Wrongful Death Actions Based On Medical Negligence: How Long Do Minors Have To Sue For The Death Of A Parent?, Rebecca L. Lewis

Texas Wesleyan Law Review

The Texas Supreme Court should take the position that an action for wrongful death is derived from the decedent's right to sue for any injury, and as such, the plaintiff, even though a minor, should inherit the statute of limitations from the decedent. In other words, children suing for the wrongful death of their parent due to medical malpractice should have two years from the date of the negligence in which to bring their claim. This report is designed to provide an overview of the Medicaid provisions of the Ticket to Work and Work Incentives Improvement Act of 1999, Public Law 106-170. This report considers the implications of the Act for the design and support of comprehensive, Medicaid-financed systems of health care for workers with severe disabilities and impairments, with a specific focus on persons with mental illness and addiction disorder disabilities. The Act, described by advocates for persons with disabilities as the most important piece of disability-related legislation since the enactment of the Americans with Disabilities Act of 1990, expands the availability of health …

Maximum Likelihood Estimation Of Ordered Multinomial Parameters, Nicholas P. Jewell, John D. Kalbfleisch

U.C. Berkeley Division of Biostatistics Working Paper Series

The pool-adjacent violator-algorithm (Ayer, et al., 1955) has long been known to give the maximum likelihood estimator of a series of ordered binomial parameters, based on an independent observation from each distribution (see Barlow et al., 1972). This result has immediate application to estimation of a survival distribution based on current survival status at a set of monitoring times. This paper considers an extended problem of maximum likelihood estimation of a series of ‘ordered’ multinomial parameters. By making use of variants of the pool adjacent violator algorithm, we obtain a simple algorithm to compute the maximum likelihood estimator and demonstrate …

The article examines two important messages for behavior analysts contained in the book "Guns, Germs, and Steel: The Fates of Human Societies," by Jared Diamond. It provides an environmentalist explanation of the different fates of the world's cultures that are compatible with the views of many behavior analysts. It details ways for behavior analysts to investigate the neglected forms of individual behavior.

The Earnings And Employment Of Nurses In An Era Of Cost Containment, Edward J. Schumacher

Health Care Administration Faculty Research

Previous research has shown that from the 1980s through the early 1990s, nurses enjoyed substantial wage and employment gains that stemmed, to some extent, from increased labor demand. Using individual data for 1988-98 to compare nurses' fortunes with those of college-educated women and other workers in the health care industry, the author documents that nurses experienced a decline in real wages beginning in the early 1990s, at the same time that the skill premium for RNs, as reflected by the return to education and experience, was increasing. Changes in measured characteristics and their returns explain very little of the decline, …
