State Constitutional Restrictions On Legislative Procedure: Rethinking Analysis Of Original Purpose, Single Subject, And Clear Title Challenges, Martha Dragich

Recognizing that state courts are beginning to review procedural challenges more rigorously, this Article attempts to provide guidance for the resolution of such cases. Part I examines the history, purposes, and standards of original purpose, single subject, and clear title restrictions, using Missouri's provisions as examples. Part I also identifies paradigmatic cases of each of the procedural violations with the hope of more sharply differentiating the three claims. Parts II through V present a case study of ten Missouri cases decided since 1994, supplemented with notable cases from other states. Part II begins with a brief description of the Missouri …

Granting Forgiveness Or Harboring Grudges: Implications For Emotion, Physiology, And Health, Charlotte Witvliet, Thomas Ludwig, Kelly L. Vander Laan

Interpersonal offenses frequently mar relationships. Theorists have argued that the responses victims adopt toward their offenders have ramifications not only for their cognition, but also for their emotion, physiology, and health. This study examined the immediate emotional and physiological effects that occurred when participants (35 females, 36 males) rehearsed hurtful memories and nursed grudges (i.e., were unforgiving) compared with when they cultivated empathic perspective taking and imagined granting forgiveness (i.e., were forgiving) toward real-life offenders. Unforgiving thoughts prompted more aversive emotion, and significantly higher corrugator (brow) electromyogram (EMG), skin conductance, heart rate, and blood pressure changes from baseline. The aim of this research project was to provide a general description of different groups of juvenile sex offenders in Western Australia (WA), and to describe their offence histories and re-offending. It also aimed to compare the juvenile sex offenders with all juvenile offenders in WA. The last aim was to identify variables, which could discriminate between juveniles who are convicted of later sex offences, and those who are not. The sample consisted of 334 juvenile sex offenders convicted in the WA Children’s Court (Court) from January 1990 until the end of June 1998. To achieve this, the research team …

This study explores how advertising and company promotion may be used to address social issues. In particular, I examine how the clothing company United Colors of Benetton attempted to position itself within the AIDS crisis. Specifically, this study investigates through case studies how the Benetton Group used activist advertising and company promotion to bring about social change concerning AIDS-related issues. I also attempt to account for the controversy that the promotion elicited through establishing the anomalous status of the company's promotion within traditional advertising efforts. Several studies have demonstrated the advantages of using interactive voice response (IVR) technology to collect self-report data from research participants and recipients of psychological/medical services. IVR allows participants to phone a computer and respond to recorded questions by pressing the appropriate touch-tone keys on their telephone. Because this technology offers substantial benefits in terms of cost and efficiency, it is surprising that it has not been more widely utilized by researchers and practitioners. Unless Texas expressly waives its Eleventh Amendment sovereign immunity, its state employees will not have similar legal recourse and protection as those available to private employees. As in many other states, a party may not sue the State of Texas without its consent. Thus, in the absence of constitutional or statutory provisions to the contrary, a state may claim sovereign immunity against any suit brought by a private party in both federal and state court. In approaching the task of recommending how to structure a Directive on common minimum standards for the recognition ofrefugee status in the Member States of the European Union, I have struggled to avoid two extremes. On the one hand, my recommendations might simply have reflected a search for the common denominator of relevant practice. The risk of this sort of analysis is, of course, that it clearly promotes a "race to the bottom," in which those States which presently fully implement their international obligations are encouraged to reduce the standard of protection.
