The Competency Conundrum: Problems Courts Have Faced In Applying Different Standards For Competency To Be Executed, John L. Farringer, Iv

Vanderbilt Law Review

Throughout Anglo-American legal history, there has been a general agreement, based on numerous rationales, that mentally incompetent inmates should not be executed for their crimes. The recurring problem, however, is how to define "incompetence" or "insanity." Legislatures and courts have sought to provide a common- sense definition, but in practice judges must confront highly technical terminology from the ever evolving field of psychiatry. Additionally, the definition must be flexible enough to apply to a variety of cases, while being universal enough to assure that all defendants are treated fairly and equally.

Il-1 Induces Collagenase-3 (Mmp-13) Promoter Activity In Stably Transfected Chondrocytic Cells: Requirement For Runx-2 And Activation By P38 Mapk And Jnk Pathways, John A. Mengshol, Matthew P. Vincenti, Constance E. Brinckerhoff

Dartmouth Scholarship

Osteoarthritic chondrocytes secrete matrix metalloproteinase-13 (MMP-13) in response to interleukin-1 (IL-1), causing digestion of type II collagen in cartilage. Using chondrocytic cells, we previously determined that IL-1 induced a strong MMP-13 transcriptional response that requires p38 MAPK, JNK and the transcription factor NF-κB. Now, we have studied the tissue-specific transcriptional regulation of MMP-13. Constitutive expression of the transcription factor Runx-2 correlated with the ability of a cell type to express MMP-13 and was required for IL-1 induction; moreover, Runx-2 enhanced IL-1 induction of MMP-13 transcription by synergizing with the p38 MAPK signaling pathway. Diversity conflicts usually occur in organizations where communication is inadequate and generally require a third party to facilitate resolution. Developing and preserving healthy workplace relationships must be a top priority for all employees. Using mediation to resolve diversity conflicts in the workplace allow preservation of jobs and full and equal participation and contributions by all employees (including minority employee groups). This workshop is designed to provide people of color in predominantly white institutions an alternate dispute resolution method to resolve relational conflicts such as race, gender, age and culture differences.

The presenter outlines a theoretical argument suggesting that organizational attempts to increase short- and long-term motivation and loyalty may unwittingly exacerbate career and financial growth problems for some "minority" workers. Research on ethnic cultural tendencies and individual differences in spending propensities is used to support the notion that the use of incentive-based compensation systems and retirement programs could lead to employees being both undermined in terms of financial health and "slotted" into divergent career paths.

Statistics suggest that Latino youths are at risk for academic underachievement and withdrawal. Culturally sensitive approaches to supporting school achievement based on the needs of Latino youth and their families must be developed. In response to these needs, the Latino Research Initiative (LRI), a collaborative group with members from the University of Nebraska-Lincoln (UNL) and the Hispanic Community Center (HCC) created the Latino Achievement Mentoring Program (LAMP). Objectives: To assess the effects of Vipassana meditation on the physical and psychological health in a multi-ethnic population in the city of Muscat. Method: The subjects were participants of a Vipassana meditation course taught in a ten-day residential retreat. Self-assessments of health-related parameters and physical and psychological symptomatology were collected from them before and immediately after the course. A control group was tested for a similar time interval. Results: Immediately after their 10-day training, the Vipassana participants assessed themselves significantly higher compared to their levels prior to the course, suggesting that the 10 days’ practice had significantly improved their physical …

Background: The newly emerging practice of Pharmaceutical Care requires that pharmacists take responsibility for the outcomes of drug therapy. Improvement in Quality of Life (QoL) represents the final outcome of the care process and indicates the success of interventions. Objectives: To assess the impact of a Pharmaceutical Care specialist asthma service provided by community pharmacists to a sample of patients with asthma, the outcome indicators being changes in health status and QoL. Objective: To assess aerobic fitness in male and female adolescents using the multistage 20-metre shuttle run test and correlate it with selected fitness variables. Method: The subjects comprised 83 girls and 64 boys aged 15-16 years, randomly selected from two segregated government schools in Muscat. After the pupils filled in a short questionnaire on their personal leisure time activities of the preceding week, their heights and weights were measured. Aerobic fitness was assessed by estimating each pupil’s minimal oxygen uptake levels (VO2max) using the multistage 20-metre shuttle running test (20-MST). The Anchor: 2001

The Anchor began in 1887 and was first issued weekly in 1914. Covering national and campus news alike, Hope College’s student-run newspaper has grown over the years to encompass over two-dozen editors, reporters, and staff. For much of The Anchor's history, the latest issue was distributed across campus each Wednesday throughout the academic school year (with few exceptions). In recent years The Anchor moved to monthly print issues and a more frequently updated website. The Anchor is now published in print twice per academic semester. Occasionally, the volume and/or issue numbering is irregular.
