. Masters, Roger Sheley

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Invasive plants reduce the capacity of ecosystems to provide goods and services required by society, alter ecological processes, and can displace desirable species. They can reduce wildlife habitat quality, riparian area integrity, rangeland economic value, and enterprise net returns. The invasion process is regulated by characteristics of the invading plant and the community being invaded. The presence and spread of invasive plants is often symptomatic of underlying management problems that must be corrected before acceptable, long-term rangeland improvement can be achieved. Disturbance appears to be important early in the invasion process because it creates vacant niches that alien plants can …

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Current vegetable production systems use polyethylene (plastic) mulch and require multiple applications of agrochemicals. During rain events, runoff from vegetable production is enhanced because 50 to 75% of the field is covered with an impervious surface. This study was conducted to quantify off-site movement of soil and pesticides with runoff from tomato (Lycopersicon esculentum Mil.) plots containing polyethylene mulch and a vegetative mulch, hairy vetch (Vicia villosa Roth). Side-by-side field plots were instrumented with automated flow meters and samplers to measure and collect runoff, which was filtered, extracted, and analyzed to determine soil and pesticide loss. Seasonal losses …

Barkocy-Gallagher, Terrance M. Arthur, Gregory R. Siragusa, James E. Keen, Robert O. Elder, William Laegreid, Mohammad Koohmaraie

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Escherichia coli O157:H7 and O157 nonmotile isolates (E. coli O157) previously were recovered from feces, hides, and carcasses at four large Midwestern beef processing plants (R. O. Elder, J. E. Keen, G. R. Siragusa, G. A. Barkocy-Gallagher, M. Koohmaraie, and W. W. Laegreid, Proc. Natl. Acad. Sci. USA 97:2999–3003, 2000). The study implied relationships between cattle infection and carcass contamination within single-source lots as well as between preevisceration and postprocessing carcass contamination, based on prevalence. These relationships now have been verified based on identification of isolates by genomic fingerprinting. E. coli O157 isolates from all positive samples were analyzed …

The Influence Of Gender On The Relationship Between Problem-Solving And Agression, Maria Evola Sep 2001

The Influence Of Gender On The Relationship Between Problem-Solving And Agression, Maria Evola

Modern Psychological Studies

The continuous rise of violence among young people has caused aggression to become a variable of interest for society. Many people believe that controlling external factors will prevent the aggressive nature of children from developing. However, the key to reducing aggression may lie in the development of proper internal coping skills. The present study focused on problem-soling ability, a component that can be taught. The relationship between problem-solving and aggression was examined, as well as how gender moderates this connection. It was hypothesized that a negative relationship existed between the two variables and that the correlation would be stronger for …

Peer Perception Of Physically Attractive Children And Prejudicial Biases Against Physically Unattractive Children, Darla J. Lawson Sep 2001

Peer Perception Of Physically Attractive Children And Prejudicial Biases Against Physically Unattractive Children, Darla J. Lawson

Modern Psychological Studies

This paper discusses peer perceptions of children based, upon the physical appearance of other children. The suggestion that physical attractiveness is related to intellect, social status, and personal achievement may seem absurd or unrealistic, however, current research establishes it as fact. Physically attractive children are assumed to have better characteristics than unattractive children. These perceptions are shaped, in part, by the physical appearance of children. This study evaluated the perceptions of a group of children who viewed photographs of other children in which the group members considered to be physically attractive, of average appearance, and physically unattractive. Results of the …

Effects Of Campus Climate And Attitudes On The Identity Development Of Gay, Lesbian And Bisexual College Students, Katherine M. Yamakawa, Elizabeth Nutt Williams Sep 2001

Effects Of Campus Climate And Attitudes On The Identity Development Of Gay, Lesbian And Bisexual College Students, Katherine M. Yamakawa, Elizabeth Nutt Williams

Modern Psychological Studies

To investigate campus climate and its effect on the identity development and college experiences of gay, lesbian, and bisexual students, undergraduate college students were asked to complete measures of homophobia and campus climate. Results indicated that males and firstyear students report higher levels of homophobia than females and seniors. However, students reported knowing of or engaging in only few instances of homophobic behaviors and felt that the college community was relatively openminded. Four qualitative interview examples are also provided, documenting the experience of gay students' identity development and the effects that campus climate has had on their undergraduate experiences. The …
